MINUTES PLANNING AND ZONING COMMISSION MEETING OF DECEMBER 3 1992 7 :00 P.M. CITY COMMISSION CHAMBERS MEMBERS PRESENT Helen Stairs Leon Brooks Tom Speer John LeRoy Cathryn welch Ben Dyal MEMBERS ABSENT: Joe Dennison Cynthia Holt- Miller Mike Davis OTHERS PRESENT: Jay Marder, Director of Planning and Development 4 Bettie Sonnenberg, Land Development Coordinator Russ Gibson, Planning Technician i Marion Anderson, Recording Secretary The meeting was called to order at 7:00 P.M. by Vice Chairman Speer. The first item on the Agenda was to hold a Public Hearing to consider a request to Rezone property from MI -2, Medium Industrial, to PD, Planned Development and to consider the faster Plan for Mountain Distribution, a warehousing use, located at 2900 W. First Street. Owner: Diane K. Dyers; representative: Urban J. Corban. Mr. Carl Pecht, 501 E. Jackson Street, Orlando, representative, stated that his clients intend to build a beer warehouse with no manufacturing. N14 Mr. Speer stated that he had read Staff's recommendations and asked that they be included as part of the records (attached). Mrs. Stairs moved on approval, including approval of the Master Plan, based on Staff's recommendations and the fact that this area is consistent with the Future Land Use flap. Seconded by Mrs. Welch. All in favor. Motion carried. The next item for consideration was the site plan for two detached signs for First Spanish Assembly of God, located at 911 Palmetto Avenue in a GC -2, General Commercial Zoning District. Owner: First Spanish Assembly of God; representative: Pastor Augusto Avila. There being no one present for representation, the Commission left this item on the table. The next item for consideration was the site plan for Kemco Industries, a manufacturing use, located at 70 Keyes Avenue in a RI -1, Restricted Industrial District. owner: Kemco, Industries; representative: Harry Reynolds . Mr. Harry Reynolds of Rich Street, Longwood, stated that he had received communication from Mrs. Sonnenberg and that they will comply to all 6-items in her correspondence without having to redo and make changes to the site plan. Mr. LeRoy asked if this was a part of Cardinal. Mr. Reynolds stated "yes, this is a part of Cardinal." He stated that the present facilities are in the Midway Industrial Park. There are MINUTES PLANNING AND ZONING COMMISSION MEETING OF DECEMBER 3, 1992 PAGE 2 approximately 35 employees and the owners plan to expand to approximately 60 employees. Mrs. Stairs asked how close would the expressway be. Mr. Reynolds stated that it would be to the south of this property. Motorists on the expressway will see only parked cars. Taste containers will be on the inside of the building. Semi trucks come by at least once a week to dispose of the waste from dumpsters only. Mr. Brooks moved for approval based on staff findings and that the applicant comply with the 6 findings which Staff had recommended. Seconded by Mrs. welch. All in favor. Motion carried. At this point, the Commission elected to continue with the workshop discussion regarding Draft Transient occupancy Revisions. Mr. LeRoy stated that he had reservations about how this was going to address the problem that originally bought this up. Mr. LeRoy does not see how this would take care of the bi- weekly or weekly problems that will exist. Mr. LeRoy stated that he did not feel comfortable with the way this was. Mr. Speer stated that he felt there should be some type of an inspection by a governmental authority for the protection of the tenant and that the tenants will have basic standards. There is already in place a landlord's /tenants bill of rights. It gives tenants the right to withhold the rent until complaints are met. Mr. Speer stated that he is afraid of that villain would be the landlords because they will do things to avoid coming into compliance. Transient tenants living with 4 or 5 people, would not complain that the screens are out because they are in there illegally anyway. Mrs. welch stated that she was concerned about keeping some of the properties up to code. She was not sure that this would take care of some of the problems. Mrs. welch stated that she felt the yearly inspection would help some. Mr. Brooks stated that apparently right now, we have nothing to address some or all of the complaints. we have to start some place. Mr. Brooks stated that the Commission needs to adopt the Provisions now and if need be, come back and revise. Mr. Chris Pilcher, 2300 Mellonville Avenue, stated that most of the transients are people that don't make very much money and can't afford to pay more rent. Probably, this was whir they were in housing such as already. They pay by the week. Mr. Pilcher stated that it would be an infringement of the property owner's rights on how the owner wants to deal with his property by revising this code. Mrs. Sonnenberg stated that only on a complaint basis do we have the ability to go in and inspect. Someone has to report that there is some type of substandard condition. Then the Code Enforcement may go out. In 1983 when the City went through rezoning, we went through the same type of thing in the old section. A listing of all the properties and a determination of two family and multiple family dwellings were compiled. The two family and multiple family were required to be licensed. This was one of the requirements when the City went through the rezoning. The same type of inspection was done at that time. At this time, a change of i ownership s the only thing that will generate an inspection. Mrs. Stairs stated that her concern was that if we aren't taking care of the violations that are in place now, how are we goin g to take care of new violations. MINUTES PLANNING AND ZONING COMMISSION MEETING OF DECEMBER 3, 1992 PAGE 3 Rev. Daniel Walker stated that he owns a house in Goldsboro, and the tenants have torn up the house. He stated that he has spent over $2,000 in repairs because of the tenants and asked what about the tenants when they do something like this. Mrs. Stairs stated that he should investigate his tenants thoroughly. Rev. Walker stated that with all the new provisions the City is going to drive a lot of people out of homes because they can't afford to pay for all the things that this provision may require. He stated that people can't afford to have the rents raised. The new provisions will cost property owners more money. Monte Olinger, 914 Elm Ave., stated that he was for anything that will stabilize and improve the Historic District including improvements to structures. He believes that the lifestyle will improve with the improvements of these structures. Mr. Marder stated that the classification that exists today was the term "Boardinghouse". We have more or less renamed it. We are not changing the permitted use in the area but we are adding a group of requirements that need to be complied with for each use. Mr. Pilcher stated that the fact that the Commission was going to change the Provisions was not going to change the fact that there will still be transient housing. Property owners will have to do more to bring the houses up to code. He stated it would not change the social economics of the person in the house. The only thing that would happen is the owner would be that going to ask for a little more weekly rent. He could not see the direct change to transient housing. Mr. Speer stated Sec. 13 Group Homes would not be a real impact on bed and breakfast. He did not know how many two family dwellings there are. Neither did Mr. Marder. Mr. Brooks made a motion to set the Draft Transient occupancy Provisions for a Public Hearing the second meeting in January. Seconded by Mrs. Welch. All in favor. Motion carried. Mrs. Stairs asked if Staff could do specifics and estimates as to the number of dwelling units and duplexes that will be affected by these provisions and also the fees and the manpower requirement that this would generate. The Commission unanimously agreed to schedule a workshop for 6 :00 P.M. the day of the Public Hearing for discussion of the Draft Transient Occupancy Provisions.
