MEMBERS PRESENT: Tom Speer Eddie Keith Joe Dennison Ben Dyal Helen Stairs Cathryn Welch MEMBERS ABSENT: Jerry Johnson Leon Brooks John LeRoy OTHERS PRESENT: Jay Marder, Director of Planning & Development Bettie Sonnenberg, Land Development Coordinator Marion Anderson, Recording Secretary Chairman Dennison called the meeting to order at 7:00 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 405 Celery Avenue in a GC -2, General Commercial Zoning District, for the purpose of an expansion of a non - conforming structure and auto parts sales and repairs. Owner/ representative: Noel Cameron. Noel Cameron, 405 Celery Avenue, Sanford, was present for representation. Mr. Cameron stated that they would like to sell auto parts and repair automobiles. Mr. Dennison stated that staff recommends approval with the storage of vehicles not visible to the public and asked if Mr. Cameron had any problems with this. Mr. Cameron stated "no" and he pointed out where the parking would be including the entrance and exit. He also stated that the hours of operation would be between 8:00 and 5:00. Mrs. Stairs moved on approval with staff's recommendations. Seconded by Mr. Keith. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1219 French Avenue in a GC -2, General Commercial Zoning District, for the purpose of an expansion of the use of a non - conforming structure (an additional efficiency apartment). Owner: Michael Jackson; representative: Donald Adkins. MINUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 21, 1991 PAGE 2 Donald Adkins, 1219 French Avenue, stated that this is a two- story building with an existing apartment. He has renovated the apartment upstairs at this location and would like to block an entrance off to make it an efficiency apartment. Mrs. Sonnenberg stated that Mr. Adkins wishes to have two units up stairs. Mrs. Stairs stated that Mr. Adkins had let her see what he was doing and that he is doing a fantastic job. Mr. Speer moved on approval. Seconded by Mrs. Welch. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1202 Oleander Avenue in a GC -2, General Commercial Zoning District, for the purpose of the change of use of a non- conforming lot and structure - church accessory use. Owner: New Salem Primitive Baptist Church; representative: Roland Ray. Roland Ray, representing New Salem Primitive Baptist Church, stated that this would be of service to the community. The property is in dire need of repair and it is obvious that it is being used as a crack house. Mr. Ray stated that this would be a complete renovation for a dining facility for the church. Mr. Keith moved on approval of the request. Seconded by Mrs. Stairs. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 918 E. 10th Street in a SR -1, Single Family Residential Zoning District, for the purpose of a duplex use for a non - conforming lot and structure. Owners /representatives: John W. and D.M. Anderson. Mr. J. W. Anderson, 1000 E. 10th St., stated that he would like to have a duplex at 918 E. 10th Street. There will be no renovations. Everything is already there. He would like to have two water meters and two electric meters. Ms. Sonnenberg stated that currently there are three units at this location. The Building Dept. has recommended approval subject to inspection so that it does not come in as three units. Mr. Speer moved on approval for the purpose of a duplex for two families, with 2 water meters, and 2 electric meters subject to inspection by the Building Dept. so that there will not be 3 tenants occupying the house. The next item was the consideration of a request for a waiver of the landscaping for TLC, Temporary Living Center, a medical outpatient and daycare use, located at 519 Palmetto Avenue in a GC- 2, General Commercial District. Owner: Seminole County School Board; representative: Charlene D. Kelley. (Approved 7/18/91). There was no one present for representation. Mrs. Sonnenberg stated that this concerns the area in the right --of -way. They are requesting to put in a certain number of trees. The 6th Street side is the area that they wish to waive. Mrs. Sonnenberg stated that they could put in 3 trees, at least, on the 6th Street side because there are no overhead wires. She stated that they do have shrubbery near the parking area. Mr. Dyal stated that the representatives had told the Commission in the beginning that they would have trouble with the landscaping. Mrs. Sonnenberg stated that the landscaper had said that they may not be able to get oak trees but they could get large wax myrtles. Mr. Speer made a motion that the original site plan be modified to allow them to plant 7 wax myrtle trees, with a height of 6' minimum, at the same location. Seconded by Mr. Keith and Ms. Welch. All in favor. Motion carried. Mrs. Sonnenberg reported that the engineer from the K Mart /Food Lion project stated to her that the St. Johns River Water Management District (SJRWMD) have, as of 10/1/91, changed the regulations that deal with water abatement. They must contain the first inch and 3/4 and that the engineers cannot do this without going with a very expensive filtration system or purchasing new property. The engineers are trying to get some type of waiver. Mrs. Sonnenberg stated that the Director of the SJRWMD wants them to come before his Commissioners in January. Mr. Harb has written a letter requesting that the Commission write a letter of support or recommendation to SJRWMD to waive the new requirement and go with what it was when the site plan was approved. Mr. Dennison stated that he is well aware of what these jurisdictions can do. Mr. Speer moved that in response to Mr. Harb's letter, addressed to Mrs. Sonnenberg, to authorize our Zoning Commission Chairman to sign a letter that has been approved by staff in support of K -mart and Food Lion obtaining their necessary permits from SJRWMD. Mrs. Sonnenberg stated that the Engineering Dept. had no problems with MINUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 21, 1991 PAGE 4 this. Seconded by Mr. Keith. All in favor. Motion carried. Mr. Speer asked what is exfiltration and what is a system for pre- treatment. Mr. Marder stated that it is the underdrain, a series of underground pipes that allows a certain rate of flow. Exfiltration is perforated pipe underground. Mr. Speer inquired as to whether someone can put runoff in ponds on others properties. Mr. Marder stated that today this is not fair, onsite water retention varies. Mr. Dyal moved on approval of the Minutes of 11/7/91. Seconded by Mr. Speer. All in favor. Motion carried. Copies of the Minutes of October 17, 1991 were missing page 2 and 4. Mrs. Sonnenberg reported that the City Commission had approved the Suda rezoning request; has authorized 3 off- site parking spaces on Oak Avenue for the bed and breakfast inn; and has authorized a carnival for December 16th for the Rescue Church of God whereby they waived the conditional use requirement. Mr. Marder stated that this is a cumbersome situation, requiring conditional uses for temporary amusement. He stated that we need to reconsider this and to review the scope of services in revising our LDR. He would recommend that this type of use to be approved by the City Commission. The Planning and Zoning Commission unanimously agreed to Mr. Marder's recommendation. There being no further business, the meeting adjourned at 7:40 P.M. o ennison, Chairman AF From the Director of Planning and Development November 15,1991__ TO: City of Sanford Planning and Zoning Commission SUBJECT: Planning Recommendations for Meeting of November 21, 1991 CAMERON - Request conditional use approval to expand a nonconforming structure for auto parts sales and repairs for property Zoned GC -2, General Commercial located at the southwest corner of Celery Avenue and Cypress Avenue. 1. Site includes an existing building. 2. Uses adjacent to site include single family residential, multiple family residential and automotive repair. 3. Recommend approval of automotive parts sales and repair based on similarity of existing uses in immediate area. Also recommend that approval be conditioned that storage of vehicles not be visible from adjacent property nor from adjacent streets. AD IN - Request conditional use approval to expand a nonconforming structure for an additional efficiency apartment for property Zoned GC -2, General Commercial located at the northeast corner of the intersection of 13th Street and French Avenue. 1. Site includes a two story principal building and an accessory building. Retail sales appear to be taking place on the first floor of the principal building. 2. Adjacent uses include a tire store, furniture refinishing, trucking and wholesale food distribution. The furniture refinishing establishment appears to have a dwelling unit on the second floor. 3. Recommend approval of the request to establish an apartment based on the similarity with existing uses in the immediate area and the existing character of the area at the present time. Planning Recommendations for November 21, 1991 Page 2 NEW SALEM PRIMITIVE BAPTIST CHURCH - Request to change to use of a nonconforming lot and structure (a one - family dwelling) for a church - related accessory use (a dining hall) for property Zoned GC -2, General Commercial located at Oleander Avenue and West 12th Street. 1. Site is composed of two parcels, a church building located on the north side of West 12th Street and a one - family dwelling located on the south side of West 12th Street. 2. Various single family dwellings are located in the surrounding area. 3. Recommend approval of the request for an accessory church use based on the existing character of the neighborhood and the minimal impact of the proposed use. ANDER N - Request conditional use approval to establish a two- family dwelling for a nonconforming lot and structure for property Zoned SR -1, Single Family Residential located at the northwest corner of the intersection of Willow Avenue and East loth Street. 1. Site includes a single family dwelling. Site is 5,850 square feet. 2. Various single family dwellings are located in the immediate vicinity of site. 3. The Planning and Zoning Commission approved a similar and nearby request at 702 Hickory Avenue on October 17, 1991. 4. Recommend approval of the request to establish a two- family dwelling based on the policy established by the Planning and Zoning Commission to approve similar activities in the neighborhood.
