09.03.81MINUTES Planning and Zoning Commission Sept. 3, 1981 7 :30 P.M. Members Present: Cliff Miller Forrest Foggin John Morris Jim Barks Sheila Roberts George Willis Members Absent: Others Present: J. Q. Galloway, Chairman Frank Whigham C. B. Franklin Leah Rogers, Zoning Inspector The meeting was called to order at 7:30 P.M. by the Vice - Chairman, Cliff Miller, in the absence of the Chairman, J.Q. Galloway. Mr. Galloway was recuperating from a minor illness. The first item for consideration was a Public Hearing for a Conditional Use for the sale of alcoholic beverages for consumption on the premises at 1200 French Ave. There was also a site plan and request for change of use from a carpet retail store to a western -type bar and restaurant. Mr. Dale Gustafson was present to speak in favor of the conditional use and explained the type of establishment he is planning. He said he plans an authentic western -type restaurant and lounge with live entertainment and requesting the sale of alcoholic beverages for consumption on the premises. Mr. Andrew Kutz was present to speak in favor and said that Mr. Gustafson was attempting something very unusual and that the place would have a museum at- mosphere and should be an interesting addition to Sanford. Mr. Frank Noell was present to speak in opposition and said he was representing the owner of the Sterchi Furniture store building. He said he was in opposition to another store in the area selling alcoholic beverages, next to another bus- iness, near a school and within walking distance of the Farmer's Market.,When asked if there was a bar just down the street, Mr'. Noell said that was a fact. Mr. Ken McIntosh was present to speak for the members of the Shiloh Baptist Church opposing the close proximity of the bar and restaurant to the church, located on 13th St. Mr. E. Southward was present to speak in opposition for his father, Ira Southward, first owner of the property in question, and present owner of Southward Fruit Co. office. He was in opposition because of the existing problems in that area and would not like to see another establishment of the same kind in that area. Mr. Pete Kostyun, owner of George's Bar, was present to speak in opposition and said the intended lounge and restaurant is within 500' of his establishment. Page 2 Mr. Willis moved to deny the conditional use on the basis that he felt it would be mainly an alcohol- consuming establishment and as a citizen, he did not feel this would be an improvement to the community. Mrs. Roberts seconded. Motion carried. The site plan was the next part of the item to be considered. In order to con- form to the requirements in the comments from the staff, the architect revised the driveways to 24' width on the master plan. Mr. Morris moved to approve the site plan as modified. Mr. Barks seconded. Motion carried. The change of use from a carpet retail store to a western -type lounge and res- taurant was not considered because of the action on the conditional use request. The next item for discussion was a Public Hearing for a conditional use for a church for Maranatha Pentecostal Church, Inc. in the MR -1 zoned district, lo- cated between Avodado Ave. and Pecan Ave. on W. 7th St., represented by Reginald Daniels and Evans Bacon. Ms. Mildred Williams, 6th St.., was present to speak in favor of the church and said she greatly approved of.a church in that area and felt there was plenty of room. Mr. Morris moved to approve the conditional use. Mrs. Roberts seconded. Motion carried. The next item for discussion was a Public Hearing for a Conditional Use for a used Automotive Sales in the GC -2 zoned district at 711 French Ave. represented by Margaret Hicks. In regard to the staff comments about a possible parking problem, Ms. Hicks said that the parking spaces in the front of the building would be kept open for customers. Mr. Al Porzig was present to speak in opposition to the request. He said he is owner of the adjacent property and operates Porzig Plumbing at 705 French Ave. and the use car lot on the corner has been a problem because it is over- crowded and evenings and weekends they use his parking space and have done damage to the hedge, etc. He was definitely opposed to another used car lot. Mrs. June Porzig was present to speak in opposition. She said she has a real estate office in the 705 French Ave. building which was remodeled from a very run -down pieee of property and felt that a used car lot next door would be detrimental. Mr. Willis said that since no site plan showing parking had been submitted, he felt the parking could be a problem, and he would move to deny the request. Mrs. Roberts seconded. Motion carried. Miss Rogers asked the board to look at GC -2, B. Conditional Uses Permitted, (5) Automotive and mobile homes, new and used, sales and service and consider if the word "automotive" was properly used. The feeling was that it should be "automobile" but that it could be taken care of the next time the Zoning Ordinance is revised. The Minutes of the previous meeting were approved.
