Victim J ma W601 s March 21, 2019 From Date Seminole County Law Enforcement and The Victim Service The purpose of this Memorandum of Understanding is to coordinate victim advocacy and cnsls- intervention services for adult victims of sexual assault in Seminole County through cooperation, collaboration, and sharing of appropriate information by agencies within thisjurisdiction. Specifically, this agreement establishes operational protocols for the investigation of adult sexual assaults to include the sexual assault examinations (for both criminal reporting and without a report), victim advocacy, crisis intervention services, hotline reports and counseling services. The parties herein agree to the following principals and guidelines: The Victim Service Center of Central Florida and Seminole County law enforcement (Altamonte Springs, Police Department, Casselbeny Police Department, Lake Mary Police Department, Longwood Police Department, Oviedo Police Department, Sanford Airport Police Department, Sanford Police Department, Seminole County Sheriffs Office, and the Winter Springs Police Department) agree that providing an effective victim -centered response is essential to sexual assault victims. The Victim Service Center is a "rape crisis center" as defined in Florida Statute 90.5035 and offers assistance to victims of sexual assault or sexual battery and their families. The Victim service Center of Central Florida and all Seminole County Law Enforcement agree that the services provided to juvenile or intellectually impaired adult victims of sexual assault, child abuse, neglect, abandonment, or any related incident will be provided by Kids House of Seminole. When reported to VSC, such incidents will be handled according to Florida Statue and VSC shall refer cases to the appropriate Seminole County Law Enforcement Agency and/or Kids House of Seminole, whichever is appropriate. Ensure victim advocacy, crisis intervention service, therapy and continuity of care is provided for adult survivors of sexual assault Ensure that all adult survivors of sexual assault have access to the 24 hour sexual assault Hotline (407 -500 -HEAL) that is maintained by the Victim Service Center of Central Florida (VSC) and always answered by a master's level Sexual Assault Counselor Ensure that all adult survivors of sexual assault are assisted in obtaining a forensic sexual examination by a qualified Sexual Assault Nurse Examiner (SANE) within 120 hours of an assault Ensure that all adult survivors of sexual assault are assisted in obtaining access to individualized crisis -intervention and advocacy services from the VSC. Crisis -intervention services means advice, counseling or consultation provided by a Sexual Assault Counselor aimed at reducing the level of emotional trauma experienced by the victim Ensure that all adult survivors of sexual assault are afforded continuity of support throughout the criminal justice process Ensure that all eligible adult survivors of sexual assault are assisted in applying for and receiving sexual battery relocation funds Commitment to effective case review to identify trends, themes, and best practices in the areas of sexual assault response, treatment, intervention, analysis, and prosecution through participation inthe Sexual Assault Response Team (SART) Provide a forum for on-going communication and resolution of issues involving adult sexual assault victims to foster an effective collaboration with involved agencies RESPONSE PROCEDURES (nopolice reaort) Should an adult victim contact the sexual assault Hotline and request a forensic sexual examination but NOT a police report, the VSC Sexual Assault Counselor will make arrangements for the exam to take place at the Seminole County Department of Health (DOH) and will respond accordingly. In addition, a Victim's Advocate from the Seminole County Sheriffs Office (SCSO) will also be contacted by the VSC's Sexual Assault Counselor and be present according to the current contract with DOH. Should it be more convenient for the victim, the option will also be given to have the forensic examination performed at the VSC's Sexual Assault Treatment Center located near Florida Hospital's main campus in Orange County. Under those circumstances, the on-call SCSO Victim's Advocate will meet with the VSC advocate and/or the SANE personnel to take custody of any evidence if the SCSO advocate was not present at the non -reporting forensic exam (the SCSO advocate can be contacted via the SCSO Communications Center by calling 407-665-6650 and requesting the on-call advocate). At no time should any evidence be entered into another law enforcement agency's evidence system if the incident is known to have occurred in Seminole County. The SCSO victim's advocate will create a chain of custody form and complete an information report (CJ1S), however NO victim information, contact information, or privileged communication will be contained within this report. The SCSO Advocate will complete an evidence sign - out form upon retrieval of the evidence and provide the VSC with the CJIS case number fortheir records. In the event a victim decides to have a law enforcement agency within Seminole County investigate the incident (convert a non -reported case to a reported case), the VSC Sexual Assault counselor will provide the victim the contact information for the appropriate law enforcement agency. The victim can then independently contact the appropriate law enforcement agency, with or without the accompaniment of a VSC Sexual Assault Counselor. Ifthe victim contacts the LE agency independently to convert the case from a non -report to a reported case, the VSC Sexual Assault Counselor will confirm a Release of Information form has been obtained in accordance with Florida Statute 90.5035. All juvenile victims (defined as any person less than 18 years of age) and intellectually impaired adults whose functioning capacity is that of a child will be referred to Kids House of Seminole for services. RESPONSE PROCEDURES (with police report) Once Law Enforcement is notified of a sexual assault, the on-call SCSO Victim Advocate will be contacted and respond to the scene. The SCSO Victim Advocate will verbally advise the victim of their statutory right to have a forensic exam and provide them the option to contact (and assist them in contacting) the VSC Sexual Assault Counselor. The SCSO Victim Advocate will also provide the victim with the "Sexual Battery - Your Rights and Services" brochure listing the VSC 24 hour Hotline number and contact information. Should the victim request the presence of a VSC Sexual Assault Counselor, whether during the forensic exam and/or after, the SCSO Victim Advocate will contact the VSC 24 hour sexual assault Hotline and arrange for the VSC Sexual Assault Counselor to meet the victim at a time and location of the victim's choosing. Ifthe victim decides not to have a VSC Sexual Assault Counselor present during the forensic exam, the SCSO Victim Advocate will apprise the victim of VSO's services, including trauma informed crisis counseling. therapy, advocacy and victim relocation compensation assistance. The SCSO Victim's Advocate will accompany the victim to the forensic sexual examination and provide on- going support and assistance throughout the criminal justice process .
