3559 ORDINANCE NO. 3559 AN ORDINANCE OF THE CITY OF SANFORD, 'FLORIDA, AMENDING ORDINANCE NOS. 3117, 2010 AND 2040 OF SAID CITY; SAID ORDINANCES BEING A ZONING PLAN AND AMENDMENTS THERETO; SAID AMENDMENT TO AMEND THE MASTER PLAN FOR MONTEREY OAKS TO ESTABLISH A TEN (10) FOOT MINIMUM REAR YARD BUILDING SETBACK REQUIREMENT FOR SCREENED PORCHES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, Florida, regulating and restricting the location and use of buildings, structures, land, and water for trade, industry, residence or other purpose; that Ordinance No. 2010 of the City of Sanford, Florida, passed and adopted May 22, 1989, which Ordinance rezoned the Monterey Oaks property to Planned Development; and that Ordinance 2040 of the City of Sanford, Florida, passed and adopted July 10, 1989, which Ordinance amended the legal description attached to Ordinance 2010; be and the same are hereby amended as follows: A. The Monterey Oaks Master Plan as approved on August 10, 1998, is hereby amended to establish a ten (10) foot minimum rear yard building setback requirement for screened porches based on consistency with the Comprehensive Plan and similar approved Planned Developments in the vicinity subject to the following conditions and stipulations: 1. There shall be no vertical construction within the rear yard utility easement areas except that fences shall be permitted so long as they are located only along the property line and provided that said fences shall not impair or impede any drainage through the rear portion of the lot where the drainage easement, drainage swale or other drainage structures are located. The modification of these setbacks in no way allows additional impervious area on the lots greater than originally permitted with the approved drainage plan. Install a six (6) foot wood privacy fence or similar barrier along approximately 264 linear feet of the eastern property line between the single-family residential property (350 Upsala Road) and the southerly property line. All other development shall be in accordance with the Monterey Oaks Master Plan, as approved on August 10, 1998. SECTION 2: Severability. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of any other section or part of a section of this Ordinance. SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: Effective Date.
