03.15.90MINUTES PLANNING AND ZONING COMMISSION MEETING OF MARCH 15, 1990 7:00 P.M. CITY COMMISSION CHAMBERS MEMBERS PRESENT: Helen Stairs Les Owens Joe Dennison Eddie Keith John Morris John LeRoy Tom Speer Ben Dyal Leon Brooks OTHERS PRESENT: Jay Marder, City Planner Bettie Sonnenberg, Land Development Coordinator Marion Anderson, Recording Secretary The meeting was called to order at 7:00 P.M. by Chairman Morris. The first item on the agenda was a Public Hearing to consider a Conditional Use for property in a MR -2, Multiple -- Family Residential zone, located at 1601 W. 11th Street for the purpose of Expansion of a Non - conforming Structure. Owner/ representative: John W. & D. M. Anderson (Tabled 3- 1 -90). Mr. Keith moved to remove from table. Mr. Dyal seconded. All in favor. Motion carried. Mr. J.W. Anderson, 1000 E. 10th Street, stated that he would like to have an additional unit put on an existing unit to make a duplex. Mrs. Anderson presented a site plan for the record. Mrs. Sonnenberg stated that they would need to go to the Board of Adjustment for side yard setbacks. Mr. Anderson stated that off street parking for the tenants will be coming off of Jessamine Avenue by way of the alley and that they will bring the structure up to code. Mrs. Sonnenberg stated that Staff recommendation was for approval. Mr. Dennison moved on approval based on Staff's recommendations. Mr. Keith seconded. All in favor. Motion carried. The next item on the agenda was a Public Hearing to consider a Conditional Use for property in a GC -2, General Commercial zone, located at 2710 French Avenue for the purpose of Detailing and MINUTES Planning and Zoning Commission Meeting of March 15, 1990 Page 2 Light Repair Work on Automobiles. Owner /representative: Angelo Reali. Mr. Angelo Reali, 1490 Bristol Park, stated that he would like to buy cars and clean them up for resale. He would buy from auction and work out of one of the bays of the mini - storage units. There would only be minor repair work, including brake work, with no body work. The City had stopped him from doing work at this location and that there was no one working there now. Mr. Owens asked if he had had any problems with the children at the elementary school. Mr. Reali stated "no ". Mrs. Stairs stated that it looked as though some was doing auto repair at the house beside the mini storage business and asked if Mr. Reali was doing the auto repair work at this house. Mr. Reali stated that he owns the whole area. The residents are working on their own cars. Mr. Owens asked if there would be any lif is or f loor j acks with any renovation to the storage bay. Mr. Reali replied "no ". Mr. Reali stated that he would have no more than two or three cars on site at any one time. There would not be any inoperable vehicles. He will be using one bay for auto repair business, and others will be used for storage. Mr. Owens moved to approve. Seconded by Mr. Dyal. Mr. Owens stated that it was under the guidelines of GC -2 district. There are other compatible uses in the area. Mr. Owens and Mr. Speer, in favor. All others opposed. Motion defeated. Mr. Dyal moved to deny. Seconded by Mr. Brooks. Mr. Speer and Mr. Owens opposed. All others in favor. Motion carried. The next item on the agenda was the consideration of the site plan for a laundry and game room use located at 931 -939 West 13th Street in a GC -2, General Commercial Zone. Owner /Rep: W.M. Wesley (Tabled 3- 1 -90). Mr. Dyal motioned to remove from table. Seconded by Mr. Speer. All in favor. Motion carried. Mr. W.M. Wesley stated that he anticipates having 30 video games generating a maximum of 30 people at one time. He has twelve parking spaces with four or five for the laundry facility. Most people would come by bikes for the video games. The hours of MINUTES Planning and Zoning Commission Meeting of March 15, 1990 Page 3 operation would be from 8:00 to 9:00. Mr. Brooks asked if he would open the game room until after school hours because of the problem with not keeping kids in school. Mr. Wesley stated that kids are not allowed to operate the games during school hours. He does not want to keep the place closed down until 3:00 because of others who may want to play the games. Mr. Brooks stated that kids from the age of 16 and under should not be in the place during school hours. Mr. Wesley agreed. Mr. Wesley stated that at this point he did not anticipate having pool tables. Mr. Morris stated that the cross access easement had been recorded. The applicant had agreed to giving us the directional flow through the parking lot. Mr. Sonnenberg stated that he had received a waiver concerning parking from the Board of Adjustment. His total requirement was 17 and they waived the number of 5, so that he is providing 12. Mr. Dennison moved on approval. Seconded by Mr. Dyal. All in favor. Motion carried. Mrs. Sonnenberg stated that Staff had approved the site plan for Dunan Bricks. Mr. Marder stated that he did not forget about Comp Plan; he was grappling with how to promulgate. Mrs. Sonnenberg stated that the lights on Georgia Ave are mounted on FPL poles and FPL will see if they can be adjusted. Mr. Morris welcomed Mr. Owens. Mr. Brooks stated that on McCracken Road, there was a cut across the road. He asked why it had not been repaired. He stated that it was getting deeper and deeper. Unanimously approved minutes as circulated. Meeting adjourned at 7:30 P.M. s, FROM THE SANFORD CITY PLANNER M a r c h 9 1 9 9 0 TO: City of Sanford Planning and Zoning Commission SUBJECT: Planning Recommendations for Planning and Zoning Commission Meeting of March 15, 1990 ANDERSON - Request conditional use approval to permit expansion of a nonconforming structure located in an MR -2, Multiple - Family Residential Zone at the southwest corner of West 11th Street and Jessamine Avenue. 1. Site is Zoned MR -2, Multiple - Family Residential and includes an existing one - story, one - family dwelling on approximately 5,100 square feet. 2. One- story, multiple- family dwellings are located adjacent to site as are various single- family dwellings in an existing MR -2, Multiple- Family Residential Zone. 3. Recommend approval of the request to expand a nonconforming use based on the existing character of the area with the stipulation that such expansion be limited to the addition of one additional dwelling unit for a maximum of two (2) dwelling units on the site. THE AUTO CLUB - Request conditional use approval to permit automotive detailing and light repair work in a GC -2, General Commercial Zone located on the west side of French Avenue south of 27th Street. 1. Site is Zoned GC -2, General Commercial and includes an existing mini - warehouse building on approximately one half acre. Site fronts French Avenue. 2. Site is adjacent to single family residences, various businesses and vacant land Zoned GC -2. Site is also adjacent to an elementary school Zoned SR -1, Single Family Residential. 3. Recommend denial because the existing building is not designed to be utilized for the intended purpose and the general incompatibility of automotive repair and service activities in such close proximity to the adjacent elementary school.
