10.17.57Regular Meeting of Zoning and Planning Commission October 17, 1957 Members present were Messers. Brown, Johnson, McKibbin, Faville, Morgan, Talley, Collins, and Lee. Also present were Building Inspector Yelvington, City Manager Knowles, A. 0. Roberts, John Williams, William Kirk, Volie Williams, Sr., and Fred Anderson. Mr. Brown called the meeting to order. Mr. McKibbin moved that the reading of the minutes for the previous three meetings be waived, as he had read them for the Commission, and that the minutes be approved as written. Seconded by Mr. Morgan and passed. The request for rezoning of Lot 13, Block 1, Fairview, from R -1 to R -3 of John T. Owens was discussed. Mr. McKibbin reported that Mr. Karns had investigated the county records and determined that Owens had purchased the property in 1953. Since the present law was then in effect, the purchase was made with the assumed knowledge that it could not be used as proposed. On this basis, Mr. McKibbin moved that the request be denied. Seconded by Mr. Faville and passed. The request of John Williams to rezone Lots 7 through 16, Pine Heights and Lots 1 through 6, Teages Addition from R -1 to C -1 was discussed. Mr. John Williams stated that the intended use of the property was for a shopping center and that this area was necessary to give the commercial area sufficient depth in order to get a shopping center in the area. Mr. Williams also stated that a C -N zone would be acceptable. Mr. Williams pointed out that the present area is not sufficient due to the stores desiring off -- street parking area in a ratio of 4 to 1 to the building area. Mr. Morgan moved to recommend the rezoning of the area rea_uested, but from R -1 to C -N. Seconded by Mr. Collins and passed. Mr. Andy Carraway's request to rezone Lots 11 through 22 and Lots 28, 29, and 30 of Block M. First Street Extension from R -2 to C -1 was next discussed. The proposed use is pharmacy and professional offices with apartments above. Mr. McKibbin stated that a_C -N zone would be acceptable to Mr. Carraway. Considerable discussion was held as to a much larger area in that vicinity is already of a commercial type use. Mr. Lee moved that they recommend rezoning from R -2 to C -N that area between First Street and Second Street, bounded on the east by San Carlos Avenue and on the west by Lakeview Avenue, less those lots on First Street, already zoned C -1, between San Juan Avenue and Lakeview Avenue. Seconded by Mr. Johnson and Mr. Morgan and passed. There being no further business, the meeting adjourned. Chairman g/0
