3516ORDINANCE NO. 3516 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT TO CHANGE THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING AIRPORT BOULEVARD EAST AND MARQUETTE AVENUE AND BETWEEN RED CLEVELAND BOULEVARD AND OHIO AVENUE, FROM AG, AGRICULTURAL TO PD, PLANNED DEVELOPMENT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, Florida, regulating and restricting the location and use of buildings, structures, land, and water for trade, industry, residence or other purpose, be and the same is hereby amended as follows: The East 1/2 of Northwest 1/4 (LESS W 828' and North 462') of Section 8, Township 20 South, Range 31 E, as recorded in - the Public Records of Seminole County, Florida. be and the same is hereby rezoned to PD, Planned Development, zoning district and the Planned Development Master Plan is attached as Exhibit "A" is included herein by reference as if fully set forth herein. Additional conditions of development are as follows: a, All development shall be consistent with the McReynolds Airport Commercial Site Master Plan. Unless otherwise specified on the McReynolds Airport Commercial Site Master Plan, all development shall comply with setback and buffer criteria set forth in the City of Sanford Land Development Regulations. c. Future access upon Red Cleveland Boulevard shall require approval from the Sanford Airport Authority and shall be accomplished so that ingress/egress to the site lines up with crossovers on Red Cleveland Boulevard. Cross access shall be provided between each increment of development so that cross circulation can occur and access to both Marquette Avenue and Red Cleveland Boulevard can be provided. Upon request by the City, the Developer shall provide cross access to property to the west of the site. SECTION 2: Severability. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of any other section or part of a section of this Ordinance. SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: Effective Date. That this Ordinance shall become effective after the Department of Community Affairs issues an intent to find the associated comprehensive plan amendment to be in compliance with state law.
