04.19.56ZONING & PLANNING COMMISSION Minutes of Regular Meeting, Thursday, April 19th, 1956, City Hall, Sanford, Florida Members present: Robert S. Brown, Chairman A. L. Collins Howard Faville A. W. Inspector Members absent: Earlyle Housholder Jimmy Wright Alfred Stanley (resignation submitted as of April 9, 1956) Meeting called to order by Chairman Brown. Request of Mr. M. R. Strickland to rezone the west 40 of Lots 4 and 10, Block 9, Highland Park, from a residential zone to a 0-1 zone for use as a filling station structure was submitted to the board. Mr. Strickland stated that a Mrs. Salsbury's property was the only residence in this immediate area that the filling station would be objectional to, but that so far Mrs. Salsbury seem to be favorable toward the proposed idea. Also, since Mr. Strickland intended to utilize the back area, he would wish to asphalt or black top up to the property line in the rear. To some protest, Mr..XoKibbin said he felt that this situation was not so- called Nspot zoningu for one individual, but extending a zone that is already established. The general feeling was that due to the lot size in this particular situation, and due to the already partial commercial zoning, the area requested could be utilized to a better advantage in conjunction with French Avenue, a commercial zone, rather than as residential property. Therefor, Mr. Moxibbin moved that the rezoning be approved by this board and recommendation submitted to the City Commission for public hearing. Notion seconded by Mar. Faville. Note listed as follows: Collins - Kaye Lee - Kaye Brown - Aye McXibbin - Aye Faville - Aye Wilson - Aye Motion carried. Mr. A. Edwin Shinholser, Attorney, next appeared before the board with a petition from property owners fronting on First Street, between Poplar Z & P Minutes - April 19th, 1956 Page 2 Avenue and Avocado Avenue on the south side, and between Poplar Avenue and the Northerly Extension of the west side of Avocado Avenue on the north side, excepting only Lots 12 and 13, Block Y. The signed petition requested that all of Lots 9 thru 14, inclusive, of Block Y, St. Gertrude Addition, be rezoned from its present classification of 0-2 to an R1 -X district upon the ground that said property is already predominantly residential area; there being in the area described six residences on the North side of the street and seven on the South side. Mr. Shinholser stated that the petition was drawn up due to the fact that it is fairly postive information that Lots 12 and 13 of Block Y had been sold within the last 60 days and it is the under- standing of surrounding residents that the party is contemplating the erection of a body shop, which could become noxious to the six houses on the north side and to the seven houses on the south side of West First Street. Under general discussion, it was felt that possibly this residential area should have been rezoned sometime ago, since the zone of C -2 had been placed thereon when West First Street was the main artery leading out of Sanford, and it was expected that this area would grow as a heavy Industrial zone. Mr. Mogibbin moved that the 10-day rule, as to requests being sub- mitted in advance, be waivered in this case. Motion seconded by Mr. Lee and carried. Mr. Molibbin then moved that the following recommendation for re- zoning be submitted to the City Commission: That Lots 9 thru 14, Block Y. (north of West First Street and west of Poplar Avenue) be rezoned from its present classification of 0--2 (commercial - industrial) to an R1 -X district. Motion seconded by Mr. Collins and carried. Mr. Moffibbin also moved that the following recommendation be sub- mitted to the City Commission along with the above recommendation: It is recommended that all land south of the extension of the south right -of -way line of Commercial Street and north of West First Street, between Tamarind and Mangoustine Avenues, together with Lots 7 and 8, of Block Y, be rezoned from its present 0-2 district to an R1 -X classification. Motion seconded by Mr. Lee and carried. Mr. MoKibbin moved that the resignation of Alfred Stanley from the board be accepted with regrets and transmitted to him. Motion seconded by Mr. Wilson and carried. 0 Lm in d Z d r V? a d Z Q Z & P Minutes - April 19th, 1956 Page 3 It was decided that until further notice, the board would hold two meetings a month; said meetings to be the first and third Thursday of each month. Mr. Faville at this time wished to bring up the subject of the wrought -up public, in rather a large body, attending their meetings and even after discussion period waiting for the board's final opinion and vote on the request submitted. Mr. Faville wished the board to know that he wanted to be a very definite member on zoning and planning affairs, but along with possible other members, could not jeopardize the firm with whom he is associated by giving out his personal opinions on such requests. He felt that some procedure could be. in order whereby the public could be asked to leave before final opinions and vote were called for and the party making the request be notified in some other manner. The board felt that even though the meetings are considered "open meetingO, some procedure could be worked out that would eliminate the situation as above referred to. Mr. Knowles was asked to check into the parliamentary procedure regarding this and refer it back to the board. There being no further business, meeting adjourned. ~airman
