The project was presented at the May 6, 2014 meeting. As part of the review process, the standards for consideration were reviewed. Standards for Consideration for Variances: Special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or buildings in the same district. The property is located in a Single Family Residential, SR-1AA zoning district. The required minimum side yard setback for an accessory structure in an SR -IAA zoning is 10 feet. The existing City utilities on the property have created a limited area in which a two car garage could be constructed. The applicant's proposed garage design includes garage doors on two sides for drive through access to the existing, City utilities. The literal interpretation of the provisions of the land development regulations would deprive the applicant of rights commonly enjoyed by other properties in the same district tinder the terms of the land development regulations. The current regulations would not allow the applicant to construct a 22' by 24'garage utilizing the existing concrete slab and providing drive through access to the existing City utilities. Both the location Ql'the utilities and the need for access encumber the use of the property, The special conditions and circumstances do not result from the actions of the applicant. The applicant is not responsible for the current location of the utilities on the property or the need for an easement or access to the utilities, Granting the variance will not confer on the applicant any special privilege that is denied by the land development regulations to other lands, structures, or buildings in the same district. Other properties in the area are permitted to install detached accessory structures. The design of the proposed gat -age will be consistent with the principal building in materials, color and architectural style. A detached gat -age will not adversely affecttct the neighborhood. The reasons set forth in the application justify granting the variance, and that the variance is the minimum variance that will make possible the reasonable use of the land, building, or structure. The applicant is proposing to construct a new 22 ' by 24'garage utilizing an existing concrete slab. The four foot side yard setback request is needed to leave afour .foot gap between the proposed garage and the existing house. The larger garage is needed to allow access to the utilities behind it. The granting of the variance will be in harmony with the general purpose and intent of the land development regulations and will not be injurious to the neighborhood, or otherwise detrimental to the public welfare.
