3466 ORDINANCE NO. 3466
AMENDING CHAPTER 2, ARTICLE XIII, NUISANCE
ABATEMENT BOARD, SECTION 2-201(b) ENTITLED
"MEMBERSHIP"; INCREASING MEMBERSHIP FROM FIVE (5)
TO SEVEN (7), TO ADD AN ALTERNATE MEMBER, AND TO
CHANGE THE QUORUM FROM THREE TO FOUR;
PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA THAT
CHAPTER 2, ARTICLE XIII OF THE CITY OF SANFORD CODE OF ORDINANCES IS
HEREBY AMENDED AS FOLLOWS:
SECTION 1: Section 2,201(b) of Chapter 2, Article XIII, Public Nuisance Abatement
Board, is hereby deleted in its entirety and a new Section 2,201(b) is hereby created and shall read
as follows:
(1) The City Commission shall appoint a seven (7) member board to serve without pay.
(2) The terms of the initial members of the board shall be staggered, with three (3)
members appointed for a term of two (2) years; two (2) members appointed for a term
of one (1) year; thereafter, all terms will be for two (2) years, The City Commission
may appoint one (1) alternate member to the Nuisance Abatement Board to serve on
the Board in the absence of Board members.
(3) The board shall elect a chairperson and a vice-chairperson and may conduct business
with a quorum of four (4) members. If any member fails to attend two (2) of three
(3) successive meetings without cause and without prior approval of the Chairperson,
the Board shall declare the member's office vacant and the City Commission shall
promptly fill such vacancy. Appointments to fill any vacancy shall be for the
remainder of the unexpired term of office. The members shall serve in accordance
with ordinances of the City Commission and may be suspended and removed for
misconduct in office or neglect of duty.
SECTION 2: Codification. That Section 1 of this Ordinance shall be codified and made a
part of the City Code of Ordinances.
SECTION 3: Severability. If any section or portion of a section of this ordinance proves
to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of
any other section or part of this ordinance.
SECTION 4: Conflicts. That all ordinances or parts of ordinances in conflict herewith be
and the same are hereby revoked.
SECTION 5: Effective Date. This Ordinance shall become effective i.mmediately upon its
passage and adoption.
