3589 ORDINANCE NO. 3589 r" AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, O~ ~.~ CLOSING, VACATING, AND ABANDONING PROSPECT DRIVE LYING BETWEEN FLORIDASTREET/27TH STREET AND AIRPORT BOULEVARD AND BETWEEN GOOD ca AVENUE EXTENDED NORTHERLY AND U.S. 17- 92/ORLANDO DRIVE; AND ESTABLISHING A DRAINAGE r-- AND UTILITY EASEMENT OVER THE ENTIRE RIGHT-OF- ~ WAY; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vaca~ and abandon Prospect Drive lying between Florida Street/27th Street and Airpo~ ~ Boulevard and between Good Avenue extended northerly and U.S. 17 92/rla ' - O ndo Dnve ~ in the City of Sanford, Florida, and establishing a drainage and utility easement over the~_ o~ entire right-of-way; and ~.> co " WHEREAS, a public hearing was held on November 13, 2000, for consideration and O ca determination as to whether or not the closing, vacating and abandoning Prospect Drive lying between Florida Street/27th Street and Airport Boulevard and between Good Avenue extended northerly and U.S. 17-92/Orlando Drive in the City of Sanford, Florida, should ~J be allowed; and ;h -IJ "~ WHEREAS, the City Commission has determined that the closing, vacating and O ~ abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, "' and welfare will be promoted by such closing, vacating and abandoning. ,D NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Prospect Drive lying between Florida Street/27th Street and Airport Boulevard and between Good Avenue extended northerly and U.S. 17-92/Orlando Drive in the City of Sanford, Florida, more particularly described as follows: SEE EXHIBIT "A" ATTACHED HERETO. be and the same is hereby closed, vacated, and abandoned; however the City hereby reserves a drainage and utility easement over the entire right of way being vacated. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
