Members Present: Eddie Keith John Morris Jay Malone Brent Carli Tammy S peer Leon Brooks John LeRoy Joe Dennison Members Absent: Gary Davidson Others Present: Jay Marder, City Planner Bettie Sonnenberg, Zoning and Arbor Inspector Chairman Morris called the meeting to order at 7:00 P.M. The first item on the agenda was the consideration of a request for a conditional use for preparation of food for off - premises consumption, that property located as 801 Celery Avenue in a RC -1 zone. Owner: Independent Oil, Inc.; representative: Alex Braumand. Mr. Hoshyar Khoshesperam of 125 Grace Boulevard, Altamonte, stated that they would like to make the store bigger and to sell chicken. Mr. Brooks inquired as to the additional traffic. Mr. Khoshesperam stated that the whole idea is fast food and convenience for the older people in the neighborhood; these older people do not have cars. Mr. Khoshesperam also stated that there will be 3 employees: 1 cashier, 1 cook, and 1 stockman; with the hours of operation being from 6:00 A.M. to 12:00 P.M. and fast food from 8:00 A.M. to 11:00 P.M. There was no one else to speak for or in opposition to the requested conditional use. Mr. Carli made motion to approve. Mr. Keith seconded. All in favor. Motion carried. The next item on the agenda was the consideration of a request for a conditional use for a retail tire store at the northeast corner of U.S. Highway 17 -92 and Americana Boulevard in a GC -2 zone. Owners: Sam and Nadim Aboulhosn and Maria and Angel Compain and Conchita Canpain- Zabala; representative: John M. Sikes. MINUTES Planning and zoning can February 18, 1988 Page 2 Becky Courson, 103 Maplewood Drive, Sanford, stated that the request is to sell tires and to install and balance. The tire store is compatible with other business in the surrounding area. Mr. John Sikes, 1199 N. Orange Avenue, Orlando, stated that the building would be 50' in depth, 120' long. The show roan will be in front. The size of the store will be about 6,000 square feet. It will have three or four bays. It is for tire retail only. Mr. Sikes stated that the depth of the property is 24' less than the description given in the tax rolls because the adjacent owner claims ownership, and the proposed store will not encroach upon the 24' in question. Ms. Courson stated that she spoke with D.O.T. and they recommended a cut to the north at the end of the property with one access for ingress and egress on Americana Boulevard. Mr. Sykes also stated that the building would be masonry with a steel frame, the facade has a mansard roof, will be a metal store front with glass and a nice entryway. There was no one else present to speak for or against the proposed conditional use. Mrs. Sonnenberg entered into record a letter from Moncrief and Reed in reference to Dr. Robert J. Smith's objecting to the inclusion of the 24'. Mr. Dennison made motion for approval on the revised legal description. Mr. Carli seconded. Mr. Malone asked why Staff had recommended denial of this conditional use. Mr. Marder stated that the uses in the area does not include auto repair businesses. Mr. Harder said that the recom- mendation recognizes that there are other areas of Orlando Drive /French Avenue that have many automobile accessory sales and installation, but they aren't really located in that particular area at the present tine; so, the recommendations is more or less conservative. All in favor, Mr. Malone opposed. Motion carried. The next item on the agenda was the consideration of the conditional use for a used car lot, that property located at 7th Street and French Avenue in a GC -2 zone. Mr. Vaughn Martin, 135 Delta Road, Geneva, stated that he will have between 30 and 40 cars on the property and he will be back with a site plan. There was no one else present to speak regarding the proposed conditional use. Mr. Carli moved on approval. Seconded by Mr. LeRoy. All in favor. Motion carried. The next item on the agenda was the consideration of a site plan for Hoffman Building, a 7 unit commercial service building located at 2530 Sanford Avenue in a GC -2 zone. Owner: W.A. Hoffman; representative: Mr. Bo Simpson. Mr. Bo Simpson, 1700 N. Highway 427, Longwood stated that he represents W.A. Hoffman who is proposing to build a very small commercial building. The plan has been revised for the swale to comply with the City and the County. The finished elevation is 48.5. MINUTES Planning and Zoning Commission Febr 18, 1988 Page 3 A 6' hedge will be put in to buffer and the 7' easement in back has been granted to the City. There is an easement on the northside for Florida Power and Light. Mr. Simpson stated that Mr. Hoffman is granting a 3' easement. There will not be any A/C compressors, there will be three wall units, each unit has its awn meter. Mr. Carli asked Staff what type of vehicle could maneuver in this area. Mr. Marder stated that probably a step van, delivery van, but no tractor trailers. Mr. Keith moved on approval with changes of two elevations from 50.9' and 48.92' to 50.4' and 48.5' respectively; and the planting of a ligustrum hedge on the north side on 18' centers to grow to 6 feet in height. Mr. Carli seconded. All in favor. Notion carried. The next item on the agenda was the consideration of a site plan for a truck terminal located at 110 Rand Yard Road in a RI--1 zone. Owner: Jose Mila; representative: Bob Seigler. Mr. Seigler, 2524 South Park Drive, stated that he aided and abedded the annexation to be under the ccmtp plan and aided the rezoning. Mrs. Sonnenberg stated that the fire hydrant location has been resolved but the Fire Department has requested that no C.O. be issued until the fire hydrant is in place with an adequate water supply. Mr. Jose Mila, 2613 Horseshoe Court, Cocoa, stated that there will be 24 to 30 semi trailers there per day, business may increase with the new facility, and 400 feet frcm the property to SR 46 will be paved in asphalt. Mr. Malone moved on approval. Seconded by Mr. Dennison. All in favor. Motion carried. The next item on the agenda was the consideration of the site plan for the Crises Pregnancy Center, a service located at 605 East 25th Street in a RC -1 zone. Owner: Carl Wood; representative: Pastor David Bohannan. Pastor Bohannan of 354 Cidermill, Lake Mary, stated that a they offer an alternative to abortion. The property has been leased to them with no money involved for 18 months but they will have to fix it up. There is a parking lot on the side yard. Ms. Barbara Renay, 310 Evansdale, Lake Mary, stated that sane one is there 4 nights a week for 2 hours. Water does not stand as there is good drainage. Mr. Marder stated that there is sere retention in the parking area. Mrs. Sonnenberg stated that the water flows onto 25th Street. Ms. Renay stated that the lady directly across the street, Ms. Pauley, is glad they are there. The parking area will be landscaped with timber and mulch. MISS Planning and Zoning Cannission February 10, 1988 Page 4 Mr. Carli made motion for conditional approval for eighteen months subject to providing a mulched parking area delineated with landscape timbers within 6 months. Mr. Dennison seconded. All in favor. Motion carried. Mr. Carli asked if anything had been done relative to the day care center on 17 -92 near 2nd Street. Mrs. Sonnenberg stated that she has not received the report on this as of yet. Mr. Carli asked about the street sign in front of the new Ratliff structure. He stated that in that area we wanted a 4 to 5 -foot height on this sign. Chairman Morris stated that there was discussion and the sign was to be ccmplimentary to this struc- ture, and this sign is surely not complimentary to this fine old structure. Mr. Carli moved that the Board advise City Camiission to make a moratorium on all signs over 25 free standing, in the City of Sanford, until such time that a sign ordinance can be worked out in the growth of the City of Sanford. Seconded by Mr. LeRoy. Mr. Malone asked if Mr. Carli would care to amend the motion to include a square footage. Mr. Carli stated that what we are looking at is a cap, we do not need the square footage, it can be looked at in the ordinance. Mr. Marder stated that the Sign Ordinance is being reviewed as part of the Land Development Regulations. In favor of the motion was Mr. Carli, Mr. Malone, and Mr. LeRoy; opposed to the motion was Mr. Brooks, Mr. Morris, Mr. Keith, Mr. Dennison and Mr. Speer. Motion defeated. Mr. Speer requested that the City check on flowing water in the north /south alley bet- ween 1st and 2nd Streets, Palmetto and Magnolia Avenues. Meeting adjourned at 8:15 P.M. Marder, City Planner L SUBJECT: Planning Recommendations or Meeting of February 16, 1988 Item No. 1: Independence Oil Inc. - Request conditional use approval to permit the preparation of food for off - premise consumption in an RC -1, Restricted Commercial Zoning District for property located at the southeast corner of Celery Avenue and Locust Avenue. A. The site is presently utilized as a convenience store with self - service gasoline pumps. B. A grocery store is located west of site and vacant land is located east of site within an existing RC -1 Zone. C. Various single family dwellings are located on north side of Celery Avenue in an existing MR -1, Multiple Family Zone and also south of site in an existing SR -1, Single Family Zone. D. Recommend approval of conditional use request to permit the preparation of food for off- premise consumption based on the existing use already established for the site and the existing character of development in the immediate area. Item No. 2: Aboulhosn /Compain /Zabala - Request conditional use approval to permit a retail tire store in a GC -2, General Commercial Zone for property located at the northeast corner of U.S. Highway 17 -92 and Americana Boulevard. A. Site includes several existing structures. B. Existing land uses in the immediate area include a medical clinic, restaurants, a car dealership and a shopping center. C. Recommend that the conditional use request to permit a retail tire store be denied because automobile and truck service would be out of character and generally incompatible with uses already established in the immediate area adjacent to site. This recommendation recognizes that, while the automobile dealership located north of site includes service activities, the principal use is sales.
