Continuation of Third reading of Ordinance No. 4434, providing new provisions to the City's Land Development Regulations pertaining to medical marijuana facilities /pharmacies /drug stores in conformity with State law; Ad published January 28, 2018. [Commission Memo 18 -039] Erica O'Conner, resident of Seminole County thanked the Commission for supporting the Ordinance. Commissioner Austin moved to adopt Ordinance No. 4434. Herrin and Sharman and Allen Green, owners; Ad published February 11, 2018. [Commission Memo 18-041] Commissioner Woodruff moved to approve Ordinance No. 4440 on first reading. First reading of Ordinance No. 4441, to rezone 19.26 acres of property at 200 S. White Cedar Road from AG, Agriculture to PD, Planned Development to establish The Towns at White Cedar PD, a 155 unit tQwnhome community, Owners: Joseph E. Andrews III; Joseph E. Andrews, Jr; Jeanette Andrews; William L Jones; and Delores J. Pickens; Ad published February 25, 2018. [Commission Memo 18 -042] Attorney Steve Coover, representing the applicant, MI Homes said that there is an existing industrial development to the west and south of this property. The development is loud and the applicant recognizes that. However, due to the noise factor, the local businesses are opposed to the development as they feel it could negatively affect their business. In summary, Mr. Coover said that the City's Comprehensive Plan requires mixed use in this area and the applicant is working with City staff to achieve that goal. Chad Moorhead, representing Madden, Moorhead & Stokes, Inc. said that a buffer CITY COMMISSION MINUTES FEBRUARY 26, 2018 REGULAR MEETING will be installed that includes eastern red cedar trees and a six foot PVC fence. A sidewalk will be installed up to SR 46 for students in the area. Commissioner Mahany expressed her dislike for PVC material when considering a fence. Dave Brown, MI Homes Director of Land Entitlements and Development, said that will be taken under advisement. Mr. Brown said that in regards to the property, noise was a concern of MI Homes as well, which is why they focused on the orientation of the buildings. Commissioner Woodruff said that he appreciates the town homes being moved further in that were along the industrial side but he would like to see that done on the other side as well (along the pond). Several business owners in the area spoke against the project. Vice Mayor Williams asked Russ Gibson, Director of Planning & Development Services if this rezone is compatible with the City's Comprehensive Plan. He explained the Planning & Zoning Commission determined that it was not compatible at the February I` hearing. Vice Mayor Williams also asked if the Comprehensive Plan allows for housing in this particular location. Mr. Gibson said that it is zoned as WIC (Westside Industry & Commerce) which allows for housing as long as it meets specific design standards. Commissioner Woodruff commented that he has concerns about the road (narrow) and Mr. Gibson said that is something that will be addressed in the engineering plan. Several residents who live in the area spoke and said that they have no concerns with noise. Mr. Coover said that the issue brought forward tonight is that this project is allowed by the City's Comprehensive Plan with conditions. Commissioner Austin moved to approve Ordinance No. 4441 on first reading. Vice Mayor Williams passed the gavel to Commissioner Mahany and seconded the motion which carried by vote of the Commission as follows: Vice Mayor Williams Aye Commissioner Woodruff Aye Commissioner Austin Aye Commissioner Mahany Aye The gavel was returned to Vice Mayor Williams after the vote. Award Bid #IFB 16/17 -09 to Stage Door II, Inc., in the amount of $775,020; and approve associated budget amendment Resolution No. 2711, in the amount of $60,000, for the Oak Avenue Streetscape Project. Appointment of City Clerk's replacement. Commissioner Woodruff moved to appoint Traci Houchin as Acting City Clerk. Award bid #IFB 17/18-1 OR to Gomez; approve the implementing procurement activities in an amount not to exceed $3,080,944.24; and budget amendment Resolution No. 2714. She is looking forward to retirement. The Commission presented Ms. Porter a certificate for 30 years of service, a clock and flowers. 11) CITY MANAGER'S REPORT Mr. Bonaparte thanked Ms. Porter for her years of service. 12) CITIZEN PARTICIPATION 13) CITY COMMISSIONER'S REPORTS CITY COMMISSION MINUTES FEBRUARY 269 2018 REGULAR MEETING Commissioner Woodruff said that on March 10,° 2018, the Hopper Academy will open its doors from 11 - 1 for a preview and invited everyone to attend.
