3586 ORDINANCE NO. 3586 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3117 OF SAID CITY; SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT CHANGING THE ZONING OF 27.8 ACRES OF PROPERTY LYING BETWEEN VIHLEN ROAD AND DOGWOOD DRIVE EXTENDED EASTERLY AND BETWEEN VIHLEN ROAD AND UPSALA ROAD, FROM AG, AGRICULTURAL, TO SR-1, SINGLE FAMILY DWELLING RESIDENTIAL; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CiTY OF SANFORD, FLORIDA: SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, Flodda, regulating and restricting the location and use of buildings, structures, land, and waterfor trade industry, residence or other purpose, be and the same is hereby amended as follows: SEE EXHIBIT "A" ATTACHED HERETO. be and the same ~s hereby rezoned from AG, Agricultural, SR-1, Single Family Dwelling Residential, zoning district. SECTION 2: The rezoning action herein is subject to the conditions provided for and agreed to in the Development Order #0043. SECTION 3: Severability. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of any other section or part of a section of this Ordinance. SECTION 4: Conflicts. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: Effective Date. That this Ordinance shall become effective immediately upon the execution and recording of the Development Order referenced above, provided that said Development Order is fully executed and delivered to the City Clerk for recording within ninety (90) days of the date of adoption of this ordinance, otherwise this ordinance shall be null and void and of no force and effect. OFFICIAL RECORDS Bn~ ?AGE h'003 0368 SEMINOLE CO.,FL Development Order for TurneFWzilkes Property(Crown Colony),Page 2 (3) The conditions upon this development approval and the commitment made as to this development approval, all of which have been accepted by and agreed to by the owner of the property are as follows: (a) All properties directly abutting the Idyllwilde Subdivision are to be a minimum of 10,000 square feet. (b) Minimum living area and building size of each residence is to be no less than 1500 square feet in area as required in SR-1AA. (c) With the exception of Lots 37 and 38 which shall have access to Dogwood Drive, access to the subdivision shall be from Vihlen Road. No access to Dogwood Drive is allowed for all lots other than 37 and 38 as noted. (d) A white vinyl fence, 6 feet high, shall be constructed in specific areas per the Conceptual Plan referenced in (f), below, including but not limited to the western property line and along lots adjoining Idyllwilde lots. Such fence shall be constructed as part of the subdivision improvements, i.e., not as a condition of CO for each house. Fence specifications shall be as approved by the City Commission. (e) No two-family dwellings are to be established within this subdivision. (f) General Layout of the subdivision for the subject property shall be generally as set forth in Exhibit "A" entitled Crown Colony Single Family Subdivision Conceptual Zoning/Site Plan dated November 21, 2000. (g) The house on proposed lot 37 shall be a single family dwelling. The existing structure (bungalow) shall be demolished. (h) Lot 39 shall not access Dogwood Drive; Lot 39 shall access the cul-de- sac; Lot 39 access to Dogwood Drive shall be dedicated to the City. (i) To the maximum extent feasible, the rear drainage problem of Lots 5 and 6, Idyllwilde III shall be corrected. (j) Lots 70, 1, 2, and 3 shall have a wall adjacent to Viihen Road plus an entry feature into the development from Viihen Road. (k) Lot 32 shall be restricted to a single story residence. (1) Deed restrictions and covenants shall be submitted to the City for approval prior to platting. (m) Ribbon curb treatment shall be provided on Viihen Road from project entrance to Upsala Road. (4) This Development Order touches and concems the afore described property and the conditions, commitments and provisions of this Development Order shall perpetually burden, run with and follow the said property and be a servitude upon and binding upon said property unless released in whole or part by action of the City of Sanford by virtue of a document of equal dignity herewith.
