FL, (hereinafter referred to as Worksite Host), for the provision of a CareerSource sponsored internship for designated participant(s); NOW THEREFORE, the parties enter into this Agreement with the following terms and Conditions: 1. TERM This contract shall begin upon signature and shall end on June 30, 2021. This agreement will replace and supersede any prior agreement between the parties, regarding the CareerSource Internship. Either party may terminate this Agreement, with or without cause, at any time by giving written notice to the other party within 24 hours. This Agreement must be completed and signed by CareerSource and Worksite Host prior to a CareerSource participant's placement with the Worksite Host. Work -based training is only offered for occupations that are in the demand in the local area in which the participant receives training. 11. WORKSITE HOST RESPONSIBILITIES The Worksite Host agrees to the following: 1. Submit a job description to CareerSource for the position a participant(s) will be trained any adjustment to the job description must be approved by CareerSource. 2. Provide the necessary orientation, training, supervision, and precautionary safety instructions in the performance of the CareerSource participant(s) duties, as stated in the job description. If a change in supervision occurs, Worksite Host will notify CareerSource and update Timesheet Authorization form (Attachment B.) 3. No member of the participant's family member may be engaged in any capacity for the employer. Relative is defined as: father, mother, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, husband, wife, father-in- law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, sister-in-law, stepfather, stepmother, stepson, stepdaughter, stepbrother, stepsister, half-brother, or half. 4. Provide a professional internship as agreed to by the parties. 5. Maintain liability insurance coverage in accordance with State of Florida law. Workers compensation insurance coverage will be provided by the State of Florida for CareerSource participant(s). Worksite hosts must report any incidents to CSCF and Manpower immediately. 6. Evaluate the participant's performance during the internship. In the event a concern cannot be addressed, notify the CareerSource contact in advance of any intent to terminate. 8. Worksite hosts must cooperate with monitoring requirements conducted by the state and/or CareerSource, and adhere to all applicable local, state, and federal rules and regulations. 9. Worksite host agrees to provide training for in -demand occupations for CareerSource participants. 10. Immediately notify CareerSource in writing when one or more of the following situations occurs with a participant:: a) Has failed to attend the initial interview or refused a suitable work site offer or voluntarily quit training; b) Not accepted by the Worksite Host into an internship; c) Has experienced absenteeism or sickness or other problems; or d) Secured employment with the Worksite Host or with another entity... 11. The maximum internship shall be no more than twelve (12) weeks and no more than forty (40) hours per week. The CareerSource participant shall not engage in the construction, operation, or maintenance of any part of any building which is used for sectarian instruction or as a place of worship. The participant will not operate a vehicle (s) for business purposes as part of job duties unless a waiver is signed by Worksite Host and a Motor Vehicle Check has been administered. The participant shall not assist with political or lobbying activities or any activity designed to influence legislation or appropriation pending before the Congress of the United States. 12. Employer must not allow intern to work off site unless site manager/supervisor is present at all times. 13. Employer must not allow the intern to handle cash during internship. 14. No currently employed Worksite Host employee shall be displaced by an internship participant. This includes partial displacement such as reduction in the hours of non -overtime work, wages or employment benefits. A Worksite Host may not displace any regular employee or fail to fill a vacancy to place an internship participant may fill the job requirements. Based upon the above, Worksite Host must ensure that employees of Worksite Hosts organization are notified of displacement rules and his/her rights under the law and ability to file a grievance. 15. Worksite Host's execution of the Internship Program Non -Financial Agreement is with the expectation that Worksite Host will be monitored by CareerSource for compliance with this provision and Worksite Hosts that violate this provision of the Agreement and requirement of the law will be terminated from participation in the internship program. 16. No internship shall be created for any position when the same or substantially equivalent position is vacant due to a hiring freeze; or when any regular employee is on lay-off from the same or substantially equivalent position; or when the regular employee has been bumped and has recall or bumping rights to that position pursuant to the Worksite Host's personnel policy or collective bargaining agreement. 17. Maintain the confidentiality of all information provided by or about any CareerSource participant(s), except as otherwise approved and authorized in writing by the participant(s), or as otherwise authorized by law. 18. All CareerSource participants are to be provided with the same working conditions by Worksite Host afforded to other employees presently in the Worksite Host's workforce. 19. The participant(s) shall not be considered an employee of the Worksite Host or CareerSource. The participant(s) shall be considered an employee of a third -party employer of record designated by CareerSource 20. The Worksite Host shall have all supervisory responsibility of the participant(s). The participant(s) shall be responsible for submitting a time sheet that will be signed and dated by the Worksite Host. Worksite Host will approve timesheet via website to third -party employer of record. 21. All potential internship participants will be referred to Worksite Host by CareerSource in accordance with the terms of this Agreement. 22. Worksite Host must not be involved in a current labor dispute and must not have a history of frequent layoffs. Worksite Host must be in compliance with all applicable business licensing, taxation, and insurance requirements. The employer must not be in violation of any local, state or federal labor laws. 23. Worksite Host may be in the private for-profit sector, the non-profit sector, or the non-profit sector. Worksite Host must have at least two full-time employees unrelated to the owner of the business. Worksite Host must provide an IRS Employer Identification number to demonstrate that they are a legitimate employer, having full-time employees, and conducting their trade or business at an appropriate place of business. Businesses must be located in Lake, Orange, Osceola, Seminole or Sumter counties. 24. The agreement must be executed and signed by all parties prior to the assigning a participant to a work site. CAREERSOURCE RESPONSIBILITIES UNDER THIS AGREEMENT CareerSource agrees to the following: 1. Recruit, select and refer participant(s) to Worksite Host for consideration of an internship. 2. Participants will be compensated at the prevailing wage rate not to exceed $20 per hour for the positions based on the worksite host's job description and validated by labor market data. Assist the Worksite supervisor in resolving any problems concerning the participant(s) performance on the job and will respond to any concerns within 24 hours. 3. Review and mediate any potential grievances concerning the participant at the host location in accordance with CareerSource grievance procedures. 4. Provide counseling and supportive services to participant(s) as needed and available. 5. Provide the total maximum hours a participant will be available for the internship and the expected timeframe for such participation, 6. Provide the required participant time record forms, progress reports, and periodic evaluation forms to be completed by the Worksite Host. CareerSource will monitor all work hours and review feedback reports. 7. Monitor worksites to ensure that all parties are, and remain in compliance, with federal and state laws, as well as state and local policies and procedures. Services and activities provided under WIOA must be monitored annually for compliance by DEO pursuant to Section 185(c), Monitoring of activities under this Agreement will be conducted at reasonable hours and as frequently as the authorized representatives of CareerSource may deem necessary in order to assure the internship is constructive for the participant and that all provisions of this Agreement are being carried out. Any issues identified will be discussed with the Worksite Host to determine a corrective action plan with specified timelines. In the event a serious issues is identified, CareerSource will reserve the right to remove participant(s) from host work site(s) without prior notice. This action may be taken when CareerSource, the Governor of the State of Florida, or the U.S. DOL finds serious or continual violations of rules or laws, where violations are not being remedied. IV. INDEPENDENT CONTRACTOR Both parties in the performance of this Agreement will be acting in an individual capacity and not as agents, employees, partners, joint ventures, or associates of one another. V. RETENTION OF RECORDS Worksite Host agrees to retain all records, supporting documents and (including electronic storage media) pertaining to this Agreement for a period of 3 years. Copies of all records and documents shall be made available for CareerSource upon request. VI. COMPLIANCE WITH POLICIES AND LAWS The warranty of this Section specifically includes compliance by Worksite Host and its subcontractor with the provisions of the Immigration Reform and Compliance Act of 1986 (P. L. 99-603), the provisions of the Workforce Innovation and Opportunity Act (WIOA) of 2014, and other applicable federal regulations and policies promulgated thereunder and other applicable State, Federal, criminal and civil law with respect to the alteration or falsification of records created in connection with this Agreement. Office of Management and Budget (OMB) Circulars: Worksite Host agrees that, if applicable, it shall comply with all applicable OMB circulars, such as 2 CFR 200 Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards. No contract shall be awarded to parties listed on the GSA List of Parties Excluded from Federal Procurement or Non -Procurement Programs. III. MONITORING Worksite Host agrees to cooperate with any review, monitoring, evaluation or audit by CareerSource, the Governor of Florida, the U.S. Comptroller General, the U.S. Secretary of Labor, or other designated representatives, and any other authorized State, Federal representative of any program which the Worksite Host administers or operates and which is funded, in whole or in part, by CareerSource. As applicable, Worksite Host agrees to make available for examination any and all CareerSource career seeker records requested and shall permit such entities to audit, examine, and make excerpts and transcripts, in whole or in part, from such records and to conduct audits of all Agreements, invoices, materials, records of personnel, conditions of employment, and all other data requested. Such access shall be granted during regular office hours of the Worksite Host with or without previous announcement and shall include provisions by the Worksite Host of suitable work space for such monitoring, inspection, audit, or investigation to be conducted. IV. HOLD HARMLESS Without waiving its sovereign immunity, and if and to the extent allowed by law, each party shall indemnify and hold harmless each other, its officers, officials, and employees from and against all claims and liabilities of any nature or kind, including costs and expenses for or on account of any claims, damages, losses, or expenses of any character whatsoever resulting in whole or in part from the negligent performance or omission of either party's employees or representatives connected with the activities described herein. NON -ASSIGNABILITY CLAUSE This Agreement or any right accruing hereunder shall not be assigned by Worksite Host in whole or in part without the prior written consent of CareerSource. Any assignment in violation hereof shall be invalid. GOVERNING LAW AND VENUE The place for any hearing, arbitration or otherwise, shall be Orange County, Florida. This Agreement shall be interpreted under the laws of the State of Florida.
