11.15.90MINUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 15, 1990 7 :00 P.M. CITY COMMISSION CHAMBERS MEMBERS PRESENT: Eddie Keith Leon Brooks Jerry Johnson Joe Dennison Helen Stairs Tom Speer Cathryn Welch John LeRoy MEMBERS ABSENT: Ben Dyal OTHERS PRESENT: Jay Marder, City Planner Bettie Sonnenberg, Land Development Coordinator Marion Anderson, Recording Secretary Chairman Dennison called the meeting to order at 7:00 P.M. The first item on the Agenda was a Public Hearing to consider the request to Rezone from AG, Agricultural, to that of RI -1, Restricted Industrial, that property located at 956 Upsala Road. Owners /representatives: John and Zoryada Poland. Mr. Roger Soderstrom of Sterling International, 300 International Parkway, Heathrow, stated that he was representing Mr. & Mrs. Poland and that they have, at this time, no intended use for the property. Mr. Soderstrom stated that the rezoning is being requested to because of other Restricted Industrial areas surrounding the Poland's property. There was no one else present to speak in favor of or against the requested rezoning. Mr. Speer asked Staff if the Comp Plan would be amended first. Mr. Jay Marder stated that the procedure to amend the Comp Plan will be presented at next meeting. The rezoning must be done after the Plan is amended. The site was recently annexed into City. All in favor. Motion carried. The second item on the Agenda was a Public Hearing to consider the request to Rezone from AG, Agricultural, to that of RI -1, Restricted Industrial, that property located East of Beardall and South of State Road 46. Owners /representative: S. Theodore Takvorian. Mr. Mark Showers stated that he was representing Mr. Takvorian, 750 County Road 427, Longwood, and that the owners would like the rezoning so that, in the future, when they decide to develop the property, everything would be in place. Chairman Dennison noted that the property is at the end of an Airport runway. Mr. Showers stated property owners will comply with height restrictions and that they are within the sound contours of the Airport. Mr. Showers stated that he is aware that sewer is not available at this time. There was no one else present to speak in favor of or against the request. Mr. Keith moved on approval. Seconded by Mrs. Stairs. All in favor. Motion carried. The next item on the Agenda was the consideration of the site plan for McGuire Auto Sales, an automobile dealer sales use, (used automobiles) for property located at 2544 French Avenue in a GC -2, General Commercial District. Owner: Charles Spencer; representative: Don Pflueger. Mr. Don Pflueger was present for representation. Mr. LeRoy asked if there was any concern onto Hawthorne regarding the 12 -foot wide road access. Mrs. Sonnenberg stated that the Fire Department is requiring this access to allow for fire fighting equipment only. This is not to be opened as a driveway, but cleared for Fire Department only. Mr. Pflueger stated that a barrier is being placed at the end of the pavement so that there will not be any through traffic. The MINUTES Planning and Zoning Commission Meeting of November 15, 1990 Page 3 fire trucks will be able to get to the hydrant and the trucks will be able to get closer to the building so that they will not have to run 250 feet of hose. The access will be labeled for fire trucks only. Mr. Pflueger stated that there will be vertical posts as barricades. Mr. LeRoy made a motion to approve site plan subject to all conditions of the Fire Department. Seconded by Ms. Welch. All in favor. Motion carried. The next item on the Agenda was the consideration of the site plan for a detached sign for Kentucky Fried Chicken, a restaurant use, located at 3601 Orlando Drive in a GC -2, General Commercial District. Owner: KFC National Management Company; representative: James W. Spencer. Jim Spencer, 316 Goodwin St. Orlando, was present for representation. Mrs. Sonnenberg stated that this is the Friendly's Restaurant site. The facade was changed. Mr. LeRoy asked the total height of sign. Mr. Spencer stated that it will be 25 -feet in height. Friendly's sign was 30 -feet. Mrs. Sonnenberg stated that Kentucky Fried Chicken is complying will all City Codes. Mr. Speer moved on approval. Seconded by Mr. LeRoy. All in favor. Motion carried. The next item on the Agenda was the consideration the site plan for a detached sign for Central Florida Regional Hospital, a public /semi - public use, to be located at the northeast corner of the intersection of W. 1st Street and Jessamine Avenue in a RMOI, Multiple - Family Residential - Office - Institutional District. Owner: HCA Central Florida Regional Hospital. Representative: Raymond Hutnak. Bill Griffith, 1401 W. Seminole Blvd., Supervisor of Plant Operations for the Hospital, was present for representation. Mr. Griffith stated that they would like to place a sign on Jessamine Avenue for visitors coming to the hospital on SR 46 will MINUTES Planning and Zoning Commission Meeting of November 15, 1990 Page 4 have no problems with finding the hospital. The emergency sign is one block away on Mangoustine. The new sign will be on Jessamine Avenue. Mr. Speer stated that he felt it was not helpful to anyone to put the sign on Jessamine when it is not the main entrance. Mr. Brooks made a motion to approve. Seconded by Mrs. Stairs. All in favor. Motion carried. Mrs. Stairs commended the cleaning of the used car lot on Sanford Avenue. Mrs. Welch asked if Staff knew when the lights would be put in at Park on Park. Mr. Keith made a motion to approve minutes. Seconded by Mr. LeRoy. All in favor. Motion carried. There being no further business, the meeting adjourned at 8:00 P.M. r. FROM THE SANFORD CITYPLANNER November 7, 1990 TO: City of Sanford Planning and Zoning Commission SUBJECT: Planning Recommendations for Meeting of November 15, 1990 POLAND REZONING - Request to rezone from AG, Agricultural to RI -1, Restricted Industrial for property located on the west side of Upsala Road. 1. Site is Zoned AG, Agricultural, fronts Upsala Road and includes approximately three acres. The site appears to include a nonresidential building located on the most southwesterly portion of site. 2. Site is adjacent to land Zoned A -1, Agricultural in unincorporated area which includes a small church with a mobile home and vacant land, 3. Site is adjacent to Rl -1, Industrial Zoning which includes an industrial subdivision under development and vacant land. 4. Site was recently annexed and is undergoing a small scale comprehensive plan amendment to be designated Regional Commerce in the Future Land Use Element. Regional Commerce is a mixed use designation that permits commercial and industrial uses. Therefore, the request for industrial zoning is generally consistent with the anticipated comprehensive plan designation. 5. Recommend that request to rezone from AG, Agricultural to RI -1, Restricted Industrial be approved based the consistency with comprehensive plan policies and the existing RI-1, Industrial Zoning already established in the immediate area. NOTE: Should this rezoning be approved, it must be acted upon subsequent to adoption of the above- mentioned small scale comprehensive plan amendment. Planning Recommendations for November 15, 1990 Page 2 TAKVORIAN - Request to rezone from AG, Agricultural to RI -1, Restricted industrial for properly located on the east side of Beardall Avenue south of SR 46 East. 1. Site is Zoned AG, Agricultural and encompasses approximately 5 acres. Site Is presently vacant. 2. Site fronts Beardall Avenue, a paved County road that appears to have a substandard pavement width (less than 24 feet). 3. Site is located in the aircraft approach and noise Impact zones of the main east - west runway of the Sanford Airport. Industrial uses are generally compatible in such areas. 4. City potable water service is available on SR 46. Central wastewater service is not available or planned at this time. Florida statutes prohibit septic tank usage for industrial development in areas rezoned or replatted since July 1989. 5. Adjacent land uses and zoning include an airport runway Zoned RI -1, airport - owned lands planned for commerciallindustrial uses per the Sanford Airport master plan Zoned AG, conveyor manufacturing and repair activities Zoned C -3, Commercial/Wholesale in unincorporated area, wholesale seafood distribution Zoned C -3 and vacant land Zoned AG in the city, A -1 in the unincorporated area. 6. Site is included in the City's Second Annual Comprehensive Plan Amendment of 1990 as "Regional Commerce" which is currently being processed. The Regional Commerce land use designation includes industrial and commercial development 7. Recommend approval of request to rezone from AG, Agricultural to RI -1, Restricted industrial based on similarity of adjacent zoning districts, existing character of area and general compatibility of permitted uses with aviation activities. However, it should be recognized that central wastewater facilities will be needed prior to industrial development of site. NOTE. This rezoning is subject to approval of the above - mentioned plan amendment. FRONT THE SANFORD CITY P R November 27, 1990 TO: City of Sanford Planning and Zoning Commission SUBJECT. Planning RecQmmendations for Meeting of December B, 1990 POLAND SMALL -SCALE COMPREHENSIVE PLAN AMENDMENT - Request to amend Future Land Use Plan of City of Sanford Comprehensive Plan from High intensity Planned Development land use designation and Use Plan of City of Sanford Comprehensive a Pla to Regional Commerce ►n Future L n. 1. Site was recently annexed into the City of Sanford and contains approximately three acres. The site fronts Upsala Road. Because the site is less :,'aan three acres, it may be added to the City's Comprehensive Plan as a small -scale amendment to the future land use map. The short process for small -scale comprehensive plan amendments contrasts with the twice per year comprehensive plan amendments that must be reviewed by the Department of Community Affairs prior to adoption. 2. Site is adjacent to an industrial park that is designated Regional Commerce in the City's plan. The site and surrounding unincorporated lands are designated High intensity Planned Development in the Seminole County Plan. Regional Commerce and High intensity Planned Development are both mixed use future development areas and are considered to be compatible and equivalent in terms of major policies and standards. 3. The anticipated impact of development of this site upon facilities and services including roads, drainage, potable water, sanitary sewer and solid waste is anticipated to be insignificant. it should be noted that all facility andlor service impacts will be considered and dealt with as conditions andlor stipulations during the development plan approval process. 4. Recommend approval of request for a small -scale comprehensive plan amendment from High Intensity Planned Development in the Seminole County Plan to Regional Commerce in the City of Sanford Comprehensive Plan based on consistency between the county and city . plans and existing development trends in the immediate area at the present time.
