CITY COMMISSION CHAMBERS MEMBERS PRESENT: Eddie Keith John LeRoy Cathryn Welch Joe Dennison Leon Brooks Ben Dyal Jerry Johnson Helen Stairs Tom Speer OTHERS PRESENT: Jay Marder, Director of Planning and Development Bettie Sonnenberg, Land Development Coordinator Marion Anderson, Recording Secretary The Chairman called the meeting to order at 7:05 P.M. The first item on consider a request 411 E. 25th Street for the purpose of Owner: Seminole Dorothy Meadors. the Agenda was to hold a Public Hearing to for a Conditional Use for property located at in a GC -2, General Commercial Zoning District, automotive dealer sales (overflow boat storage). Board County Commissioners; representative: Mr. Bob Seigler, 2934 Jewett Lane, was present for representation and stated that he had represented Ms. Meadors in another application back in 1986 which rezoned the entire property to GC -2. He stated that this is strictly a marine operation which sells and repairs boat engines and, on occasion, may sell a boat. Mr. Seigler stated that Ms. Meadors is not in the automotive business, but rather, in the boat business. About a year ago, people that could not buy new boats and engines, started having them repaired. Sometimes the engines or repaired parts are not picked up at the time specified and they have to be stored until the clients come in. This lot has been cleaned up. Equipment is standing in stacks. Being able to move a boat into an overflow storage area would help tremendously with customers. There has been an increase in business. Ms. Meadors need additional room for customers to come in. This overflow storage area is an accommodation of the present situation. There are no plans to build on this lot. Will be use for additional storage only. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 702 Hickory Avenue in a SR -1, Single Family Residential Zoning District, for the purpose of a duplex. Owners /representatives: John W. & D. M. Anderson. Mr. J. W. Anderson, 1000 E. 10th Street, stated that he would like to turn this existing dwelling into a duplex. Mr. Dennison asked if he was aware of staff's recommendations and stated that the site is 6200 square feet and that the minimum lot size is 7500 square feet. Mr. Dennison told Mr. Anderson that he did not have quite enough land for a duplex. Mr. Anderson stated that 15 years ago there was a business in the back, the business relocated. The business area was then turned into living space. This is one long building and is already two apartments. Mr. Anderson stated that he wants to legallize it. There are bathing and kitchen facilities in both units. The building is adequate and up to code as far as he knows. Mr. Anderson stated that this building was built approximately in the 40 He will not be expanding but would like to make sure he was within the law in having the two units there. There is one light meter there, he needs two. He will put in a separate light service for the other unit. Also there is one water meter. Mr. Anderson will put in another water meter. Mr. Dennison asked if the conditional use is granted, if the Commission is within the guidelines of the zoning ordinance. Mr. Marder stated that the Commission could place any reasonable conditions on the activity such as insuring that minimum building and housing codes apply. Mr. Anderson stated that there is one smoke detector also and he will install one in the other unit. Mr. Brooks moved on approval with the condition that water and light meters and an additional smoke detector be installed. Seconded by Ms. Welch. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 420 S. Oak Avenue in a SR -1, Single Family Residential Zoning MINUTES PLANNING AND ZONING COMMISSION MEETING OF OCTOBER 17, 1991 PAGE 3 District, for the purpose of a bed and breakfast inn, boarding house. Owners /representatives: Roberta & Walter Padgett. Mr. Walter Padgett, 420 S. Oak Avenue, stated that the intent is to establish the Higgins House as an owner /operated bed and breakfast Inn. This will be a small historical bed and breakfast. inn consisting of 3 elegant bedrooms. Mr. Padgett stated that they will promote the revitalization of Sanford. Mr. Keith asked if Mr. Padgett will be living in the house. Mr. Padgett stated that it will be owner operated. There are two parking spaces in the back yard and sufficient space is adjacent to the north. Also there is off street parking. Mr. Keith asked Mr. Padgett how many workers would he have. Mr. Padgett stated that it would be his wife and himself. This will be a small operation. Mr. Dave Farr, 400 E. 1st Street, stated that the Chamber of Commerce gets quite a number of telephone calls from people looking for a bed and breakfast inn. Sanford needs several bed and breakfast inns. Mr. Farr stated that he was in attendance to encouraged the Commission to approve this request. Warren Skipper, 207 E. 10th Street, President of Sanford Historic Trust, was present to speak in favor of the request. He stated that a lot of Trust members had an opportunity to stay at a bed and breakfast inn and all spoke highly of it. Mr. & Mrs. Padgett opened their home last year during the tour of homes. There were approximately 12 people in the audience to speak in favor of request. Mr. LeRoy stated that he would like the restrictions that the use of the property at 420 S. Oak Avenue shall be limited to a single family residence or a bed and breakfast inn; when operated as a bed and breakfast inn, it shall be owner occupied and owner operated; the number of guest rooms shall not exceed three; and the architectural significance and integrity of the structure ie Queen Anne Victorian shall be maintained. Mr. LeRoy stated that these are restrictions contained within a letter Mr. Padgett had written to the Planning and Zoning Commission. Mr. Dennison stated that he had received a letter from an adjacent property owner, Carl Gutmann, Jr. and that Mr. Gutmann has asked that the Commission approve the bed and breakfast inn. Seconded by Ms. Welch. All in favor. Mr. Keith opposed. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 419 Park Avenue in a SR -1, Single Family Residential Zoning District, for the purpose of a child care center with a church. Owner: First United Methodist Church; representative: Carol Reid. Carol Reid, 208 Tollgate Road, Longwood, stated that she has an established child care at Good Shepard Lutheran Church, but that she has to relocate. She stated that she is licensed for 70 children based on square footage, 20 square foot per child. Mr. Brooks moved on approval. Seconded by LeRoy. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1121 Sanford Avenue in a GC -2, General Commercial Zoning District, for the purpose of automobile and truck repair. Owners /representatives: Ronald M. & Beverly J. Smith. Mr. Ronald Smith, 105 Grovewood Ave., stated that he had come before the Commission 3 1/2 weeks ago and that his request was approved but found to be that the advertisement was misadvertised. Mr. Smith stated that he had found out that he had bought two separate properties. Mr. Marder stated that 3 1/2 weeks ago, the application only included the parking area when the City received it. It did not include the land that the building is on. There was a problem with the legal description. The total legal description was not submitted to the City. Mr. Leroy moved on approval. Seconded by Brooks. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1300 W. 13th Street in a GC -2, General Commercial Zoning District, for the purpose a automobile and truck repair. Owners: John W. & Delores Anderson; representative: Joseph Watkins. MINUTES PLANNING AND ZONING COMMISSION MEETING OF OCTOBER 17, 1991 PAGE 5 Mr. Joseph Watkins, 1301 W 13th Street, stated that he would like to move his business across the street from 1300 W 13th St. There is a shed and it is fenced in. He stated that he has talked with several people in the community and has had favorable opinions. Work will be on Mondays through Fridays and sometimes on Saturdays. This property is the old laundromat with three bays to pull cars under. Ms. Edvina Fielder, 1301 W. 12th Street was present to speak in opposition. She stated that this property is adjacent to her property. She asked the Commission to take into consideration that it will join her home. She will get all the crowds and the noise. She stated that she is upset by the crowd on the corner now and that she has had to put up fences and bars because she is so afraid. This is a terrible corner. Mr. Dennison asked her if there was anything that Mr. Watkins could do to help her overcome some of her fears. Ms. Fielder said that she has no problem with the laundromat, that it is fenced in with a chain link fence; but that she is afraid of the garage and that it would depreciate for her home. Mr. Brooks asked Mr. Watkins if he would be willing to put a buffer between the properties. Mr. Watkins stated that there are two fences there now. There is a wall in the back. Ms. Fielder does not know what, if anything, could be done that would help. Hattie Mae Humphrey, 1307 W. 12th Street was also present to speak in opposition. She stated that she lives on the other side of Ms. Fielder and that if people started gathering at this garage it would be at her back door. Ms. Humphrey stated that she has had some problems and it is scary. Mr. LeRoy, asked Mr. Watkins how many cars does he work on in a week. Mr. Watkins stated that 3 or 4 cars would stay on the property from Monday to Friday. His hours of operation would be from 8:00 to 5:30. Mr. Keith stated to Ms. Fielder that this may be a deterrent because Mr. Watkins is there and he will protect his business. Mr. Watkins stated that he would put in a solid wooden fence in the back to help. Mr. Brooks moved on approval with the buffer of a fence and site plan approval of the fence. Seconded by Mr. LeRoy. MINUTES PLANNING AND ZONING COMMISSION MEETING OF OCTOBER 17, 1991 PAGE 6 The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 2880 Orlando Drive in a GC -2, General Commercial Zoning District, for the purpose of a temporary outdoor amusement fair. Owner: Tri- Regency, Inc.; representative: Kenneth Southward. Mr. Brooks moved to table due to lack of representation. Seconded by Mr. LeRoy. All in favor. The next item was the consideration of the site plan for a professional office use located at 108 Chapman Avenue, in a RMOI, Multiple - Family Residential - Office - Institutional District. Owner/ representative: Donald and Judy Schreiner. (Tabled 10/03/91) This item was left on the table due to lack of representation. The next item was the consideration of the site plan for office and automobile and truck repair uses for 1121 Sanford Avenue, located in a GC -2 General Commercial District. Owner /representative: Ronald and Beverly Smith. Ronald Smith stated that his hours of operation are 8 to 5, 5 days per week. The landscaping will be completed as soon as possible. Mr. Keith moved on approval. Seconded by Mr. LeRoy. All in favor. Motion carried. The next item for consideration was the site plan for a multiple - family dwelling detached sign for Cedar Creek Apartments located at 2540 Hartwell Avenue in a MR -3, Multiple - family Residential District. Owner: American Opportunity Foundation, Inc., representative: Ronald Ginsburg. Ronald Ginsburg, 2200 Lucien Way, Maitland, stated that the sign is to go on the corner of 25th St. and Hartwell Ave. Will be in the ground on that corner and not on any building. This sign is very similar to the entrance sign on the eastside of the property. Mr. Keith moved on approval. Seconded by Mr. Brooks. All in favor. Mr. LeRoy opposed. Motion carried. The next item on the Agenda was the Comprehensive Plan Status Report presentation by Jay Marder, Director of Planning and Development. Mr. Marder stated that the Comp Plan has been printed, packed, and Federal Expressed to the State and Regional Planning Council for review prior to City Commission anticipated adoption on October 28, MINUTES PLANNING AND ZONING COMMISSION MEETING OF OCTOBER 17, 1991 PAGE 7 1991. The shading areas are the changes. Mr. Marder stated that when the plan is adopted, the City will send a copy of the adopted plan to the Regional Planning Council and the State and these two agencies will make a determination whether it is in compliance or not. Mr. Marder also stated that the City is moving towards adopting the joint planning agreement with the County on the 28th. This will permit lands that annex into the City to immediately come under the City's Land Development Regulations. Mr. Brooks moved on approval of the minutes. Seconded by Mr. LeRoy. All in favor. Motion carried. Mrs. Sonnenberg stated that on the 14th the City Commission upheld decisions on rezonings recommendations, to deny Waddles request and approval on Suda. Joe Dennison, Chairman I � ■r■ u From the Director October 11, 1991 of Planning and Development TO: City of Sanford Planning and Zoning Commission SUBJECT: Planning Recommendations for Meeting of October 17, 1991 AHOY MARINE - Request conditional use approval to permit outdoor storage and/or display in a GC -2, General Commercial Zone located at 511 East 25th Street. 1. Site includes approximately 21,584 square feet that is basically undeveloped at the present time. The site is enclosed by a chain link fence. Used boats are displayed. The existing use appears to violate the Land Development Regulations provisions which prohibits outdoor storage and /or display and chain link fence located in required buffer areas. 2. Outdoor storage /display, sales and repair of boats is located adjacent to site in a GC -2 Zone. Site is also adjacent to an electrical substation and a gasoline service station. 3. East 25th Street is classified as a major arterial. Question is one of policy regarding the expansion and establishment of additional automotive dealer sales activities, including automobile, truck, major equipment, and boat sales, along 25th Street. Many uses evidencing outdoor display and storage are located along U.S. Highway 17 & 92 and Sanford Avenue south of 25th Street. 4. Recommend denial of the request to establish outdoor storage and/or display based on a policy to discourage additional outdoor storage and display of automobiles, boats and other similar equipment along the effected segment of 25th Street. ANDERSON - Request conditional use approval to permit a two family dwelling in an SR -1, Single Family Residential Zone located at 702 Hickory Avenue. Site includes a one - family dwelling and includes a land area of approximately 6,200 square feet. 2. Site is adjacent to single family dwellings. 3. Minimum lot size for establishing a two- family dwelling in an SR -1 Zone is 7,500 square feet. 4. Recommend denial of the request to establish a two- family dwelling based on insufficient land area to support the proposed use. Site includes a two -story residence that is a designated historic building in the Downtown Residential Historic District. The site faces Centennial Park. 2. The Padgetts requested and received City Commission approval to request conditional approval for a bed and breakfast inn on September 9, 1991. 3. Adjacent uses include a multiple family condominium project to the north, a boarding house to the south known as 'The Florida Hotel," the City -owned Cultural Arts Center and dwellings of various types in the surrounding area. 4. Recommend approval of the request to establish a bed and breakfast inn based on the similarity of the proposed use with adjacent uses and mixed -use character of the immediate area at the present time. REID - Request conditional use approval to permit a child care center in conjunction with a church Zoned SR -1, Single Family Residential and located on 5th Street between Park Avenue and Magnolia Avenue. 1. Site includes various existing church buildings including a sanctuary and activity rooms. 2. Site is adjacent to a City park, another church, various single and multiple family dwellings, a parking lot and vacant land. 3. Recommend approval of the request to establish a child care center in conjunction with a church based on the similarity of uses already established on site and surrounding area. SMITH - Request conditional use approval to permit automotive repair and use of a nonconforming structure for property Zoned GC -2, General Commercial located on Sanford Avenue north of 13th Street. 1. Site is Zoned GC -2, General Commercial and fronts on Sanford Avenue between 11th Street and Celery Avenue. Site includes approximately 7,137 square feet. Site is basically an existing building with a storefront on Sanford Avenue and a vehicle repair facility facing the paved lot to the north. 2. Site is adjacent to a paved lot being utilized for automotive repair activities. Automotive repair activities are being conducted adjacent to site in a GC -2 Zone. WATKINS - Request conditional use approval to permit automobile and truck repair for property Zoned GC -2, General Commercial located on West 13th Street and Olive Avenue. 1. Site is enclosed by a chain link fence and includes a small building. Site includes approximately 8,400 square feet. 2. Uses adjacent to site include a church, automobile repair and service, an alcoholic beverage sales establishment, a two- family dwelling and various single family dwellings. 3. Recommend approval of request to establish automobile repair based on similarity of existing uses already located in the immediate area with the condition that the use be visually screened from all property lines. MARANTHA NEW LIFE CENTER - Request conditions use approval to permit a temporary outdoor amusement or fair for property Zoned GC -2, General Commercial located on U.S. Highway 17 & 92 between 27th Street and Airport Boulevard. 1. Site is basically vacant at the present time a fronts a major arterial roadway. 2. Site is adjacent to a junkyard, several restaurants, a church and a automobile dealer ship. 3. Recommend approval of the request to establish a temporary outdoor amusement facility based on the existing character of the immediate area at the present time.
