3560ORDINANCE NO. 3560 AN ORDINANCE OF THE CITY OF SAN FORD, FLORIDA, AMENDING ORDINANCE NOS. 3117 AND 3334 OF SAID CITY; SAID ORDINANCES BEING A ZONING PLAN AND AMENDMENTS THERETO; SAID AMENDMENT TO AMEND THE MASTER PLAN FOR STERLING WOODS TO ESTABLISH A TEN (10) FOOT MINIMUM REAR YARD BUILDING SETBACK REQUIREMENT FOR SCREENED PORCHES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, Florida, regulating and restricting the location and use of buildings, structures, land, and water for trade, industry, residence or other purpose, and Ordinance No. 3334 of the City of Sanford, Florida, passed and adopted April 28, 1997, which Ordinance rezoned the Sterling Woods property to Planned Development, be and the same are hereby amended as follows: A. The Sterling Woods Master Plan dated January 6, 1997 is hereby amended to establish a ten (10) foot minimum rear yard building setback requirement for screened porches based on consistency with the Comprehensive Plan and similar approved Planned Developments in the vicinity subject to the following conditions and stipulations: There shall be no vertical construction within the rear yard utility easement areas except that fences shall be permitted so long as they are located only along the property line and provided that said fences shall not impair or impede any drainage through the rear portion of the lot where the drainage easement, drainage swale or other drainage structures am located. 2. The modification of these setbacks in no way allows additional impervious area on the lots greater than originally permitted with the approved drainage plan. 3. All other development shall be in accordance with the Sterling Woods Master Plan, as approved on April 28, 1997. SECTION 2: Severability. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of any other section or part of a section of this Ordinance. SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: Effective Date.
