AN 8:15 ORDINANCE NO. 3329 AN ORDINANCE OF THE CITY OF SAN FORD, FLORIDA, CLOSING, VACATING, AND ABANDONING :z A PORTION OF EAST ROAD BETWEEN SUMMIT ROAD AND MAIN ROAD, A PORTION OF SU!v~vlIT ROAD BETWEEN EAST AND HOSPITAL ROAD, AND A PORTION OF HOSPITAL ROAD BETWEEN $U!v~vllT ROAD AND MAIN ROAD; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon a portion of East Road between Summit Road and Main Road, a portion of Summit Road between East Road and Hospital Road, and a portion of Hospital Road between Summit Road and Main Road; and WHEREAS, a public hearing was held on January 27, 1997, for consideration and determination as to whether or not the closing, vacating and abandoning of East Road between Summit Road and Main Road, a portion of Summit Road between East Road and Hospital Road, and a portion of Hospital Road between Summit Road and Main Road should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: A portion of East Road between Summit Road and Main Road, a portion of Summit Road between East Road and Hospital Road, and a portion of Hospital Road between Summit Road and Main Road, more particularly described as follows: That part of Hospital Road as recorded in Sanford's Substantial Tract No. 1, Plat Book 5, Pages 83 and 84, Public Records of Seminole County, Florida, 1,300 feet south of a westerly extension of the south line of County Cemetery as recorded in Plat Book 14, Page 67, Public Records of Seminole County, Florida and All that part of Summit Road as recorded in Sanford's Substantial Farms Tract No. 1, Plat Book 5, Pages 83 and 84, Public Records of Seminole County, Florida lying west of the west right-of-way line of Hospital Road as recorded in said Sanford Substantial Farms Tract No. 1. and ~m i~o c~ All that part of East Road as Recorded in Sanford's Substantial Farms Tract No. 1, Plat Book 5, Pages 83 and 84, Public Records of Seminole County, Florida, lying north of a easterly projection of the north line of Lot 60 of said Sanford Substantial Farms Tract No. i, be and the same is hereby closed, vacated, abandoned, subject, however, to the City retaining the property described as Hospital Road as a utility easement. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
