4410 Lk Mary Townhomes PD Ordinance No. 2017-4410 An ordinance of the City of Sanford, Florida relating to a total amendment of the previously approved Lake Mary Townhomes Planned Development (PD) to a new revised PD to be known by the same name PD and approving a new PD master plan; providing for the rezoning of real property located at 1160 West Lake Mary Boulevard and assigned Tax Parcel Identification Number 10-20-30-300-0160-0000 within the City Limits (map of the property attached); providing for findings and intent, development conditions and the resolution of disputes by the Planning and Zoning Commission; providing for the taking of implementing administrative actions; providing for the adoption of a map and PD master plan by reference; providing for conflicts; providing for severability; providing for non-codification and providing for an effective date. Whereas, an application has been submitted proposing to amend the previously approved Lake Mary Townhomes PD at 1160 West Lake Mary Boulevard; and Whereas, the subject property was rezoned to a PD by means of the enactment of Ordinance Number 3909 on January 24, 2005 and the rezoning was implemented by approval of the associated PD Development Order (which included the Lake Mary Complex PD Master Plan) on April 8, 2005; and Whereas, pursuant to Article IV, Section 4.3, G of the City's Land Development Regulations, a PD project expires 3 years from the effective date of the approval and all work must be completed within the 3-year time frame; and Whereas, the PD rezoning actions taken by the City in 2005 have expired and all approved uses and development conditions associated with the PD must be established including, but not limited to, approval of a new PD master plan; and Whereas, the new proposed master plan provides for a townhome development with approximately 104 dwelling units (13 townhouse buildings, each being 2 stories in height, with 8 units being within each townhouse building) with the ultimate I I P number of units being determined upon verification of the wetland line located on the subject property and the architectural design that is implemented; and Whereas, the Property Owner of the PD property is First American Land Trust Company, LLC; and Whereas, the applicant for the PD approval Jamie Jimenez, Esquire; and Whereas, a Citizen Awareness and Participation Plan (CAPP) meeting requirements of the City has been submitted to the City and that process included a meeting held on February 8, 2017 all of which was accomplished by Frith and Associates, Civil Engineering and Land Planning; and Whereas, the total site area is 24.79 acres of which 9.67 acres are upland and 15.12 acres are wetland of which 3.45 acres of wetlands are proposed to be impacted; and Whereas, the City's Planning and Development Services Department has conducted a thorough review and analysis of the demands upon public facilities and recommended that the subject rezoning application be approved having determined that the proposal is technically sufficient and consistent with the goals, policies and objectives of the Comprehensive Plan of the City of Sanford, the Land Development Regulations of the City of Sanford, and the controlling provisions of State law; and Whereas, the City staff recommended approval of this Ordinance subject to normative development, detailed development requirements and conditions some of which, if not later resolved, shall be subject to resolution by the Planning and Zoning Commission; and Whereas, on June 15, 2017 the Planning and Zoning Commission 2 1 P a g,e recommended that the City Commission approve the rezoning, request and, recommended that such approval be subject to numerous conditions; and Whereas, the City Commission has determined that the proposed rezoning of the subject property as set forth in this Ordinance is consistent with the Comprehensive Plan of the City of Sanford, the Land Development Regulations of the City of Sanford, and the controlling provisions of State law; and Whereas, the City Commission of the City of Sanford, Florida has taken all actions relating to the PD rezoning action set forth herein in accordance with the requirements and procedures mandated by State law. Now, therefore, be in enacted by the People of the City of Sanford, Florida. Section 1. Legislative findings and intent. (a). The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to the application relating to the proposed rezoning of the subject property as well as the recitals (whereas clauses) to this Ordinance. (b). The approval set forth in this Ordinance is subject to the specific conditions that are set forth subsequently in this Ordinance and the Property Owner has agreed that no requirement herein lacks an essential nexus to a legitimate public purpose and is not roughly proportionate to the impacts of the proposed use that the City seeks to avoid, minimize, or mitigate. (c). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. (d). This Ordinance is consistent with the goals, objectives and policies of the 31I' a! L Comprehensive Plan of the City of Sanford. Section 2. Rezoning of real propertylimplementing actions; Lake Mary Townhomes PD. (a), Upon enactment of this Ordinance the property, as depicted in the map attached to this Ordinance shall be rezoned from the Lake Mary Townhomes PD classification to the Lake Mary Townhomes PD (as revised) zoning classification consistent with the provisions of this Ordinance. (b). The City Manager, or designee, is hereby authorized to execute any documents necessary to formalize approval of the rezoning action taken herein with regard to the Lake Mary Townhomes PD and to revise and amend the Official Zoning Map or Maps of the City of Sanford as may be appropriate to accomplish the action taken in this Ordinance and as set forth herein. (c). The conditions to be incorporated into the pertinent development order relating to the action taken in this Ordinance include the following: (1). Pursuant to Section 4.3.G of the Land Development Code of the City of Sanford (Land Development Regulations), this rezoning shall expire 3 years from the effective date of this Ordinance if all improvements have not been completed or an extension granted. (2). All development shall be consistent with the Lake Mary Townhomes PD Master Plan, dated as received by the City on April 17, 2017, unless otherwise specifically set forth any associated development order; provided, however, that all subsequent development orders shall be consistent with the provisions of this Ordinance. (3). All land use activities conducted on PD property shall be in accordance with 4 1 P a g e Schedule "E" — Design Standards, of the City's Land Development Regulations, unless otherwise specifically designated on the Lake Mary Townhomes PD Master Plan; provided, however, that recreational/boat/etc. vessel/vehicle parking shall be offsite and such parking is prohibited on site. (4). The townhome PD project shall meet all the requirements of the City's Land Development Regulations. (5). The townhome PD project shall meet all the requirements of Schedule "U" — Lake Mary Boulevard Gateway Corridor Overlay District, of the City's Land Development Regulations. (6). A minimum 1-year lease shall be required if the units are to be leased unless it is determined by the City Attorney that such requirement is not consistent with controlling law. (7). Architectural/Dimensional shingles shall be required on all buildings (roofs); (8). There shall be no building permits issued for vertical construction (residences nor community amenities) until all site improvements are completed and all water lines are approved by the Florida Department of Environmental Protection; provided, however, that the provisions of Section 166.033, Florida Statutes, shall be adhered to. (9). A homeowners association shall be required and created in a manner as approved by the City which shall be obligated to maintain any and all walls installed in conjunction with the townhome PD project and any outside area between a wall and adjacent property lines; (10). A dog walk area with waste collection receptacles shall be provided within 5 1 P a g,e the townhome PD project community as approved by the City. (11). A comprehensive signage program meeting the standards of the sign regulations as set forth in the City's Land Development Regulations is required. (12). The final design and location of all driveways and access points shall be determined by City staff during the development plan review process. (13). Unless otherwise specified on the Lake Mary Townhomes PD Master Plan, all development shall comply with setback and buffer requirements set forth in Schedule "J", Landscape, Buffer and Tree Requirements, of the City's Land Development Regulations. (14). Any development within a wellfield protection zone shall comply with the applicable City, State and Federal regulations and land use restrictions including Schedule "M" and Schedule "P", of the City's Land Development Regulations, to ensure the City's potable water supply is protected; provided, however, that the provisions of Section 166.033, Florida Statutes, shall be adhered to. (15). Any development on land that is considered environmentally sensitive under controlling law or delineated as wetlands by an agency with jurisdiction shall be mitigated as required by jurisdictional requirements under controlling law; provided, however, that the provisions of Section 166.033, Florida Statutes, shall be adhered to. (16). A preliminary subdivision plan and subdivision improvement plan shall be submitted and subject to approval by the City with all construction activity being subject to approval by the City prior to any use or development of the subject PD project property. (17). A school capacity availability letter of determination issued by the Seminole County School District shall be provided by the Property Owner to the City prior to the 6 1 P recording of the final plat. (18). A subdivision plat shall be reviewed, approved and recorded, in accordance with the provisions of Chapter 177, Florida Statutes, prior to the issuance of any certificates of occupancy. (19). The Property Owner shall install a decorative and functional fountain in all wet retention ponds as part of the PD project development approval process which approval shall provide for ongoing maintenance requirements and responsibilities upon the homeowners association with the City having no obligation relating thereto, but having the right to enforce such requirement including, but not limited to, taking action to ensure functionality and imposing special assessments relating thereto. (20). The following design elements will be considered during the development plan review: (a). Site improvements occurring on the PD property may include the incorporation of low impact development (oftentimes referred to as "LID")techniques and crime prevention through environmental design (oftentimes referred to as "CPTED") guidelines. (b). Elements of buildings may be constructed incorporating Leadership in Energy and Environmental Design (oftentimes referred to as "LEED"), Florida Green, or such other equivalent energy savings standards as may be approved by the City. (c). Unless specifically requested and approved on the PD Master Plan, any required elements missing from or not shown on the PD Master Plan shall comply with the City's Land Development Regulations. (21). The resolution of all disputes arising from development under the Lake 7 1 P a a e Mary Townhomes PD shall be resolved by the Planning and Zoning Commission unless otherwise specifically provided by controlling law. Section 3. Incorporation of map and PD Master Plan for Lake Mary Townhomes PD. The map attached to this Ordinance is hereby ratified and affirmed and incorporated into this Ordinance as a substantive part of this Ordinance establishing the Lake Mary Townhomes PD. Section 4. Conflicts. All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed including, but not limited to, the provisions of Ordinance Number 3909. Section 5. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 6. Non-codification; Implementation. (a). This Ordinance shall be not be codified in the City Code of the City of Sanford or the Land Development Code of the City of Sanford (Land Development Regulations); provided, however, that the actions taken herein shall be depicted on the zoning maps of the City of Sanford by the City Manager, or designee. (b). The City Manager, or designee, shall implement the provisions of this Ordinance by means of a non-statutory development agreement which shall be executed 8 1 P a a e by the Property Owner within 60 days of the effective date of this Ordinance or the subject property's zoning classification shall revert to an un-zoned property status. Lake Mary Boulevard, is being submitted for second reading and adoption. The property owner is First American Land Trust Company,LLC.The applicant is Jamie Jimenez, attorney of fact for First American Land Trust Company, LLC. Firth and Associates, Civil Engineering and Land Planning, accomplished the Citizens Awareness Participation Plan on February 8, 2017 and is attached. The Affidavit of Ownership and Designation of Agent form is attached and other information is available in order to ensure that all potential conflicts of interests are capable of being discerned. FISCAL/STAFFING STATEMENT: Based on the Seminole County Property Appraiser 2016 property tax roll,the existing vacant 24.79 acre property to be rezoned has an assessed value of$176,640 and a total tax bill of$3,541. No additional staffing or City resources are required if the subject property is rezoned. Page 1 of 6 t BACKGROUND: Pursuant Article IV, Section 4.3, G, a Planned Development Project shall expire three (3) years from the effective date of the approval and all work must be completed within the three-year time frame. The property was rezoned PD, Planned Development by Ordinance No. 3909 and associated Development Order 04-0043 including the Lake Mary Complex PD Master Plan,which was adopted on January 24, 2005. All approved uses and conditions associated with this PD have expired and a new PD Master Plan needs to be established. The subject property has been given a project address of 1160 W. Lake Mary Boulevard. The site is located on the northeast corner of West Lake Mary Boulevard and Sterling Pine Street. The site totals approximately 24.79 acres and runs from West Lake Mary Boulevard north along Sterling Pine Street. The property owner has submitted a request to establish a new PD Master Plan. The new Master Plan depicts a townhome development with approximately 104 dwelling units. The actual number of units will depend on verification of the wetland line and the architectural design. It is proposed to have 13, 2 story townhouse buildings with 8 units per townhouse building. The future land use designation on the northern developable portion of the site is MDR-10 (Medium Density Residential-10 dwelling units/acre).The southern developable portion of the site has a future land use designation of MDR-15 (Medium Density Residential-15 dwelling units/acre). The overall proposed density of 4.2 units per acre does not exceed the maximum density allowed. The townhome project is proposed to meet all of Schedule E Design standards, Section 18.0, Townhouse Standards with the exception of the required recreational/boat vehicle parking which will be off-site and not allowed on the project site. The total site area is 24.79 acres of which 9.67 acres are upland and 15.12 acres are wetland and of which 3.45 acres of wetlands are proposed to be impacted. Per the preliminary subsurface soil and groundwater investigation report the south part of the site is somewhat open with low underbrush and scattered pines. A natural wetland system occupies the majority of the north and east part of the property. A smaller wetland type area exists along the power easement where it enters the west property line along Sterling Pine Street. A wetland/slough area occupies the north and east part of the property. The site elevations range from about 46 feet near Lake Mary Boulevard to about 38 feet along the wetland in the north. Bio- Tech Consulting, Inc. conducted an environmental assessment of the proposed property in March, 2017. The evaluation includes a review of any species listed by FFWCC and/or USFWS, habitat, and a review for the occurrence of protected species of flora and fauna through direct and indirect observations. No plant species listed by either the Florida Department of Agriculture (FDA) or U.S. Fish and Wildlife Service (USFWS) was identified on the site during the assessment conducted. However, two (2) species were identified that are listed as "commercially exploited" by the Florida Page 2 of 6 Department of Agriculture and Consumer Services (FDACS). The listing of these species poses no restriction towards the development of the property. Wildlife species were identified during the evaluation of the site,however,none of the wildlife species are identified in the FFWCC's Official Lists—Florida's Endangered Species, Threatened Species and Species of Special Concern. The request to Amend the Planned Development Zoning was continued at the June 1, 2017 Planning and Zoning Commission meeting to June 15, 2017. The Planning and Zoning Commission approved the request to amend the Lake Mary Townhomes PD at 1160 W.Lake Mary Boulevard as recommended by staff, subject to a Development Order that includes all recommended conditions. The City Commission approved the first reading of Ordinance No. 4410 on June 26, 2017. The City Clerk published notice of the public hearing in the Sanford Herald on June 25, 2017. LEGAL REVIEW: The City Attorney has reviewed the Staff report and has noted the following: Section 166.033, Florida Statutes,provides as follows (please note emphasized text): "(1) When reviewing an application for a development permit that is certified by a professional listed in s. 403.0877, a municipality may not request additional information from the applicant more than three times,unless the applicant waives the limitation in writing.Before a third request for additional information,the applicant must be offered a meeting to attempt to resolve outstanding issues. Except as provided in subsection(4), if the applicant believes the request for additional information is not authorized by ordinance, rule, statute, or other legal authority, the municipality, at the applicant's request, shall proceed to process the application for approval or denial. (2) When a municipality denies an application for a development permit,the municipality shall give written notice to the applicant. The notice must include a citation to the applicable portions of an ordinance,rule,statute,or other legal authority for the denial of the permit. (3) As used in this section, the term "development permit" has the same meaning as in s. 163.3164, but does not include building permits. (4) For any development permit application filed with the municipality after July 1, 2012, a municipality may not require as a condition of processing or issuing a development permit that an applicant obtain a permit or approval from any state or federal agency unless the agency has issued a final agency action that denies the federal or state permit before the municipal action on the local development permit. (5) Issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. A municipality shall attach such a disclaimer to the issuance of development permits and shall include a permit Page 3 of 6 condition that all other applicable state or federal permits be obtained before commencement of the development. (6) This section does not prohibit a municipality from providing information to an applicant regarding what other state or federal permits may apply." The above-referenced definition of the term"development permit" is as follows: "(16) 'Development permit' includes any building permit, zoning permit, subdivision approval, rezoning, certification, special exception, variance, or any other official action of local government having the effect of permitting the development of land." (Section 163.3164(16),Florida Statutes). Thus, if this application is denied, a denial development order must be issued which must cite to the applicable portions of each ordinance, rule, statute, or other legal authority supporting the denial of the application. For example,if a goal,objective or policy of the Sanford Comprehensive Plan were to be the basis for a denial,then such goal,objective or policy must be part of the motion proposing the denial. A denial development order would be drafted to implement the actions of the Planning and Zoning Commission in the event of such occurrence. Accordingly, any motion to deny must state, with particularity,the basis for the proposed denial. The term "development order" is defined as follows and, as can be seen, refers to the "granting, denying, or granting with conditions [ofJ an application" "(15) `Development order' means any order granting, denying, or granting with conditions an application for a development permit." (Section 163.3164(15), Florida Statutes). RECOMMENDATION: The Planning and Zoning Commission, along with Staff, recommends that the City Commission approve the proposed amendment to the Lake Mary Townhomes PD at 1160 W. Lake Mary Boulevard, subject to a development order with the following conditions: 1. (BTC) conducted an environmental assessment of the approximately 24.52-acre Lake Mary Property. This site is located in the northeast quadrant of the intersection of W. Lake Mary Boulevard and Sterling Pine Street, approximately 1.0 mile west of US-17 South; within Section 10, Township 20 South, Range 30 East in Seminole County, Florida (Figures 1, 2 & 3). The on-site evaluation included " + a review of any species listed by FFWCC and/or USFWS, habitat, and a review for the occurrence of protected species of flora and fauna through direct r " A e'w• and indirect observations. PROTECTED SPECIES •, A Using methodologies outlined in the Florida's Fragile Wildlife (Wood, 2001); Measuring and Monitoring Biological Diversity Standard Methods for Mammals (Wilson, et al., 1996); Wildlife Methodology Guidelines (1988); and Florida Fish and Wildlife Conservation Commission's Gopher Tortoise Permitting Guidelines (revised January 2017); an assessment for"listed" floral A " and faunal species was conducted at the site on March 16, 2017. The harvesting of these species, royal fern (Osumunda regalis) and cinnamon fern (Osmunda cinnamomea) for commercial gain is not allowed. However, the listing of these species poses no restrictions towards the development of the subject property. The following provides a brief description of applicable species as they relate to development of the property. -deell ConsultingC. cntal .end Permitting Services Darren Sowell;Darren Sowell Architecture,LLC Lake Mary Property-Seminole County, Florida (BTC File#215-233) Wildlife Survey Page 3 of 5 Bald Eagle(Haliaeetus leucocephalus) State protected by F.A.C. 68A-16.002 and federally protected by both the Migratory Bird Treaty Act (1918) and the Bald and Golden Eagle Protection Act(1940) In August of 2007, the US Fish and Wildlife Service (USFWS) removed the Bald Eagle from the list of federally endangered and threatened species. Additionally, the Bald Eagle was removed from FFWCC's imperiled species list in April of 2008. Although the Bald Eagle is no longer protected under the Endangered Species Act, it is still protected under the Bald and Golden Eagle Protection Act, the Migratory Bird Treaty Act, and FFWCC's Bald Eagle rule (Florida Administrative Code 68A-16.002 Bald Eagle (Haliaeetus leuchocephalus). In May of 2007, the USFWS issued the National Bald Eagle Management Guidelines. In April of 2008, the FFWCC adopted a new Bald Eagle Management Plan that was written to closely follow the federal guidelines. Under FFWCC's new management plans, buffer zones are recommended based on the nature and magnitude of the project or activity. The recommended protective buffer zone is 660 feet or less from the nest tree, depending on what activities or structures are already near the nest. A FFWCC Eagle permit is not needed for any activity occurring outside of the 660-foot buffer zone. No activities are permitted within 330 feet of a nest during the nesting season, October 1 through May 15 or when eagles are present at the nest. In addition to the on-site review for listed species, BTC conducted a review of the FFWCC's recorded Bald Eagle (Haliaeetus leucocephalus) nest sites on or in the vicinity of the subject property. Based on FWC's most currnet survey data (i.e., 2014) for Seminole County, this review revealed one (1) recorded Bald Eagle nest located within one (1) mile of the project site (see attached). Bald Eagle nest SE039 is 0.77 miles northeast of the project site and was last known active in 2014. This nest is located outside of the 660 foot buffer and as such, there is no further action pertaining to Bald Eagles and the subject property. USFWS Consultation Areas The U.S. Fish and Wildlife Service has established "consultation areas" for certain listed species. Generally, these consultation areas only become an issue if USFWS consultation is required, which is usually associated with permitting through the U.S. Army Corps of Engineers. The reader should be aware that species presence and need for additional review are often determined to be unnecessary early in the permit review process due to lack of appropriate habitat or other conditions. However, the USFWS makes the final determination. Consultation areas are typically very regional in size, often spanning multiple counties where the species in question is known to exist. Consultation areas by themselves do not indicate the presence of a listed species. They only indicate an area where there is a potential for a listed species to occur and that additional review might be ne ssary to confirm or rule-out the io-Tech Consulting Inc. The additional review typically includes the application of species- specific criteria to rule-out or confirm the presence of the species in question. Such criteria might consist of a simple review for critical habitat types. In other cases, the review might include the need for species-specific surveys using established methodologies that have been approved by the USFWS. The following paragraphs include a list of the USFWS Consultations Areas associated with the subject site. Also included, is a brief description of the respective species habitat and potential for additional review: Everglade Snail Kite (Rostrhamus sociabilis plumbeus) Federally Listed as "Endangered" The subject site falls within the USFWS Consultation Area for the Snail Kite. Currently the Snail Kite is listed as "Endangered" by the USFWS. Snail Kites are similar in size to Red- shouldered Hawks. All Snail Kites have deep red eyes and a white rump patch. Males are slate gray, and females and juveniles vary in amounts of white, light brown, and dark brown, but the females always have white on their chin. Kites vocalize mainly during courtship and nesting. They may occur in nearly all of the wetlands of central and southern Florida. They regularly occur in lake shallows along the shores and islands of many major lakes, including Lakes Okeechobee, Kissimmee, Tohopekaliga (Toho) and East Toho. They also regularly occur in the expansive marshes of southern Florida such as Water Conservation Areas 1, 2, and 3, Everglades National Park,the upper St. John's River marshes and Grassy Waters Preserve. Although the subject site falls within the USFWS Everglade Snail Kites consultation area, no Everglade Snail Kites were observed within the subject site during the wildlife survey conducted by BTC. As there is no habitat within the limits of the subject property, it is not anticipated that a formal survey would be required by the USFWS or another agency to determine if any Everglade Snail Kites utilize any portions of the site. Florida Scrub-Jay(Aphelocoma coerulescens) Federally Listed as "Threatened" The subject site falls within the USFWS Consultation Area for the Florida Scrub-Jay. Currently the Florida Scrub-Jay is listed as "Threatened" by the USFWS. Florida Scrub Jays are largely restricted to scattered, often small and isolated patches of sand pine scrub, xeric oak, scrubby flatwoods, and scrubby coastal stands in peninsular Florida (Woolfenden 1978a, Fitzpatrick et al. 1991). They avoid wetlands and forests, including canopied sand pine stands. Optimal Scrub- Jay habitat is dominated by shrubby scrub, live oaks, myrtle oaks, or scrub oaks from 1 to 3 m (3 to 10 ft.) tall, covering 50 to 90 % the area; bare ground or s arse vegetation less than 15 cm (6 BBio-Tech Consullinu Inc. l nvirorinwnral and Permirrint Servives Darren Sowell;Darren Sowell Architecture,LLC Lake Mary Property,-Seminole County, Florida(BTC File#215-233) Wildlife Survey Page 5 of 5 in) tall covering 10 to 50% of the area; and scattered trees with no more than 20% canopy cover (Fitzpatrick et al. 1991). No Florida Scrub-Jays were observed within the subject site during the wildlife survey conducted by BTC. As there is no habitat within the limits of the subject property, it is not anticipated that a formal survey would be required by the USFWS or another agency to determine if any Florida Scrub-Jays utilize any portions of the site. The environmental limitations described in this document are based on observations and technical information available on the date of the on-site evaluation. This report is for general planning purposes only. The limits of any on-site wetlands/surface waters can only be determined and verified through field delineation and/or on-site review by the pertinent regulatory agencies. The wildlife surveys conducted within the subject property boundaries do not preclude the potential for any listed species, as noted on Table 1 (attached), currently or in the future.
