MINUTES PLANNING AND ZONING COMMISSION MEETING OF OCTOBER'3, 1996 7:00 P.M. CITY COMIMISSION CHAFERS CITY HALL, SANFORD, FLORIDA MEMB PRESENT: Otto Garrett Lynn Stogner Mac McClanahan Ben Dyal Jim Valerino Ross Robert Leon Brooks MEMBERS ABSENT: Helen Stairs - excused Michael Skat - excused SRS PRESENT: Jay Marder, Director of Planning and Development Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary Mr. Valerino called the meeting to order at 7:00 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 200 N. Holly Avenue in a GC -2, General Commercial Zoning District for the purpose of storage of business records. Parcel No. 25 -19 -30 -300- 0190 -00000 Owner: ONA Partnership; representative: James F. Hahn. Jim Hahn, 1115 Secret Lane, Deltona., was present for representation. He stated that the current use allows for a manufacturing facility and that he is requesting to change the use to allow for a storage facility. The types of records to be stored will include documents from lawyers and government facility files. There will be no traffic to site other than himself. Mr . Stogner moved f or approval based on Staf f ' s rec.ommend.ations. Seconded by Mr. Dyal. All in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request to establish a government owned use, a Seminole County Work Release Center at. Five Points, by Seminole County Government within an AG, Agriculture Zoning. District located at 212 Bush Boulevard. Owner: Seminole. Board of County Commission; representative: Emile Jammal, Lopatka, Murdock, Jammal & Associates, Inc. No one was present to represent this request. Mr. Marder stated that Staff has recommended approval based on similar uses in the immediate area. He stated that this Commission will be making a recommendation to the City Commission. There aren't any other uses of this type. The area north of the Jail includes part of this site and is zoned AG. The site is well buffered from residential areas and is in very close proximity to the Juvenile Center. Mr. Stogner moved to table until a representative could be present, The motion died for a lack of second. Mr. Dyal moved to approve based on Staff' recommendations. Seconded by Mr. Brooks. Mr. Dyal stated that the request is straightforward considering the neighborhood. Mr. Stogner stated that a representative needs to be here. Mr. McClanahan noted that approval is contingent with Staff's recommendations. Mr. Valerino opposed.. All others in favor. Motion carried. The next item on the Agenda was the consideration of the Site Plan for a Seminole County Work Release Center at Five Points located at 212 Bush Boulevard in an AG, Agriculture Zoning District. Owner: Seminole Board of County Commission; representative: Emile. Jammal, Lopatka , Murdock, Jammal & Associates,, Inc. Mr. Stogner moved to table due to lack of representation. Seconded by Mr. Dyal. All in favor. Motion carried. MINUTES PLANNING AND ZONING COMMISSION MEETING OF OCTOBER 3, 1996 PAGE 2 Next item was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1500 W. 25th Street in an MR- 3, Multiple Family Residential Zoning District, for the purpose of a residential care facility. (Continued from August 15, 1996, Planning & Zoning Commission meeting). Parcel No. 35- 19- 30- 300 - 0370 -0000. Owner: Bertha Marie Vance; representative: Lorraine Arnold. Bertha Vance, 1500 W. 25th Street, was present and stated that Lorraine Arnold is the representative of this request. She stated that Ms. Arnold would like to construct an adult center at this location and had indicated to her that a church would be taking a part in the adult center. Ms. Vance stated that if all goes well, she will sell her property to Ms. Arnold and move. Mr. Brooks moved for approval. Seconded by Mr. McClanahan as per Staff's recommendations. Mr. Valerino opposed. All others in favor. Motion carried. Mr. Dyal asked about the house on Eseambia. Mr. Gibson stated that he did not have an update but that the condition of the house has been reported to Code Enforcement. He will. check on the status and report at the next meeting. Mr. Brooks requested that something be done with the BP Station on Celery Ave-. Mr. Robert moved to removed Item 2.B from the table. Seconded by Mr. Dyal. All in favor. Motion carried. Emile Jammal, 1347 Palmetto Avenue, Winter Park, appeared to represent this request. He stated that this will be a 5184 square feet, 1 -story building. It will house 30 men and 10 women. Mr. Robert questioned whether or not there is muck. Mr. Jammal stated "no ". The water table is 2 to 3' down. Drainage will go to a large retention pond on property belonging to the College. Mr. Robert asked about fencing. Mr. Jammal stated that they have had no comments on fencing from Staff.. The area, around the site is open with no immediate residential properties. This facility will be for low security, trustee type inmates. The building will be secure and staffed 24 hours. Mr. Garrett asked about. the use of reclaimed water. Mr. Marder stated that it is not there but it is part of the road construction. Primarily, it will serve the College. but will go to County sites also. Mr . Dyal moved f or approval with all recommendations f ram Staf f . Mr. Brooks seconded. All in favor. Motion carried. Mr. Marder reported that Staff is revising the regulations regarding telecommunication towers and that the Commission should receive an update at the next meeting. James Valerino, Vice Chairman From the Director of Planning and Development- - September 20, 1996 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of October 3, 1996 SEMINOLE COUNTY GOVERNMENT - Request permission to establish a correctional work release facility in an AG, Agricultural Zone located on the north side of Bush Boulevard. NOTE: Pursuant to the definition of a "Government Owned Use," the proposed Seminole County Work Release Center to be located at Five Points is processed under the procedures for rezoning, specifically regarding hearings and advertisements. As such, the request will not result in a rezoning. It will result in the use being established for denied) by motion of the City Commission pursuant to recommendation by the Planning and Zoning Commission. This procedure is required because a portion of the property north of Bush Boulevard (Zoned AG, Agriculture) was annexed to the City and has not been utilized for government uses. The southerly portion of the property Zoned GC -2, General Commercial has already had government owned uses established for many years and does not require additional approval of such uses. 1. Site is Zoned AG, Agricultural and is vacant at the present time. 2. The Seminole County Jail and the Juvenile Detention Center are located adjacent to the site in areas Zoned GC -2, General Commercial. 3. Recommend approval of the request to establish a correctional work release facility in an AG, Agricultural Zone based on similarity of proposed use with correctional uses already established in the immediate area. ARNOLD - Request conditional use permit to establish a residential care facility on property Zoned MR -3, Multiple Family Residential, located at 1500 West 25th Street. Site includes approximately three (3) acres and appears to include one single family dwelling at the present time. Site fronts West 25th Street which is a four -laned minor arterial facility also known as County Road 46A. 2. Site is adjacent to multiple family dwellings to the east and south and single Planning Recommendations - Page 1 family dwellings to the north and west. 3. Pursuant to Footnote Number 17 of Schedule B, Permitted Uses, the City's requirements for residential care facilities in MR -3 Zones states the following, "Such use shall be permitted as a conditional use provided that such use shall not be located within a radius of 1,200 feet of another residential care facility or a community residential home in a multi - family zone or within 500 feet of a single family boundary." The site in question is within 500 feet of an SR -1, Single Family Residential Zone. The applicant requested and received special permission from the Sanford City Commission to waive the 500 foot requirement on September 16, 1996 with the stipulation that a buffer around the property's boundary that is adjacent to single family residential use be provided. 4. Recommend approval to establish a residential care facility in an MR -3, Multiple Family Residential Zone be approved based on similarity of proposed use with multiple family uses already established in the immediate area and with the condition that a masonry wall a minimum of six feet in height be provided along the north and west property lines, that the side of said masonry wall facing single family dwellings to the north and west be provided with a stucco finish, that all buildings shall be set back a minimum distance of 35 feet from the north and west property lines, and that a landscaped buffer of a minimum of twenty five feet in width be provided adjacent to the north and west property lines. DOCUMENT STORAGE OF CENTRAL FLORIDA - Request conditional use approval to permit the storage of business records for property Zoned GC -2, General Commercial located at 200 North Holly Avenue. Site is Zoned GC -2, General Commercial and is presently being utilized for metal fabrication, i.e., manufacturing. 2. The site is adjacent to a junk yard, vacant land, the City's public works complex and a landscape installation business. 3.
