3386 ORDINANCE NO. 3386 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 18 OF THE SANFORD CITY CODE, TO ADOPT TFIF. RESIDENTIAL LIGHTING STANDARDS AND TO PROVIDE THAT VIOLATION OF THE RESIDENTIAL LIGHTING STANDARDS IS A CIVIL INFRACTION FOR WHICH A CITATION MAY BE ISSUED; PROVIDING FOR SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE. WHEREAS, it is the desire of the City Commission of the City of Sanford to adopt Residential Light'rag Standards; and WHEREAS, the adoption of the Residential Lighting Standards is done to facilitate prevention of "light pollution" in residential areas caused by direct glare, and NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA, that revisions to the City Code are hereby adopted as follows: SECTION 1: That Article VIII~ Residenf~al Lighting Standards, shall be added, as follows: ARTICLE VIII. RESIDENTIAL LIGHTING STANDARDS Excessive lighting prohibited in Residential areas. (a) All lighting is required to be installed in such a manner and be so shielded that the cone of light shall fall within the perimeter of the property upon which such lighting is located. U~ghting shall be directed away from adjacent properties. No direct glare shall be directly visible from a public right-of-way or residential use adjacent to the property in question. All lighfmg shall conform to applicable codes including but not limited to building and electrical codes in effect within the City of Sanford. (b) Any resident of the City of Sanford shall have the right to object to lighting that causes direct glare or otherwise causes light to fall upon said resident' s residence in a manner that causes direct glare. The City shall have the power and authority to utilize any and all appropriate and lawful means and methods to eliminate direct glare including Code Enforcement proceedings~ civil citation, and injunctive relief in circuit court. (c) City street lights are excepted from these standards. SECTION 2: Section 18-87~ Schedule of Violations, of Article V. Code Enforcement Citations is amended by the addition of "Section 18-1050 Excessive light'rag prohibited in Residential Areas. Class IF. SECTION 3: SEVERABILITY. ffany section or a portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: CONFLICTS. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: EFFECTIVE DATE.
