11.07.57ZONING AND PLANNING COMMISSION Regular Meeting November 7, 1957 Members present were Messers. Brown, Faville, Karns, Morgan, and Talley. Also present were Building Inspector Yelvington and City Manager Knowles. Chairman. Brown called the meeting to order. The request for rezoning of the Northly 125 feet of Lot 44, J.E. Pace's Sub - division from an R -1 to a C -N zone in order to use the property for proposed construction of a pharmacy shop was presented by Kenneth E. Slack, owner. The Commission went into a lengthy discussion in regards to this request. Mr. Karns questioned the fact that the board receives many individual rezoning requests and that possibly the board does too much individual rezoning. Mr. Brown stated that when the Zoning Ordinance is re- worked, he felt that individual rezoning requests would be reduced greatly. Mr. Brown also stated that he felt that the board should not reduce the R--2 zone at the expense of the commercial areas. Also, Mr. Karns' thought on this was that it would be well to give much consideration to the hospital being in this area and the fact that lowering the zoning could bring in down- grading establishments. Mr. Faville moved that the request be denied due to the fact that the commercial area should not be extended or increased at this particular location since there is now a buffer zone which is of value-in its present status. Motion seconded by Mr. Karns and carried. Mr. Brown then brought up the fact that the creation of a duplex area with regards to an overlay map and requirements there- of should have some more discussion. Mr. Brown brought to the board's attention that the County Zoning Regulations would be presented for public hearing on November 19a, at 2:00 p.m. at the Court House in the County Commission Room and requested that as many of the Zoning and Planning members as possible try to be present. Mr. Yelvington then asked the board for permission to discuss Section 5, Exceptions, Items 1 and 2, of the Zoning Ordinance. He stated that in many cases he has encountered the following examples: 1. Building has only an 8 -foot front yard in lieu of a 10 -foot front yard as required, and had requested a permit to make an addition on the back because they had an excessive rear yard area. Building has a 10 -foot and a 25 -foot side yard; 10 -foot front yard, with a 2-foot rear yard, but would like to make an addition on the side where the larger side yard exists. It was the consensus of opinion of the board that this would still constitute a request for variance and must go before the Board of Adjustment. It was brought to the board's attention by Chairman Brown that there would be a "Certificate Course" in Deland, Florida on December 9b, 10th, and 11tb and that possibly some of the Zoning and Planning members could find time from their duties to attend.
