FL. · CLERK OF CIRCUIT COURT RECORDED & VERIFIED 0FFtC~AL , 659197 01M/ R-2 ,H8,02 0}7 t890 ORDINANCE NO. 3623 SEMINOLE C0.,~L AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THAT 20' UTILITY AND DRAINAGE EASEMENT LYING BETVVEEN TECH DRIVE AND UPSALA ROAD AND BETWEEN CENTRAL PARK DRIVE AND UPSALA ROAD; PROVIDED THAT THE EXISTING UTILITY LINE(S) SHALL BE RELOCATED AT NO EXPENSE TO CITY; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon that 20' utility and drainage easement lying between Tech Drive and Upsala Road and between Central Park Drive and Upsala Road in the City of Sanford, Florida, provided that the existing utility line(s) shall be relocated at no expense to the City; and WHEREAS, a public hearing was held on February 12, 2001, for consideration and determination as to whether or not the closing, vacating and abandoning that 20' utility and drainage easement lying between Tech Drive and Upsala Road and between Central Park Drive and Upsala Road in the City of Sanford, Florida, should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by.such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That 20' utility and drainage easement lying between Tech Drive and Upsala Road and between Central Park Drive and Upsala Road in the City of Sanford, Florida, more particularly described as follows: OFFICIAL RECORDS BO~,t t,,tGE I 0171891 SEMINOLE CO.,FL Easterly 10' of Lot 25 and Westerly 10' of Lot 26, Sanford Central Park, PB 33, Pages 64-66, Seminole County, Florida. be and the same is hereby closed, vacated, and abandoned; provided that the existing utility line(s) shall be relocated prior to the vacate being effected, and said relocation shall be done at no expense to the City. SECTION 2" If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
