12.17.81MINUTES Planning and Zoning Commission Dec. 17, 1981 7:30 P.M. Members Present: J. Q. Galloway, Chairman James Barks C. B. Franklin Cliff Miller Sheila Roberts George Willis Members Absent: Forrest Foggin Frank Whigham John Morris Others Present: Leah Rogers, Zoning Inspector The meeting was called to order at 7:30 P.M. by the Chairman, J. Q. Galloway. The'first item for consideration was a Public Hearing to rezone from RMOI to GC -2, the property located at 501 E. 1st St. The planned use of the property is for commercial use. Mr. David Suellau was present to speak in favor of the request and said he did not have any specific tenant in mind, but the building has been empty for two years and he felt he would have a better opportunity to lease if it were zoned GC -2. He said there are no plans for additional building as there is no space. There was no one to speak in opposition. After discussion, Mr. Barks moved to recommend approval. Mrs. Roberts seconded. The next item for discussion was a conditional use of a home occupation, telephone service only, for Protectors Security, located at 2425 Lake Ave. in the SR -1 zoned district, represented by Thomas A. Hood. After discussion, Mr. Barks moved to approve. Mr. Franklin seconded. Motion carried. The next item was a site plan of a church for Maranatha Pentecostal Church, located at 610 Pecan Ave. in the MR -1 zoned district and a paved parking lot for the church, located north of 7th St. between Pecan Ave. & Poplar Ave. in the RI -1 zoned district, represented by Elder Evans Bacon. He said the handicap parking spaces would be changed to 12' x 20' and the internal landscaping be put on the site plan to comply with the Zoning Inspector's comments. He said the papers are being drawn up for the purchase of the property for the parking lot, and the loan from the bank has been verbally confirmed and they have 25% of the amount in cash for a down payment. He said they are planning to build • steel frame building and will need an extension of the conditional use for • church at the present site, 1016 French Ave., for at least 6 more months. He said they have checked on alternate meeting places and the rental fees are too high to allow them to pay the rent and build at the same time. Mr. Barks moved to approve the site plan with the stipulation that all handicap parking spaces are shown as 12' x 20' and the internal landscaping requirements (10 sq. ft. per parking space) are shown on the site plan. Mr. Franklin seconded. Motion carried. The next discussion was regarding the request for the extension of the conditional use. Mr. Willis moved to grant the extension to the meeting of Jan. 21, 1982 at which time progress should be shown with the purchase of land and a building construction loan received and a permit obtained for the building. Mr. Barks seconded the addition. Carried. The next item for consideration was a site plan for a 420 sq. ft. office in part of an existing single - family dwelling located at 420 Oak Ave. in the RMOI zoned district, represented by Carl Gutmann. After discussion on the engineer's comments regarding the paving of the alley and accompanying drainage sketch, Mr. Miller moved to table the item to the Jan. 7th meeting. Mr. Barks seconded. Motion carried over the dissenting vote of Mr. Willis because he felt it should have been approved conditionally. The next item for discussion was a proposed addition to Cooper's Pub, located at 2605 Park Drive in the GC -2 zoned district, represented by James Hackett. After discussion, Mr. Barks moved to approve with the stipulation that the drainage and parking plan be approved by engineering. Mr. Miller seconded. Motion carried. The next item was a final plat and final engineering plan for Groveview Villas, Unit 1, located north of Lake Mary Boulevard, east of Sir Lawrence Drive, west of Justin Way, and south of Groveview Village in the MR -1 zoned district, represented by Herb Ross for Sentex Homes of Florida. He said the plat consists of 11.6 acres, with 89 units which is 7.7 per acre. He said he was asking for approval subject to compliance with final engineering approval and Zoning Inspector comments. Mr. Barks moved to approve the final plat and final engineering subject to final engineering review and compliance with the Zoning Inspector's comments. Mr. Franklin seconded. Motion carried. Ms. Rogers asked the board to consider the zoning in the area on the west side of 17 -92 from Airport Blvd. to Lake Mary Blvd. in the area of Harcar, Inc. and determine if a change in zoning would be in order. After discussion, it was the feeling that the area seems compatible to the present GC -2 zoning. The question of regulation of distance between ground signs was brought up for discussion and the board requested the Building Official to send a recommendation to the next meeting for consideration. The Minutes of the previous meeting were approved as mailed. The Minutes of the Nov. 19th meeting were amended because of two address changes for the apartments on Airport Blvd. and the Andrew Kutz office building approved at that meeting.
