AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING A PORTION
OF COHF4ERCIAL STREET BETWEEN MULBERRY AVENUE
AND POMEGRANITE AVENUE IN THE CITY OF c~
SANFORD, FLORIDA, RESERVING AN EASEF4ENT FOR

PUBLIC UTILITY PURPOSES; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, an application has been filed wi~h the City of Sanford to close, vacate and
abandon a portion of Commercial Street between Mulberry Avenue and Pome~ranite Avenue
of Sanford, Florida, reserving an easement for public utility purposes; and
~o WHEREAS, a public hearing was held on November 10, 1997, for consideration and
~' determinaCion as to whether or not the closing, vacating and abandoning of a portion of
r-- Commercial SCreet between l'4ulberry Avenue and Pome~'anite Avenue; and
:~ WHEREAS, the City Commission has determined that the closing, vacating and
~ abandoning of that certain property does not conflict with the Comprehensive Plan of the
z City of Sanford, Florida, and that the public health, economy, comfort, order, convenience,
~o and welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF

SANFORD, FLORIDA:
SECTION 1: That a portion of Commercial Street between Mulberry Avenue and
Pomegranite Avenue, more particularly described as follows:
~- A 66' by 255' public right-of-way lying North and parallel to
~ the North property line of Block 2, Tier 20, E.R. Trafford's map
,, of the Town of Sanford, according to the plat thereof as
c~ ~ recorded in Plat Book 1, Pages 56 through 64, of the Public
>- Records of Seminole County, Florida. -N

~2 be and the same is hereby closed, vacated, abandoned, however, the City hereby reserves and
c~ retains an easement for public utility purposes over the property described above.
~ SECTION 2: If any section or portion of a section of this ordinance proves to
~- invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
~ of any other section or part of this ordinance.

~ SECTION 3: That all ordinances or parts of ordinances in conflict herewith be ancl
~ the same are hereby revoked.
o_ SECTION 4: That this ordinance shall become effective immediately upon its passage
and adoption.
