Gallagher, Jr. George Millis Members Absent: C. B. Franklin, Jr. Shelia Roberts Frank Whigham Others Present: Al Payne, Zoning Director The meeting was called to order by the Chairman, J. Q. Galloway at 8 :00 P.M. The first item on the agenda was a Public Hearing to rezone from PUD (unplatted and undeveloped area) to GC -2, MR -2 and SR -1, that property described as Sanora Planned Unit Development. Present to speak in opposition to the proposed changes were Gordon Meyer, 113 Sanora Blvd., Paul Jarvis of Cardinal Industries, Russell Odham, 102 Krider Rd., Commissioner Julian Stenstrom and Don Grainger. Mr. Meyer said his objection was only to the 700 sq. ft. minimum requirement in SR -1 and.-felt that there should be a requirement somewhere between 700 sq. ft. and 1300 sq. ft. in the Zoning Ordinance. Mr. Jarvis was present to oppose the rezoning of the Cardinal area because it is completed and asked that it remain PUD. Mr. Odham was present to represent the Homeowners Association of Sanora and said the only objection to the rezoning was the SR -1 area because of the 700 sq. ft. minimum and hoped there would either be a new'classification or change the minimum back to 900 sq. ft. and said they would prefer 1000 sq. ft. as minimum. Mr. Stenstrom was present to question the rezoning of the PUDS. He said he had no recollection of the City Commission requesting rezoning, but was in favor of changing the minimum area for PUD from 20 to 100 acres in order to plan for the future when .property might be annexed into the city. Mr. Krider was present to represent Hunt Oil Co. and said their only objection was to the parcel designated as GC -2 and gave each member a sketch showing the portion they would request be zoned PIR -2, which consists of 20.112 acres in the eastern portion. In spite of the fact that apartments are a permitted use in GC -2, they would prefer that portion be MR -2. MINUTES - Planning & Zoning Commission - Sept. 18, 1980 - 8:00 P.M. Page 2 --------------------------------------------------------------- - - - - -- Mr. Grainger was present to give his opinion as a citizen of Sanford and said the 700 sq. ft. minimum house did not fit in the area. Mr. Warren, 110 Rabun Ct., was present to object to the 700 sq. ft. minimum requirements of SR -1 in the Sanora area. After discussion, Mr. Barks made the following 3 -part motion. 1. Recommend Cardinal Industries portion be dropped from consideration and remain PUD. 2. Recommend that the Hunt Oil property be removed from PUD and rezoned as noted on Mr. Krider's exhibit, with the eastern 20.112,acres of the suggested GC -2 be MR -2, and the remaining portion of 8.638 acres be GC -2. 3. Table the matter of rezoning area marked SR -1 until the Board can come up with a better classification. Mr. Miller seconded. motion carried. The next item for consideration was a Public Hearing to rezone from PUD to GC -2, MR -1 and SR -2, that property described as Americana - Carriage Cove Planned Unit Development. Mr. Martin Mindich was present to request that the property owned by him and designated to be rezoned to MR -1 be changed to MR -2. Galloway, Chairman City of Sanford Planning and Zoning Commission Subject: Rezoning of Americana- Carriage Cove PUD Dear Sir, On September 15, 1980 I had the pleasure of meeting with both Mr. Payne and Mr. Braceland of the City and reviewed the pro- posed rezoning of the above subject property. We are in agreement with their recommendation with the exception of 1.5 acres at the corner of Downing Street and State Road 427 (see attached legal). We are requesting that this be zoned GC -2. MINUTES - Planning Zoning Commission - Sept. 18, 1980 - 8 :00 P.M, P a,g e, 3 -, n �,'r - - - - _ _. - -. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - After discussion, Mr. Miller moved to recommend that Americana - Carriage Cove be removed from PUD and rezoned to CC -2, MR and SR -2, as advertised with the exception of a portion of 1.5 acres of Carriage Cove be rezoned GCR2 instead of SR -2 per the .following legal description: Commence at the NE corner of the NW4 of the NE4 of the NW4 of Section 13, Township 20 South, Range 30 East, Seminole County, Florida, thence run S. 01 0 04 1 49" W, along the East line of the NW4 of the NE 4 of the NW4 of said Section 13, for 825.62 feet to a Point of Beginning: thence continue S. 01 1 49" W, along the East line of the NW4 of the NE'-4 of the NW4 of said Section 13, for 94.10 feet to a point: thence N. 86 E, for 3.84 feet to a point on the Northerly Right of Way line of State Road No. 427; thence run S. 39 ° 06'54" W. along the Northerly Right of Way line of said State Road No. 427, for 257.30 feet to a point; thence N. 61 0 29 1 54" W for 79.25 feet to the point of curvature of a circular curve concave to the Northeasterly and having for its elements a radius of 128.54 feet and a central angle of 62 0 16'15 "; thence run along the arc of said curve for 139.70 feet to a point of tangency; thence N. 00 E.. for 145,00 feet to a point; thence S. 89 E. for 295.17 feet to the Point of Beginning. Containing 1.509 acres more or less. The next item was a Public Hearing to rezone from PUD (unnlatted and undeveloped area) to SR -1A, SR -2 MR -1 and GC -2, that property described as Hidden Lake Planned Unit Development. Mr. A. B. Peterson, Jr. was present to represent the owners of 650 or 700 acres of undeveloped area of Hidden Lake PUD, and said the property owners are in complete agreement with the suggested changes north of Airport Boulevard, but would request action be delayed on the portion south of Airport Blvd. until he can bring in a redevelopment plan which he said should be ready in a week. He said the property owners would like a zoning classification between 700 and 1300 sq. ft. but the primary request was for a delay in rezoning until the redevelopment plan can be submitted for consideration. Air. John Johnson, President of the Hidden Lake Homeowners Association, was present and objected to the MR -2 zoning which allows apartments, and asked about the entrance to Hidden Lakes and the traffic increase, The present zoning of PUD allows the use of apartments so the rezoning would not change the possibility of apartments being built in the area. Mr Willis said he felt that an area of this size would warrant a redevelopment plan and if there was one near completion, he moved to table the item until the meeting of October 16, 1980. Page 4 The next item for consideration was a request from Complete Interiors, Ramblewood, for a side yard setback of 18 instead of 20' between dwellings on lots 68 & 69, Ramblewood, Unit 1, to save a large oak tree. Audrey Krauss was present to represent the request and presented a drawing of the property in question to show the location of the tree. Mr. Gallagher moved to approve the variance. Mr. Foggin seconded. Motion carried. Mr. Bill Murphy, builder from Orlando, was present to represent a site plan and request for conditional use for 6 duplexes on lots 5 thru 10, Blk. 9, Dreamwold, 3rd Section, located on the east side of Lake Ave. south of 24th Place. After a review of the site plan, it was apparent there were too many changes. to be made in order for the plan to be acceptable. Mr. Miller moved to table the item for a better site plan and engineering plans to meet requirements. Mr. Gallagher seconded. Motion carried. The next item for discussion was a possible change to the Zoning Ordinance to change the 700 sq. ft. minimum living area to 900 sq. ft. as a permitted use in the SR -1 zoned district. Mr. Miller moved to set a Public Hearing to amend the SR -1 zoning to allow a minimun of 900 sq. ft. living area, with 700 so. ft. as a conditional use. Mr. Gallagher seconded. Motion carried. The minutes of the previous meeting were approved as mailed. There being no further business, the meeting was adjourned.
