AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, r--
CLOSING, VACATING, AND ABANDONING THAT CERTAIN 14 rn
FOOT WIDE NORTH-SOUTH UTILITY EASEMENT LYING
BETWEEN MELLONVILLE AVENUE AND WASHINGTON COURT
AND BETWEEN EAST 24TH STREET AND EAST 25TH STREET/SR ''~ O'~
46/GENEVA AVENUE; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close,
vacate and abandon that certain 14 foot wide North-South utility easement lying
between MellonviHe Avenue and Washington Court and between East 24th Street and
East 25th Street/SR 46/Geneva Avenue; and
WHEREAS, a public hearing was held on January 5, 1995, for consideration
and determinations to whether or not the closing, vacating and abandoning of that
certain 14 foot wide North-South utility easement lying between MeHonville Avenue
and Washington Court and between East 24th Street and East 25th Street/SR
46/Geneva Avenue should be allowed; and
~_ CO WHEREAS, the City Commission has determined that the closing, vacating and
c~ abandoning of that certain property does not conflict with the Comprehensive Plan
~ ~ of the City of Sanford, Florida, and that the public health, economy, comfort,
~ ~- -~ order, convenience, and welfare will be promoted by such closing, vacating and
~- o ~ abandoning.
~o ~ NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
.. ~_~ SANFORD, FLORIDA:
SECTION 1: That certain 14 foot wide North-South utility easement lying
between Melionville Avenue and Washington Court and between East 24th Street and
East 25th Street/SR 46/Geneva Avenue, more particularly described as follows:
~ The East seven feet of Lots 162, 163, and 164, SANFO
o PARK, according to the plat thereof, as recorded in Plat
= Book 5, Page 62, of the Public Records of Seminole
~ CO County, Florida;
o 7 AND
~ The West seven feet of Lots 19, 20, and 21, Block 1, WYNNEWOOD,
~co according to the plat thereof, as recorded in Plat Book 4, Pages 92-94,
~0 CO of the Public Records of Seminole County, Florida,
~ o "~ be and the same is hereby closed, vacated and abandoned.
~ c~ = SECTION 2: If any section or portion of a section of this ordinance proves to
be invalid, unlawful or unconstitutional, it shah not be held to impair the validity,
~= force or effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby revoked.
SECTION 4: That this ordinance shah become effective immediately upon its
passage and adoption.
