3432 ORDINANCE NO. 3432 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE CITY COMMISSION OF THE CITY OF SANFORD TO DEVELOP A PORTION OF THE PROPERTY GENERALLY DESCRIBED AS FORT MELLON PARK AND MORE PARTICULARLY DESCRIBED IN THIS ORDINANCE; PERMITTING THE CITY TO LEASE SAID PROPERTY IN ORDER TO ALLOW FOR THE DEVELOPMENT OF A HOTEL/CONFERENCE CENTER AND CITY PARK COMPLEX ON THE PROPERTY, SUBJECT TO APPROVAL OF THE ELECTORS OF THE CITY; PROVIDING FOR REFERENDUM ELECTION BY CITY ELECTORS ON NOVEMBER 3, 1998; PROVIDING FOR SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE. WHEREAS~ there is a great need for economic development and job opportunities within the City of Sanford and more particularly along the waterfront of the City of Sanford~ and WHEREAS~ economic development in the City of Sanford would be greatly improved through the development of the Sanford lakefront as a hotel/conference center and city park complex~ and WHEREAS, the City Commission desires to enhance park amenities and recreational opportunities of Fort Mellon Park for the benefit of City residents through landscaping, boardwalk, fishing piers and other amenities with such improvements funded in whole or in part through increased tax revenues from hotel/conference center development. WHEREAS, the City Commission finds it in the best interest of the City to enact an ordinance authorizing the City Commission to enter into the necessary contracts to develop a hotel/conference center and city park complex on waterfront property currently known as Fort Mellon Park; and WHEREAS, the City Commission of the City of Sanford, Florida may submit to the electors of the City the proposed Ordinance pursuant to the City's home rule powers~ Chapter 166 of the Florida Statutes, and Section 7~4 and 7-5 of the Sanford City Code; and WIlEPEAS, the City Commission finds it in the best interest of the City to submit this proposed Ordinance to the electors of the City for a referendum at the election to be held on November 3, 1998. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: DESCRIPTION OF PROPERTY. The property in question in this Ordinance is generally described as Fort Mellon Park but more paff~cularly described as provided in Exhibit "A" to this Ordinance. SECTION 2: DEVELOPMENT ALLOWED. The City Commission of the City of Sanford is hereby authorized to enter into all necessary agreements and contracts to effectuate development of the property described in Exhibit "A" , through the lease of that property to a private developer for purposes of building a hotel/conference center complex. Said development shall be constructed in such a way to allow a joint use of the property as a city park to the fullest extent economically feasible. SECTION 3: APPROVAL. That the question of the approval of this Ordinance shall be submitted to a vote of the electors of the City at a referendum to be held in the City of Sanford on November 3, 1998. SECTION 4: FORM OF BALLOT. That the form of the ballot shall be in a clear, concise statement without argument or prejudice. The ballot question to be used in the referendum election shall be substantially in the following form: Should the City. allow a City park and hotel/conference center on Fort Mellon Park? To enhance economic development, job opportunities and park amenities for Ordinance No. 3432 Page 2 of 4 City residents, the City Commission of the City of Sanford is authorized to lease a portion of Fort Mellon Park to enter into contracts and to authorize development of the Park for a hotel/conference center and City Park complex. SECTION 5: SEVERABILITY. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other action or part of this Ordinance. SECTION 6: CONFLICTS. That all Ordinances or parts ofOrdinances in conflict herewith be and the same are hereby revoked. SECTION 7: SEVERABILITY. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other action or part of this Ordinance.
