There were approximately 30 people in the audience in representation of the old Sanford Regulations - Draft Revisions to Land Development Regulations. Sue Olinger, President of the Sanford Historic Trust, made a presentation to the Planning and Zoning commission stating that all properties within the Historic District had been grandfathered in. Preservation has not been on the main agenda in Sanford. The Historic District is in a decline. Educating people is one of the most important tasks. Ms. Olinger stated that the revisions to the Code will not have any effects on the homes. owners will be required to meet the new codes only if work is to be done to a structure. She asked that the Commission recommend approval of the draft revisions to the City Commission. Kevin Stubbs, 618 oak Ave., member of Sanford Historic Trust and Historic Preservation Board, stated that there are four types of structures. Type 4 is a single family dwelling; type 4A is a residential structure that would allow for office and commercial use; type 5 is an apartment; and type 6 is an industrial lot which is a minority in the District. Paul Capucelli, 810 Myrtle Ave., member of the Historic Trust stated that the Historic Preservation Board will approve, monitor, and enforce the Codes. Mrs. Stairs asked if a home, not listed as an apartment, would remain an apartment and if it would still be used as an apartment. Mr. Stubbs reiterated that all structures are grandfathered in. If it was to sit empty for 6 months, then it would revert back to single family. Mrs. Stairs asked if there was a built -in safeguard if a house could be built on a property where a structure had burned or should be razed. Ms. Olinger answered "yes ". Mr. Speer questioned the requirement for structures to have one working porch light with a censor. Ms. Olinger stated that one purpose of the light is to deter crime. The structures were originally built as apartments and should remain apartments. He asked what would be the economical change for requiring a residential manager for apartments. Mr. Marder stated that there would be no economical change for requiring a residential manager because the owner would have one of the tenants as a designated manager. The Planning and Zoning Commission unanimously recommended the approval of the draft revisions to the City's Land Development Regulations which incorporate the latest changes to the Old Sanford Regulations prepared by Andres Duany with the proposed changes intended to be incorporated into Schedule S, Historic Preservation, with several minor changes to be incorporated into the Administrative Section of the LDR, with minor changes to the figures including the map. The first item on the Agenda was to hold a Public Hearing to consider a request to rezone property located at 2001 Celery Avenue from SR -1, Single Family Dwelling Residential to that of PD, Planned Development and consider an amendment to Master Plan for New Tribes Mission Homes. owner: New Tribes Mission, Inc.; representative: Daniel E. Taube, Dan Taube, 160 Bolivia Court, Sanford, stated that New Tribes Mission had purchased this property from Joe Watson. Previously, they had rezoned 40 acres to PD and had constructed single and multi-family homes. Mr. Taube stated that New Tribes Mission would like to rezone 30 acres for single and multi - family homes, and duplexes. Mr. Taube stated that what New Tribes Mission is trying to do is eliminate all housing on First Street and turn that facility into offices. Mr. LeRoy moved to recommend approval to rezone and consider an amendment to the Master Plan. Seconded by Mrs. welch. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 519 Park Avenue in an SR -1, Single Family Dwelling residential Zoning District for number of parking spaces. 303 required, 248 proposed. owner: First Baptist Church of Sanford; representative: Cindy McGinnis. Cindy McGinnis, Schweizer, Inc., stated that she is the architect and representative of this request. She stated that the Church had purchased adjoining property over the gears with plans of expanding for growth for the next 30 years. Ms. McGinnis also requested that the Church be allowed to use off- street parking. Mrs. Stairs asked Ms. McGinnis if there was any problem with No. 5 of Staff's recommendations regarding the shuttle. Nis. McGinnis stated that the Church's request was to not be required to provide a shuttle until the parking capacity is met. She stated that it MINUTES PLANNING AND ZONING COMMISSION MEETING of OCTOBER 21, 1993 PAGE 2 would take several years before the Church would reach its limit on parking. Mr. Marder stated that the shuttle is needed at special times, Christmas, Easter, etc. Mr. Speer stated that these are days when people learn to live together and adjust. Mrs. Stairs moved to approve as recommended by Staff with the exception of No. 5 of Staff's recommendations that the proposed shuttle become a condition of approval with the requirement that specific downtown parking sites be identified and that written assurances be provided to the City to insure that such areas may be utilized. Seconded by Mr. Dyal. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1602 W. Airport Blvd. in a GC -2, General Commercial Zoning District for the purpose of the sale of alcoholic beverages (consumption on premises) Class 3. Owner: Mr. Hickman; representative: John Aitcheson. John H. Aitcheson, 105 W. Elm Avenue, Sanford, was present for representation. He stated that the City Commission had granted a waiver of the distance requirements regarding the proposed Class 3 Alcoholic Beverage Sales License. There being no one else present to speak in favor of or against the request, Mr. Dyal moved for approval. Seconded by Mrs. Stairs. Mr. LeRoy opposed. Motion carried. The next item for consideration was the Site Plan for Florida Solar, an office/warehouse use, located at 235 Coastline Road in a RI -1, Restricted Industrial zoning district. owner: C.B.C. Industrial Park, Inc.; representative: H. D. Holsumbach; (Tabled 10- 7 -93). Mr. Dyal made a motion to remove from the table. Seconded by Mr. LeRoy. All in favor. Motion carried. Dick Holsumbach, 605 Dickman Circle, stated that he does not have any problems with Items 1, 2, 3, 4, 6, 7 of Staff's recommendations (attached). He stated that he is working with the City Engineer to resolve the curbing for Item 5. Mr. Holsumbach stated that he intends to conform to the City's requirements. Mr. LeRoy asked Mr. Holsumbach if it was his intention to request a waiver that the hedge, in the required 5' landscaped buffer, be waived and that trees be planted instead. Mr. Holsumbach requested that he be allowed to waive the hedge and plant trees in the landscaped buffer area. Mr. Davis moved to approve the site plan subject to Item No. 5 of Staff's recommendations being resolved with the City and the waival of the hedge and the planting of trees. Seconded by Mr. LeRoy. All in favor. Motion carried. The next item was the consideration of the Site Plan for Universal Mapping, an office /warehouse use, locate at 201 Tech Drive in a RI- 1, Restricted Industrial zoning district. owner: C.B.C. Mr. Holsumbach, 605 Hickman Circle, Sanford, stated that he agrees with all recommendations made by Staff and that he will incorporate all the recommendations into the site plan when it is submitted for a building permit. Mr. Marder n ted that in reviewing the approved on -site signage for Seminole Towne Center, it did not deal with the billboard situation at site. He stated that there are 6 or 7 billboards located on the Seminole Towne Center site. Mr. Marder stated that he had received the second version of the billboards. As of this date, all billboards are non - conforming. The second version for billboard signage will go to the City Commission for its opinion. Mr. Marder related that County regulations provide that no bill- boards are to be seen from the Expressway. The billboards are located along I -4 within an area that will be purchased through condemnation by FDOT for the Expressway interchange. Tom Speer. ice Chairman From the Director of Planning and Development October 14, 1993 i TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of October 21, 1993 NEW TRIBES MISSION. INC. - Request to rezone from SR -1, Single Family Residential to PD, Planned Development for property located on the south side of Celery Avenue. 1. Site is Zoned SR -1, Single Family Residential and is basically vacant at the present time. 2. Proposed development includes various residential uses ranging from single family residential to multiple family residential. The proposed development constitutes an easterly extension to existing residential development under common ownership. 3. The Future Land Use Plan Map designates the area for Medium Density Residential - 15 or fifteen dwelling units per acre. The proposed Master Plan residential density is 6.2 dwelling units per acre. Therefore, the proposed Master Plan is consistent with and compatible with the Comprehensive Plan. 4. Recommend approval of PD, Planned Development Zoning for the New Tribes Mission Master Plan based on consistency with the Comprehensive Plan. FIRST BAPTIST CHURCH OF SANFORD - Request for a dimensional variance regarding parking spaces for property Zoned SR -1, Single Family Dwelling Residential located at 519 Park Avenue. 1. Site includes various properties utilized by the First Baptist Church for existing and proposed buildings and parking areas. 2. The purpose of the proposed variance for parking regards the construction of a new sanctuary building. Information is provided by the applicant dated September 21, 1993. In general, the applicant proposes to include 86 adjacent on- street parking spaces in order to meet approximately 80 percent of required parking of 303 spaces. In addition, the applicant proposed to utilize a shuttle service to unspecified downtown parking lots for high attendance periods such as Easter and Christmas. PLANNING RECOMMENDATIONS FOR OCTOBER 21, 1993, PAGE 2 3. Several other churches are located adjacent to and in the immediate vicinity of the site. Also, various single and multiple family dwellings are located in the immediate area. The general vicinity is part of a designated historic district and is characterized by numerous historic buildings. In general, various public and private facilities and uses in the area do not provide adequate off - street parking in terms of compliance with the City's present parking requirements. For example, a multiple family building located on the east side of Park Avenue and adjacent to the southernmost church parking area does not appear to have significant off - street parking facilities. None of the other churches or the City - owned Cultural Arts Facility appear to have off - street parking facilities that meet present parking standards. Other than the property including in this request, there appear to be two or three 50 foot wide lots in the general vicinity that are designated for off - street parking. 4. Question is one of policy regarding parking in the immediate area and the addition of facilities creating additional demand for parking. 5. Recommend approval of the proposed parking variance based on the preponderance of existing similar facilities that do not meet present parking requirements located in the immediate area. Also recommend that the proposed shuttle become a condition of approval with the requirement that specific downtown parking sites be identified and that written assurances be provided to the City to insure that such areas may be utilized. GIL CHARLAND - Request conditional use approval to permit the sale of alcoholic beverages for consumption on premises - Class 3 for property located at 1602 W. Airport Blvd. in a GC -2, General Commercial Zoning District. 1. Site is Zoned GC-2, General Commercial and includes a shopping center located at the corner of two arterial roadways. 2. A vacant convenience store and an apartment complex are located adjacent to site. Various retail commercial and service uses are located in the immediate area. 3. Pursuant to a letter dated September 15, 1993 attached to the application, the City Commission has granted a waiver of distance requirements regarding the proposed Class 3 Alcoholic Beverage Sales license. 4. The above findings are provided for information purposes. A staff recommendation is not provided for requests involving alcoholic beverages.
