3420 ORDINANCE NO. BURNING AND THE USE OF FI~WORKS BY THE PUBLIC DURING THE 1998 FOREST AND BRUSH FIRE EMERGENCY AND BANNING THE SALE OF FIREWORKS IN THE CI~; AND PROVIDING FOR SEVE~BILI~, CONFLICTS AN EFFECTIVE DATE. WHEREAS, ~e GovemoF of the State of Florida has issued Executive Order Number 98- 141 issued June 7, 1998, declaring a State of EmeFgency throughout Florida due to the forest and bFush fires occu~ing within the State; WHEREAS, the Governor's Executive OFdeF expressly recognizes the extreme potential for more fires that threaten life and prope~y and has instituted a ban on burning authorizations statewide; WHER~S, several counties acFoss the State have experienced losses and damages to real and personal prope~y and citizens have sustained injuries from the fires; WHER~S, the National Weather Se~ice predicts that extremely d~ weatheF conditions have created 8 high fire danger and the weather forecasts show a continuing high burn potential; WHEREAS, the Fire Marshall advises that the risk of fu~her forest and brush fires is high given weather and ecological conditions; WHER~S, the Fire MaFshall Fecommends that the City Commission urge all membeFs of the public not to do any open burning, including ~mp fires, bonfires, and trash burning OF to ignite any fireworks, including legal spaFklers, because of the high risk conditions, duFing this emergency; WHER~S, the Fire MaFshall recommends that the only fiFeWOFk exception should be July 4~ firewo~ displays which are specifically appFoved by local fire authority having jurisdiction; and WHER~S, eliminating open burning during the period of emergency will lessen the risk of forest and brush fires, and thereby Feduce the risk of harm to human life and pmpe~y; and WHEREAS, not igniting fireworks during the period of the emergency, including Independen~ Day, July 4th, also will lessen the risk of forest and brush fires, and thereby fu~her reduce the risk of harm to human life and prope~y. NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CI~ OF SANFORD, FLORIDA: SECTION 1: That the City Commission of the City of SanfoFd, hereby declares: 1. The general public is diFected not to do any open buming including any campfires, bonfires, trash burning, and any other similar open incineration during the declared forest and bFush fire emergency; 2. The general public also is directed not to ignite fireworks of any kind during the declared forest and brush fire emergency, including igniting sparklers; 3. Only firework displays specifically approved by a local fire authority having jurisdiction are excepted from this proclamation; 4. The Police Department and other law ~nforcement, fire prevention and emergency personnel are directed to publicize the dangers and risks associated with open burning and igniting fireworks and directing citizens not to do any open burning or to ignite even legal fireworks during the declared 1998 Forest and Brush Fire Emergency, including the July 4th Independence Day celebrations; 5. The Police Department and other law enforcement officials, agents of the State Fire Marshall, the Florida Division of Forestry and City of Sanford Fire Prevention Officials are empowered to specifically enforce the laws governing open fires and the use of illegal fireworks (bottle rockets, fire crackers, roman candles, etc.) during this period of declared emergency. 6. The sale of fireworks is expressly forbidden in the City of Sanford during this period of declared emergency and the Police Department, other law enforcement agencies, City Fire Prevention officials, building and code enforcement officials and City Licensing officials are empowered and directed to enforce this Resolution. SECTION 2: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all Ordinances or parts of Ordinances in conflict herewith by and the same are hereby revoked.
