The first item on the Agenda was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 2425 French Avenue, in a GC -2, General Commercial Zoning District,, for the purpose of a 30' setback requirement for a canopy, 35' required, 5' proposed. owner: Highway oil Company; representative: Roder Combs. Tabled: March 3, 1994. Mrs. Stairs made a motion to remove from the table. Seconded by Mr. Dyal. All in favor. Motion carried. Mr. Dennison noted that a decision to table this request was made to give the requestor an opportunity to refine his request and come up with a better traffic circulation plan, Mr. Lewis Covin, Clay oil Corporation, stated that the problem is with the layout of the station. He stated that when customers pull into the station and want a particular type of gas, they have to wait for that pump causing congestion. The improvement which will be the installation of multi -hose dispensers which will allow the pump islands not to be blocked, eliminating backups. on the corner, there is an open curb cut and people come in the wrong way. Mr. Covin stated that they are proposing to close the corner curb cut. This will leave one curb cut which lets cars enter the station,but they must exit onto the side street. This will reduce the traffic flow to one direction. Mr. Covin explained that canopies are a part of a site that the oil companies now dictate. He stated that lights are for security. Mr. Valerino asked why the four pumps could not be installed without a canopy. Mr. Covin explained that people tend to come in more during the evening when lights are needed. He stated that the pan of the canopy traps the light, directing it downward to the concrete and spilling out. Mr. Dennison stated that the Commission's concern was more with the traffic circulation. Mr. Covin stated that they are proposing to close the curb cut. Another option would be to pave over the tanks in the rear of the property and direct traffic onto the side street. He stated that they were hoping the closure of the one curb cut would be enough. MINUTES PLANNING AND ZONING COMMISSION MEETING OF MARCH 17, 1994 PAGE 2 Mr. Covin asked if the closing of the curb cut and the paving over the pan field in the rear with the redirection of traffic would be enough to have the request approved. Mr. Speer made a motion to table this request until the end of the meeting to allow time for the previous representative to arrive. Seconded by Mr. Dyal. Mrs. Stairs opposed to the motion. All others in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located in Phase I, Northstar Business Park, in a GC -2, General Commercial Zoning District, for the purpose of a fire training office and warehouse with outside fire training area. Owner: Trepanier, Oyler and Stoller; representative: Howard Schieferdecker. George Livingston, 2300 Lucien Way, Ste. 250, Maitland, Howard Schieferdecker, and Steve Nokk were present for representation. (Mr. Nokk handed out a site plan). Mr. Livingston stated that Florida Gas has decided that the current facility is not adequate. Mr. Livingston stated that they originally proposed a 25' setback but had changed to 50' based on staff's comments. He stated that the Fire Marshall had indicated that a 50 setback would be adequate. Steve Nokk read several letters from companies that are involved in this type training indicating that the 50' setback is sufficient. Mr. Davis asked if the Fire Marshall, Richard Cohen, had changed his dimension requirement from 100' to 50 Mrs. Sonnenberg stated that Mr. Cohen had emphasized that 100' would be a good buffer. Mr. Nokk explained that propane and natural gas are used with 4 or 5 different props in teaching the proper steps for extinguishing fires. The highest prop is 25 Fires are mechanically ignited and can also be extinguished by a mechanical valve. Mr. Livingston stated that the flames are burning 2 to 3 minutes at a time and are marginally visible. This is free training for firefighters. He stated that he, along with Mr. Schieferdecker, own land that is adjacent to the south, and that they. do not have any problems with the use. There are no nearby residences. Mr. Tom Ball, 683 Morning Dove Cir., Lake Mary, stated that he is an adjacent property owner. He stated that he attended a training class and does not have any objections to this use. Mr. Dyal moved for approval with the 50' requirement with no wall or the trees for buffering but that the applicant must comply with all standard landscaping requirements. Seconded by Mr. Brooks. All in favor. Motion carried. The next item on the Agenda was the consideration of the Final Plat for Pamala Oaks PD, a 28 lot single- family residential subdivision, located at 841 Upsala Road in a PD, Planned Development Zoning District. Owner: A. David Feinberg; representative: John Reynolds. Mr. Dyal moved to remove from the table. Seconded by Mrs. Stairs. All in favor. Motion carried. Harry Reynolds of Engineering Design was present for representation. He stated that the only change would be a fence to be added around the retention pond. Roger Combs of Fueling Components stated that he was under the impression that if the curb cut was closed the variance would be considered. Mr. Dennison stated. that the Commission expected a plan that would show better traffic circulation. Mr. Combs stated that they determined that the major problem was the curb cut. He stated that they did not have any plans drawn up but that they are proposing to close the curb cut. He stated that when the one curb cut is closed, it would basically make the business northbound. Mr. Combs stated that it is the hose availability and the distance spread between the pumps that causes backups. Mr. Dyal asked if the canopy was a make it or break it deal. Mr. Combs stated that this would remain a full service station and the canopy is needed for coverage for the attendant and the station and for the security of lights at night. He stated that they would be upgrading to the highest technology. Mr. Davis moved to deny based on lack of adequate traffic circulation. Seconded by Mr. Dyal, Mr. Speer in opposition. All others in favor. Motion carried. Mr. Dennison welcomed and introduced Mr. Jim Valerino to the Commission. Mrs. Stair moved to approve the minutes as circulated. Seconded by Mr. Dyal. There being no further business, the meeting adjourned at 8:15 F.M. 4 J'e Den ison, Chairman Flom the Director of March 9, 1994 Planning and Development TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of March 17, 1994 FUELING COMPONENTS, INC. - CLAY OIL COMPANY - Request a dimensional variance to permit a canopy within the required front yard building setback for property Zoned GC -2, General Commercial located at the corner of 24th Place and French Avenue /U.S. Highway 17 & 92. 1. Site is Zoned GC -2, General Commercial and includes a small existing service station. 2. The site is located on a corner and fronts a major arterial roadway, U.S. Highway 17 & 92. The site area is approximately 13,589 feet. The minimum size for a lot in a GC -2 Zone is 10,000 square feet. The existing building and traffic circulation facilities are primarily situated on the western half of the site fronting U.S. Highway 17 & 92. At the present time the traffic circulation system is substandard and does not comply with the City's existing traffic access requirements. The observed lack of sufficient land area appears to cause traffic circulation problems with automobiles being unable to find space on the site and sticking out onto U.S. Highway 17 & 92, forcing traffic to detour or stop. In general, the portion of the site currently being utilized as a gasoline service station is of insufficient size to properly conduct such activity. The existing traffic circulation system, especially access from U.S. Highway 17 & 92, creates a traffic safety hazard. The eastern half of the site is vacant at the present time. 3. The request does not appear to comply with hardship and other criteria for granting dimensional variances. 4. Various commercial uses in the immediate area include automobile repair, miscellaneous retail and businesses. 5. Recommend that the request for a dimensional variance be denied based on the lack of sufficient size to safely conduct the present activity, the related undesirability of permitting the traffic circulation problem from being expanded further through the addition of a canopy and the availability of land under common ownership to expand or modify the present service station use in a manner that would provide for a safe traffic circulation system and comply with existing Land Development Regulation requirements and criteria. Also, based on Planning Recommendations - Page 1 safety considerations and access spacing criteria, vehicular access to the site should be limited to 24th Place. SCHIEFERDECKER - Request conditional use permit to conduct an outside fire training area in conjunction with a fire training facility in a GC-2, General Commercial Zone located in the North Star Business Park south of State Road 46 West. Site is Zoned GC -2, General Commercial and is vacant at the present time. Site consists of the southern half of Lot 14 in North Star Business Park, Phase 1. 2. Adjacent uses include an industrial building immediately south of site and various similar uses in the immediate area. Site is also adjacent to vacant land to the east (unincorporated, Zoned A -1) and various single family dwellings located in the general vicinity of the site. 3. The proposed facility is a commercial /industrial use that will primarily serve as a training facility for firefighters from around the state as well as workers who repair gas appliances or are otherwise involved with gas utilities. According to information presented to staff by the applicant, the hazardous facilities will include a unique type of open burning in the form of an empty tank that will be surrounded by flames with a maximum height of 25 feet (the present facility at the airport has flames as high as 40 feet). Also two burn pits for other substances such as chemicals will have flames ranging from 2 to 5 feet in height. The applicant anticipates twenty (20) classes or more per year. 4. Regarding hazardous materials and activities safety issues, the designated Fire Marshall for the City of Sanford, Richard Cohen, has the authority, by virtue of training and experience, to place reasonable requirements and criteria upon activities and uses such as those being proposed by the applicant. Therefore, in addition to any procedural requirements for fire equipment, trained personnel and related controls, a reasonable physical buffer or distance separation between the proposed burn tank and pits needs to be provided and maintained between such tank and pits and adjacent buildings, vehicles and property. This requirement is similar to distance separations, buffers and setback requirements and criteria between potentially incompatible land uses as set forth in the Land Development Regulations. Specifically, the Fire Marshall has concurred that a minimum distance of one hundred (100) feet shall be provided between the burning activities and buildings, adjacent property and automotive vehicles. 5. Regarding land use compatibility and traffic safety, the proposed burning activities would be visible from motorists and adjacent properties. The potential distraction to motorists from flames as well as general potential annoyance to adjacent properties calls for the provision of visual buffers in order to insure land use compatibility. 6. Recommend that the request to establish a training facility for natural gas with open burning facilities be approved subject to the following conditions: a. A minimum distance of one hundred (100) feet shall be provided to Planning Recommendations - Page 2 separate open burning activities from property lines, buildings, required parking spaces and vehicles (except fire- fighting equipment). This recommendation is based upon and assumes the correctness of information provided by the applicant as noted above. b. Burning activities shall be visually buffered from adjacent properties and adjacent roadways. Such buffering shall include the use of eight (8) foot walls and on -site buildings. In addition, trees shall be planted around the site in such a manner as to provide additional visual buffer from flames. The location and type of landscape and walls shall be approved by the Planning and Zoning Commission pursuant to site plan review. Planning Recommendations - Page 3
