3519ORDINANCE NO. 3519 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ""J CLOSING, VACATING, AND ABANDONING A 6' PORTION .-._ Of A 10' UTILITY EASEMENT LOCATED BETWEEN ~ MAYFAIR GOLF COURSE AND KINGSWOOD COURT EXTENDED EASTERLY AND BETWEEN RANTOUL LANE AND COUNTRY CLUB ROAD IN THE CITY OF SANFORD, FLORIDA; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon a 6' portion of a 10' utility easement located between Mayfair Golf Course and Kingswood Court extended easterly and between Rantoul Lane and Country Club Road in the City of Sanford, Florida; and WHEREAS, a public hearing was held on November 8, 1999, for consideration and determination as to whether or not the closing, vacating and abandoning of a 6' portion of the 10' utility easement located between Mayfair Golf Course and Kingswood Court extended easterly and between Rantoul Lane and Country Club Road should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and ~ abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That the 6' portion of the 10' utility easement located between Mayfair Golf Course and Kingswood Court extended easterly and between Rantoul Lane and Country Club Road in the City of Sanford, more particularly described as follows: SEE EXHIBIT "a" ATTACHED HERETO. be and the same is hereby closed, vacated, and abandoned. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
