3631 ORDINANCE NO. 3631 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THE NORTH- "" Co SOUTH UTILITY EASEMENT LYING BETWEEN o'~ :~: CO ~-- MELLONVILLE AVENUE AND BAY AVENUE AND '7 BETWEEN EAST 25TH STREET AND EAST 24TH STREET; ~-- PROVIDING FOR SEVERABILITY, CONFLICTS AND ....j c~ EFFECTIVE DATE. C:::) ~ WHEREAS, an application has been filed with the City of Sanford to close, vacate o and abandon the North-South utility easement lying between Mellonville Avenue and Bay ~ Avenue and between East 25th Street and East 24t~ Street in the City of Sanford, Florida, CO and ~< WHEREAS, the City has received a Petition to Vacate Right of Way and/or " c~rq c~ Easement with eleven of the seventeen adjacent property owners' signatures (64.7%); and ~ WHEREAS, a public hearing was held on March 26, 2001, for consideration and c~ determination as to whether or not the closing, vacating and abandoning the North-South O utility easement lying between Mellonville Avenue and Bay Avenue and between East 25t~ Street and East 24t~ Street in the City of Sanford, Florida, should be allowed; and O WHEREAS, the City Commission has determined that the closing, vacating and rJ ~2 abandoning of that certain property does not conflict with the Comprehensive Plan of the ~q City of Sanford, Florida, and that the public health, economy, comfort, order, convenience~ ~ and welfare will be promoted by such closing, vacating and abandoning. ~ o NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF ~ SANFORD, FLORIDA: c~ SECTION 1: That the North-South utility easement lying between Mellonville Avenue and Bay Avenue and between East 25th Street and East 24th Street in the City of OFFICIAL RECORDS SEMINOLE CO..FL Sanfordl Florida, more particularly described as follows: That certain North/South utility easement lying between and ~buttinO Lots 110 through 15g, SANFO PARK, ~aaording to the m~p or pl~t thereof recorded in PI~ Book 5~ psOe Public Reaord~ of Seminole County, Florida. be and the same is hereby closed, vacated, and abandoned. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
