3515ORDINANCE NO. 3515 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3324 AND ITS AMENDMENTS TO AMEND SECTION 23.0 OF THE CITY'S PERSONNEL RULES AND REGULATIONS TO PROVIDE PAY FOR WORK DURING EMERGENCIES OR DISASTERS TO NON-EXEMPT AND EXEMPT EMPLOYEES; PROVIDING FOR SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Sanford, FI0dda, deems it necessary to amend Section 23.0 of the Citys Personnel Rules and Regulations to provide compensation to non- exempt and exempt employees for work dudng emergencies or disasters. NOW, THEREFORE, BE tT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: SECTION 2: SECTION 3: The City Commission adopts statements above as if fully set forth heroin. That the terms of Ordinance No. 3324 are hereby amended. That Ordinance No. 3324 be and same is hereby amended to provide that the revisions to the Personnel Rules and Regulations attached hereto as Exhibit "A' is incorporated herein by reference are hereby adopted. SECTION 4: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. SECTION 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 6: That this ordinance shall be effective upon passage and adoption. ATTEST: " AS~H~~N OF THE CITY OF SANFORD, FLORIDA EXHIBIT A CITY OF SANFORD PERSONNEL RULES & REGULATIONS SECTION 23.0 PAY FOR WORK DURING EMERGENCIES OR DISASTERS 23.1 GENERAL It is the policy to fairly compensate employees when any natural, technological or human- caused emergency or disaster requires an emergency declaration by the City. PROCEDURES A~ City personnel in non-exempt (non-salaried) pay plans who are designated by their Department Directors as essential and who are assigned to work dudng emergencies or disasters, will be compensated for time worked in accordance with the Fair Labor Standards Act (F.L.S.A.) Thcsc crnployccs will receivc full pay for hours worked dudng thc emergency in addition to their normal full day pay for thc work ,~ay or work wcck only in the event that City operations have been closed down due to the disaster and State or Local Emergency has been declared by the City Commission. Overtimc rulcs apply according to thc Fair Labor Standards Act (F.L,S.A.). Employees in a non-exempt (non-salaried) pay plan and considered as non-essential personnel and are not instructed to report to work will not receive pay for the work day but may request leave with pay (vacation, personal absence or comp time) !f they have no paid leave balance available their time will be reflected as "leave without pay". Whcn City opcrations arc dosed down before start of s schcduled workday, employecs normally scheduled to work who arc instructed not to roport to work (as dcscdbed in (1) abovc) will receivc full pay for t~hc workJay. When City operations ore dosed down dudng a scheduled workday, employees who report to work r=nd arc subsc>quently released by thc City Managcr will reeeivc full pay for thc workday. Employees in an "exempt" (salaried) pay plan who are considered as non-essential will not have their salary affected by the above rule due to City operations having been closed. Employees already on official leave will not receive any additional paid time off and will be paid according to their odginai leave request. Employees scheduled to be on leave dudng their standard work (vacation, holiday, personal, comp time, or sick) who are called in to work due to an emergency situation will be paid et an oveffimc ratc. for hours worked during the emergency in accordance with the FLSA and will not receive any additional paid time off.
