3490 ORDINANCE NO. 3490 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, TO ANNEX WITHIN THE CO~O~TE AREA OF THE CI~ OF SANFORD, UPON ADOPTION OF SAID ORDINANCE, A PORTION OF THAT CERTAIN PROPER~ LYING BETWEEN VIHLEN ROAD EXTENDED WESTERLY AND ~ WOrNALL DRIVE AND BE~EEN LOWE AVENUE AND UPSALA ROAD; IN ACCORDANCE WITH THE VOLUNTARY ANNE~TION PROVISIONS OF SECTION 171.044, FLORIDA STATUTES; PROVIDING FOR SEVE~BILI~, CONFLICTS AND EFFECTIVE DATE. WHEREAS, ~ere has been filed with ~e Ci~ Cle~ of the Ci~ of Sanford, Florida, a petition conDinin~ ~he names of the prope~ owners in the area described hereina~er requestin~ annexation to the corporate area of ~e Ci~ of Sanford, Florida, and requestin~ to be included therein; and WHEREAS, ~e Prope~ Appraiser of Seminole Count, Florida havin~ ce~ified thac there is one prope~ owner in the area to be annexed and that said prope~ owner has si~ed the Petition for Annexation; and WHEREAS, it has been dete~ined that the prope~ described hereina~er is reasonably cornpat/and con~uous to the corporate areas of the Ci~ of Sanford, Florida, and it has ~er b~n dete~ined that the anne~on of said prope~ will not result in the creation of any enclave; and WHEREAS, ~e Ci~ of Sanford, Florida, is in a position to provide municipal serfices to the prope~ described herein, and ~at the Ci~ Commission of the Ci~ of Sanford, Florida, deems it in the best interest of ~e Ci~ to accept said peti~on and to annex said prope~. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CI~ OF SANFORD, FLORIDA: SECTION 1: That the properly described below, situated in Seminole Courf~, Florida, be and the same is hereby annexed to and made a part of the City of Sanfoifi, Florida, pursuant to the voluntary annexation provisions of Section 171.044, Florida r~ Statutes: r-- Lot Z]0, New Upsala, according to Plat Book 1, Page 67, Public Records of Seminole County, Florida. SECTION 2: That upon this Ordinance becoming effective, the property owner and any residents on the property described herein shall be entiUed to all the rights and privileges and immunities as are from time to time granted to residents and property owners of the City of Sanford, Florida, as further provided in Chapter 171, Florida Statutes, and shall further be subject to the responsibilities of residence or ownership as may from time to time be determined by the goveming authority of the City of Sanford, Florida, and the provisions of said Chapter 171, Florida Statutes. SECTION Z]: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. SECTION 4: That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby revoked.
