Clazififcatiow Question: Section 1.1 Specifications B. Ask for leases to be quoted at 2000 miles a month. Can the County provide Historical data on the units in service to support that vehicles are traveling 24,000 miles a year, (E.g. a list with in-service dates and current mileage)? Answer: The County of Volusia completed a sample based on 1 month of service with 4 vehicles and the result is an average monthly mileage.of 2116.25 miles. Question: Section 2.46 Damages to Rental Equipment "Rental Bidders also agree that the County shall have no obligation for payment of damages of any nature to equipment provided with or without an operator unless clear and convincing evidence demonstrates that gross negligence of either the County or its employees acting within the scope of their employment was the direct cause of such damages or destruction." Does the above paragraph pertain to Leasing Companies and Leased vehicles? If so is the County requesting that physical damage coverage be included in the monthly rate? Answer: Section 2.46 is not requesting additional insurance coverage for the County of Volusia, but instead requires that the awarded vendor insure itself against risk of loss in so far as the County of Volusia will not be responsible for damages to rental equipment except as otherwise set forth in section 2.46. Question: It is our intent to work with Volusia County to arrive at a mutually beneficial solution regarding all contracts and agreements. We use a trust as the Lessor in the Asset-backed securitization (ABS) market and due to this certain terms and conditions that obligate the trust may prohibit entering this market. Can we come to mutually agreed upon replacement language regarding the order of precedence and other terms and conditions prior to Submission and/or Award? Answer: The County's terms and conditions shall prevail. Page i of 2 14-B-101 VO Question: Regarding the General Conditions and Instructions and Section 2.15 - The trust borrows its money in the Asset-backed securitization (ABS) market, which is the best market for a leasing business to obtain its debt. Without a Trust as the Lessor, it would not be possible to enter this debt market. Due to the Asset-backed securitization (ABS) market, financial assignment will take place. We will provide written notification in the event of a non-financial assignment. Will the County allow for financial assignment without notice and/or any fees? Answer: Assignment of the contract shall not be permitted except as otherwise set forth in section 2.15. Please sign and attach this addendum to your bid submittal.
