3620 ORDINANCE NO. 3620 AN ORDINANCE OF THE CITY OF SANFORD, FLOR!DA, O~ ~_~ WESTERLY 424,88 FEET OF THE T WAY LYING BETWEEN MCCRACKEN ROAD AND ~,O ACADEMY AVENUE AND BETWEEN AIRPORT BOULEVARD AND PERSIMMON AVENUE; RESERVING A DRAINAGE AND UTILITY EASEMENT OVER THE ENTIRE RIGHT-OF-WAY FOR THE MAINTENANCE OF EXISTING AND FUTURE UTILITIES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. r- WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon the westerly 424.88 feet of the unnamed right-of-way lying between ~ I McCracken Road and Academy Avenue and between Airport Boulevard and Persimmon o Avenue in the City of Sanford, Florida, reserving a drainage and utility easement over the "'~' ca entire right-of-way for the maintenance of existing and future utilities; and WHEREAS, a public hearing was held on February 12, 2001, for consideration and :> determination as to whether or not the closing, vacating and abandoning the westerly 424.88 feet of the unnamed right-of-way lying between McCracken Road and Academ~ c:::) Avenue and between Airport Boulevard and Persimmon Avenue in the City of Sanforc~ Florida, should be allowed; and ~ --- r- .,.j .H WHEREAS, the City Commission has determined that the closing, vacating and r.J -P abandoning of that certain property does not conflict with the Comprehensive Plan of the o City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, 4J and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF ~>~ SANFORD, FLORIDA: SECTION 1: That the westerly 424.88 feet of the unnamed right-of-way lying n. between McCracken Road and Academy Avenue and between Airport Boulevard and Persimmon Avenue in the City of Sanford, Florida, more particularly described as follows: SEE EXHIBIT "A" ATTACHED HERETO. be and the same is hereby closed, vacated, and abandoned; however the City hereby reserves a drainage and utility easement over the entire right-of-way being vacated for the maintenance of existing and future utilities. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance.
