CITY COMMISSION CHAMBERS Ben Dyal Lynn Stogner Mac McClanahan 41 Mike Skat Helen Stairs Jim Valerino Mark Platts Ross Robert Leon Brooks OTHERS PRESENT: Jay Marder, Director of Planning and Development Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary The first item on the Agenda was to hold a Public Hearing to consider a request for a conditional Use for Bright Star Tower and Consulting, Inc. property located within the 2400 Block of W. Airport Blvd. , in a MI -2, Medium Industrial Zoning District for the purpose of a 215' guyed communications tower for public /private utilities service (Public Service Structure). Owner: D.O. Smith Development Corp.; representative: William F. Geisler. William F. Geisler, 4025 W. Danby Court, Winter Springs, stated that the name of his business is Bright Star Tower and Consulting, Inc. and that he is requesting to construct a tower at this location. He stated that he will be renting space on this tower to carriers. He constructs the towers and leases the space. This towers will be designed to handle three or four cellular carriers. Mr. stogner asked if the guyed tower is 700' from the nearest residence. Mr. Geisler stated that it will be 700' less 140' from a residence. The tower will have all appropriate lights and is surrounded by MI -2 Zoned property. Mr. Dyal moved to approve as presented. Mr. McClanahan seconded. All in favor. Motion carried. The next item on the Agenda was the consideration of the Site Plan for a 215' guyed communications tower for Bright Star Tower and Consulting, Inc. for property located within the 2400 Block of W. Airport Blvd., in a MI -2, Medium Industrial Zoning District. Owner: D.O. Smith Development Corp.; representative: William F. Geisler. Mr. Geisler stated that the 6' chain link fence is for security purposes. Mr. Platts questioned the closed road. Mr. Geisler noted that he has access to the keys to the gate for after hour use. Mr. Marder stated that the road was closed because the users requested this and the City allowed it. Mr. Dyal moved for approval as presented. Mr. Skat seconded. All in favor. Motion carried. Gary Martinet, 2895 S. Orlando Dr, Sanford, stated that he needs the variance to save a tree. In order to save this tree, he had to move the building as far over as possible. Mr. Dyal asked what type of business would be at this location. Mr. Martinet stated that he makes cable for electronic components. He would like for the building to be 40' away from the tree. He stated that Selma Uhr, a tree expert, has estimated the tree to be between 200 and 300 years old. Mr. Skat moved to approve as presented. Mr. Dyal seconded. All in favor. Motion carried. The next item was the consideration of the Site Plan for Automatic Cable Corp., an assembly use proposed for Lot 7 -C, Sanford Central Park, located at 102 Coastline Road in a RI -1, Restricted Industrial Zoning District. Owner /representative: Gary Martinet. Gary Martinet, 2895 S. Orlando Drive, Sanford, stated that the green area around the trees would be landscaped. Mr. Robert questioned the finished floor elevation of 8 above the crown of the road. Mr. Martinet stated that this is correct and that there would be no on -site retention. He stated that there would not be any large trucks coming in, simply UPS. Harry Reynolds, Engineering Design, stated that they concur with staff's comments. The parking spaces are 10x20 and the last parking space on east side is the dumpster location. Mr. Gibson stated that Staff had requested revised site plans with more drainage elevations, north arrow, relocation of stop bars, dumpster location, and that the assembly use be clarified. He stated that the applicant has worked out what Staff had requested. Mr. Robert moved to recommend approval subject to Staff's recommendations. Seconded by Mr. Dyal. All in favor. Motion carried. The next item was the consideration of the Site Plan for Ram Industries, a wholesale storage use proposed for Lot 11, Keyes Seminole Industrial Park located at 110 Keyes Court in a RI -1, Restricted Industrial Zoning District. Owner: Keyes Seminole Industrial Park Investors Ltd., representative: John A. Munfield, General Partner. Harry Reynolds, Engineering Design, was present for representation. Mr. Gibson stated that Staff has not received the revised plans, but that the issues associated with the revised plans are pertinent to final engineering review. Mr. McClanahan asked if the pop -overs are to tie the retention areas together. Mr. Reynolds stated "yes, that it ends up in a big central pond." Mr. Robert asked if a fence would be required. Mr. Gibson stated "no". Mr. Marder stated that there is a specific agreement that allows this property owner to connect to the adjacent owner. Mr. Reynolds stated that an easement is all there is. The Master Drainage Plan is suppose to take care of all the lots, although he decided to put MINUTES PLANNING AND ZONING COMMISSION MEETING OF JANUARY 4, 1996 PAGE 3 in his own ponds. Mr. Gibson stated that Staff requires an agreement for cross utilization of the drainage easement. Mr. McClanahan moved for approval as presented. Mr. Skat seconded. All in favor. Motion carried. Mr. Skat asked if the City ever looks at what ends up in retention ponds and what happens if someone has toxic runoff. Mr. Marder stated that the City doesn't go out to determine or check the ponds. Some one would have to alert the City. Mr. Marder stated that there have been some discussions of billboards in the unincorporated area. He has drafted a memo to the City Commission regarding an interlocal agreement with the County whereby the City would take the regulations of billboards under its wings and apply its sign code and zoning regulations. He stated that the City cannot regulate without an interlocal agreement. There being no further business, the meeting adjourned at 7:55 P.M. Helen St s. Chairperson I - - From the Director December 29, 1995 of Planning and TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of January 4, 1996 BRIGHT. STAR TOWER AND CONSULTING. INC. - Request conditional use approval to permit a communication tower of 215 feet in height for property Zoned MI -2, Medium Industrial, located on Albright Road. 1. Site includes approximately three acres, is vacant and is Zoned MI -2, Medium Industrial. 2. The applicant proposes to construct a guyed communication tower (three guy wires) that will be 215 feet in height. In addition, a 15' x 25' equipment shed will be located adjacent to the tower. 3. Adjacent uses include crankshaft rebuilding, miscellaneous manufacturing and warehousing, tractor trailer storage, a junkyard, an occupied mobile home that appears to be utilized for security purposes and vacant land. In general, the area west of Airport Boulevard in zoned for industrial development. The tower is proposed to be located approximately 700 feet from existing single family residential uses located on the east side of Airport Boulevard. 4. An existing communication tower of the latice -self- supporting type is located approximately one mile northwest of site on Narcissus Road. That tower is approximately 200 feet in height. 5. Recommend approval of request to establish a 215 foot high guyed communication tower based on existing nonresidential character of immediate area surrounding site. MARTINET - Request a dimensional variance from side and rear building setbacks to construct an industrial building in an RI -1, Restricted Industrial Zone located on Coastline Road. 1. Site is Zoned RI -1, Restricted Industrial, fronts Coastline Road and is vacant at the present time. Site is heavily vegetated and includes numerous trees. 2. Applicant requests a dimensional variance of ten feet to permit a five foot side yard setback along the westerly property line and a variance of fifteen feet to Planning Recommendations - Page 1 permit a five foot rear yard along the north property line. The applicant states in a letter dated December 20, 1995 that the variances are requested in order to save a large, old oak tree that is somewhat centrally located on the site. 3. Uses adjacent to the site include light manufacturing and warehousing (Continuous Forms and Checks, Compass Marketing) as well as vacant land. These established uses appear to have retained significant natural vegetation on their respective sites. 4. Recommend that the requested dimensional variances for side and rear setbacks be approved because of special conditions peculiar to the land, i.e., unique natural vegetation in the form of a very large, old oak tree, the fact that the special condition did not result from actions of the applicant and the request meets the general intent and purpose of the Zoning Ordinance, subject to the site plan submitted by the applicant.
