AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING TWO
NORTH-SOUTH UTILITY AND DRAINAGE EASEMENTS ~
LYING BETWEEN SUN DRIVE AND UPSALA ROAD
EXTENDED EASTERLY AND BETWEEN SOUTH WHITE c~
CEDAR ROAD AND CENTRAL PARK DRIVE IN THE CITY
OF SANFORD, FLORIDA; PROVIDING FOR SEVERABILITY, e
CONFLICTS AND EFFECTIVE DATE. ..~
~ WHEREAS, an application has been filed with the City of Sanford to close, vacate and
r-- abandon two utility and drainage easements lying between Sun Drive and Upsala Road
'. extended easterly and between South White Cedar Road and Central Park Drive in the City
E~ of Sanford, Florida; and
~ WH EREAS, a public hearing was held on November 23, 1998, for consideration and
~ determination as to whether or not the closing, vacating and abandoning of two utility and
c~ drainage easements lying between Sun Drive and Upsala Road extended easterly and betwe~>_>
~. South White Cedar Road and Central Park Drive; and
c~ WHEREAS, the City Commission has determined that the closing, vacating and
~ abandoning of that tengin property does not conflict with the Comprehensive Plan of the
> City of Sanford, Florida, and that the public health, economy, comfort, order, convenience,
~ and welfare will be promoted by such closing, vacating and abandoning.
-- NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
~ SANFORD, FLORIDA:
~' SECTION 1: That those two utility and drainage easements lying between Sun Drj~
,., and Upsaid Road extended easterly and between South White Cedar Road and Central Park
m Drive in the City of Sanford, more particularly described as follows:
a. That certain ten foot easement on the east side of Lot
20, less the northerly thirty feet thereof; and
b. That certain five foot easement on the west side of Lot 1
for only that portion of the easement east of and abutting Lot
20, less the northerly 30 feet thereof~ Sanford Central Park.
be and the same are hereby closed, vacated, and abandoned.
SECTION 2: If any section or portion of a section of this ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effec~
of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and
the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its passage
