3367 ORDINANCE NO. 3367 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING THE CITY CODE CHAPTER 16, SECTION 16- 3, ENTITLED TERM; PENALTY FOR DELINQUENCY TO REFLECT THE PROPER AMOUNT OF ADDITIONAL PENALTY; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Sanford deems it necessary to amend the City Code Chapter 16, Licenses, by amending Sec. 16-3, Term; Penalty for Delinquency to reflect the proper amount of additional penalty. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: Chapter 16, Licenses, Sec. 16-3 entitled "Term; Penalty for Delinquency" is hereby deleted in its entirety and the new Sec. 16-3 is adopted as follows: Sec. 16-3. Term; penalty and delinquency. Except as otherwise provided, no license required by this chapter shall be issued for more than one year, except when issued for a half year, day, month, or quarter, as the case may be. All licenses shall be issued beginning August first of each year, shall be due and payable on October first of each year and shall expire on September thirtieth of the succeeding year. Those licenses not renewed by October first shall be considered delinquent and subject to a delinquency penalty of ten (10) percent for the month of October plus an additional five (5) percent penalty for each month of delinquency thereafter until paid; provided that the total delinquency penalty shall not exceed twenty- five {25) percent of the occupational license fee for the delinquent establishment. Those persons who engage in any business, profession, or occupation and have not paid their occupational license renewal fees within one hundred fifty (150) days after the initial notice of tax due shall be subject to an additional penalty of two hundred fifty dollars ($250.00). SECTION 3: SEVERABILITY. If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: CONFLICTS. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: EFFECTIVE DATE.
