4461 Comp Plan AmdmtOrdinance No. 2018-4461 An ordinance of the City of Sanford, Florida relating to the City's comprehensive planning program; enacting substantial and comprehensive amendments to the City's Comprehensive Plan to, among other things, ensure consistency with the Community Planning Act as set forth in the Florida Statutes; providing for the enactment of the Comprehensive Plan 2018-2030 containing a wide variety of goals, objectives and policies with regard to all required and other desirable planning subjects and matters; providing for exhibits; providing for implementing administrative actions such as transmittal to the Florida Department of Economic Opportunity and other agencies of government; providing for severability; providing for conflicts/ratification of prior actions; providing for instructions relative to codification and providing for an effective date. Whereas, the City of Sanford is committed to planning and managing the future growth and development of the City; and Whereas, pursuant to Section 163.3191, Florida Statutes, the City timely prepared an evaluation and appraisal notification letter and transmitted said letter to the Department of Economic Opportunity; and Whereas, the City of Sanford determined amendments to all of its Comprehensive Plan are necessary to reflect changes in state requirements; and Whereas, pursuant to Section 163.3191(2), Florida Statutes, the City of Sanford is required to transmit within one (1) year such amendment or amendments for review pursuant to Section 163.3184, Florida Statutes; and Whereas, the City of Sanford Planning and Zoning Commission has held a public hearing on June 7, 2018 to receive public input and comment on the proposed amendments to the Comprehensive Plan; and Whereas, the City Commission has held a transmittal public hearing on July 9, 2018, to receive public input and comment on the proposed amendments to the Comprehensive Plan; and Whereas, the City Commission has held an adoption public hearing on 2018, to receive public input and comment on the proposed amendments to the Comprehensive Plan; and Whereas, pursuant to Chapter 163, Part II, Florida Statutes, the City Commission accepted the proposed Comprehensive Plan amendments and authorize their transmittal to the Florida Department of Economic Opportunity and other agencies as required by controlling State law; and Whereas, the City of Sanford has complied with all requirements and procedures of controlling Florida law in processing this amendment to the Comprehensive Plan including, but not limited to, Section 163.3187, Florida Statutes; rare Whereas, the City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to the application relating to the proposed amendments to the Comprehensive Plan; and Whereas, the Exhibits to this Ordinance are incorporated herein as if fully set forth herein verbatim; and Whereas, the City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance; and Whereas, this Ordinance is internally consistent with the goals, objectives and policies of the Comprehensive Plan. Now, therefore, be in enacted by the People of the City of Sanford, Florida. Section 1. Legislative findings and intent. (a). The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to this Ordinance as well as the recitals (whereas clauses) to this Ordinance. (b). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. Section 2. Adoption of Amended Comprehensive Plan (Comprehensive Plan 2018-2030). The package of amendments to the Comprehensive Plan, attached in the Exhibits to this Ordinance, are hereby enacted as the City's Comprehensive Plan 2018- 2030. Section 3. Implementing actions. (a). The City Manager, or designee, is hereby authorized to transmit copies of the adopted amendment to the Comprehensive Plan (Comprehensive Plan 2018-2030) to the appropriate agencies in accordance with the provisions of Section 163.3184, Florida Statutes. (b). The City Manager and the City Attorney are hereby authorized to take any and all necessary actions to defend the transmittal, potential enactment and implementation of this Ordinance and assert the legal compliance status of this Ordinance. (c). The City Manager shall ensure that City staff makes the documents associated with this Ordinance widely available to the public. Section 4. Severability. If any section, sentence, phrase, word, or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity or effect of any other action or part of this Ordinance. Section 5. Conflicts/ratification of prior actions. (a). All ordinances or parts of ordinances in conflict herewith are hereby repealed. (b). The City of Sanford hereby ratifies and affirms that action taken by the City Commission and the City as a whole to date relative to the comprehensive planning programs action activities of the City. The applicability and effect of the City of Sanford Comprehensive Plan are hereby ratified and shall remain in full force and effect consistent with the provisions of this Ordinance. Section 6. Codification; instructions to Code Codifier. This Ordinance shall be codified in such manner as the Code Codified deems appropriate in accordance with the provisions of Section 1-10 of the City Code. Section 7. Effective date. The effective date of this plan amendment, if the amendment is not timely challenged, shall be 31 days after the State Land Planning Agency (the Florida Department of Economic Opportunity) notifies the local government that the plan amendment package is complete. If timely challenged, this amendment shall become effective on the date the State Land Planning Agency or the Administration Commission enters a final order determining this adopted amendment to be in compliance. No development orders, development permits, or land uses dependent on this amendment may be issued or commence before it has become effective. Passed and adopted this 12th day of November, 2018. Bonaparte, Jr., City Manager SUBJECT: Adopt Comprehensive Plan Amendments Evaluation Appraisal Report STRATEGIC PRIORITIES: ® Unify Downtown & the Waterfront ® Promote the City's Distinct Culture ® Update Regulatory Framework Redevelop and Revitalize Disadvantaged Communities SYNOPSIS: Ordinance No. 4461 provides for adoption of the City's Comprehensive Plan Amendments and Evaluation and Appraisal Report. FISCAL/STAFFING STATEMENT: No additional staffing is anticipated if the Future Land Use amendment is approved. BACKGROUND: Large Scale Comprehensive Plan Amendments and Evaluation and Appraisal Report Pursuant to Chapter 163.3191 Florida Statutes, every seven (7) years, local governments must evaluate their Comprehensive Planning document to ensure that it reflects current State law. This evaluation (known as the Evaluation and Appraisal Report, or EAR), is also used to determine how well the plan is meeting local needs. The last time the City of Sanford Comprehensive Plan underwent a complete update was in 2009. It is now time for the City to assess the changes that have occurred since 2009 and update its Comprehensive Plan to set the course for the planning horizon of 2030. On October 16, 2016, the City sent a letter to the State DEO office identifying the City's intent to update its Comprehensive Plan through the Evaluation and Appraisal Review process. This action met the deadline of November 1, 2017 for notification as set by DEO. By initiating the process, the City must transmit the Comprehensive Plan update package by May 24, 2017. The Comprehensive Plan's new planning horizon will be 2030. The City hired consultants Poulos and Bennet and were tasked with evaluating and providing recommended updates to the City of Sanford's Comprehensive Plan. The consultant interviewed City Staff, conducted workshops with the Planning & Zoning Commission and City Commission involved various stakeholders such as the City of Sanford Chamber of Commerce, Ashville Group, Goldsboro Choice Neighborhood Initiative, City of Sanford Residents and Business owners, Mayor's Youth Council and visitors to the City of Sanford. The process also included an extensive public input initiative with a Public Input Workshop on January 24, 2018 with approximately 36 attendees, the Mayor's Youth Council held on February 13, 2018 and a Community Survey conducted between December 2017 and January 2018 that had 23 questions and yielded 549 responses. The updated City of Sanford Comprehensive Plan has been organized into two Volumes. Each volume is broken into a series of Sections and Chapter in order to provide a thoughtful organization to content by theme, thereby reducing redundancies and making the overall document easier to use by multiple audiences. Volume I, contains the Goals, Objectives & Policies of the Comprehensive Plan as serves as the regulatory Volume of Comprehensive Plan series. The volume also provides background and intent for the overall document itself, as well as each section of the document in order to foster greater understanding of the Policies contained, as well as to enhance regulatory support for the document. Volume II serves to provide both analysis and documentation to support Volume I of the Comprehensive Plan and to evaluate other factors that will contribute or serve as a barrier to the City of Sanford's successful growth. Instead of being organized into traditional elements, Volume II has been organized into cohesive themes, similar to Volume I, in order to avoid duplicative information and to more successfully evaluate certain criteria that might be otherwise be separated into distinct elements. On June 7, 2018 the Planning and Zoning Commission recommended to transmit the proposed Comprehensive Plan amendments and associated Amendments of the City of Sanford Water Supply Facilities Work Plan based on the Evaluation and Appraisal Report to the State Department of Economic Opportunity (DEO) and the St. Johns River Water Management District. The City Commission held a public hearing on July 9, 2018 for transmittal of the proposed Comprehensive Plan amendments and associated Amendments of the City of Sanford Water Supply Facilities Work Plan based on the Evaluation and Appraisal Report for transmittal to the State Department of Economic Opportunity (DEO) and the St. Johns River Water Management District. Both the EAR matrix and updated Comprehensive Plan were reviewed by numerous state agencies with DEO providing and Objections, Recommendations and Comments (ORC Report) on September 18, 2018. The following are the agency comments that were received: Florida Department of Economic Opportunity Department does not identify any objections or j comments to the proposed amendment. I The proposed EAR -based text amen— d increases the maximum allowable floor area ratio Florida Department of Transportation for the General Commercial FLU, and has the potential to result in adverse impacts to the State j Highway System (SHS) and the Strategic Intermodal System (SIS). St. Johns River Water Management District No comments on the proposed amendment. Florida Department of Environmental Department found no provision that, if adopted Protection would result in adverse impacts to important state resources subiect to the Department's jurisdiction. In response to the Florida Department of Transportation comment a new as shown below, footnote (5) has been added under Table FLU -I on Page II -5 of Volume I. In addition, it is also supported by existing Policy FLU 1.1.1, which requires compliance with the City's Concurrency Management System (CMS). (5) Densities/intensities are subject to compliance with the City's ConcurrencManagement System(CMS) See Policies FLU 1.1.9 and M 1.1.6). Where located within designated Transportation Concurrence Exception Areas (TCEA), developments shall meet the criteria outlined therein in order to achieve desire densities/intensities (Objective FLU 2.3 and M 1.2). LEGAL REVIEW: This matter has been reviewed by the Assistant City Attorney. RECOMMENDATION: Staff recommends the City Commission adopt Ordinance No. 4461 on second reading and the City's Comprehensive Plan Amendments and Evaluation and Appraisal Report. Additional comments or recommendations may be presented by staff at the meeting.
