ORDINANCE NO. 3304
AN ORDINANCE OF THE CITY OF SAN FORD,
FLORIDA, CLOSING, VACATING, AND ABANDONING
THAT CERTAIN 7.5 FOOT WIDE DRAINAGE AND
UTILITY EASEHENT LYING ON THE EASTERLY rn
PORTION AND THAT CERTAIN 10 FOOT WIDE c~
DRAINAGE AND UTILITY EASEHENT LYING ON THE
SOUTHERLY PORTION OF THE PROPERTY AT 309
BORADA ROAD; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close, vacate and
abandon that certain 7.5 foot wide drainage and utility easement lying on the easterly portion
and that certain 10 foot wide drainage and utility easement lying on the southerly portion
of the property at 309 Borada Road; and
WHEREAS, a public hearing was held on August 12, 1996, for consideration and
determination as to whether or not the closing, vacating and abandoning that certain 7.5 foot
wide drainage and utility easement lying on the eastedy portion and that certain 10 foot wide
drainage and utility easement lying on the sourhefty portion of the property at 309 Borada
Road; and
WHEREAS, the C-ity Commission has determined that the closing, vacating and
abandoning of that certain property does not conflict with the Comprehensive Plan of the
City of Sanford, Florida, and that the public health, economy, comfort, order, convenience,
and welfare will be promoted by such closing, vacating and abandoning·
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SAN FORD, FLORIDA:
SECTION 1: That certain 7.5 foot wide drainage and utility easement lying on the
easterly portion and that certain 10 foot wide drainage and utility easement lying on the
southerly po~on of the propera/at 309 Borada Road, more particularly described as
follows:
~11 of that certain 7.5 foot wide drainage and utility easement
lying along the east side property line and all of that certain 10
foot wide drainage and utility easement lying along the south
side property line of Lot 14, Block 2, Hidden Lake Phase II,
Unit I, Plat Book 24, Pages 15 to 17, of the Public Records of
Seminole County, Florida
be and the same is hereby closed, vacated, abandoned.
SECTION 2: If any section or portion of a section of this ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and
the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its passage
and adoption.
