CLERK O~ClRCUIT COURT ' RECORDED &~,~ERIFIED 8 i 8 15 96 MAR 262: 0 ORDINANCE NO. 3292 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THAT CERTAIN 1S FOOT WIDE NORTH-SOUTH DRAINAGE EASEHENT LYING ON THE WESTERLY PORTION OF THE PROPERTY AT 126 PAHALA COURT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE, WHEREAS, an application has been filed wiffi the City of Sanford to close, vacate and abandon that certain 15 foot wide north-south drainage easement lying on the westerly portion of the property at 126 Pamala Court; and WHEREAS, a public headng was held on February 26, 1996, for consideration and determination as to whether or not the closing, vacadng and abandoning that certain 15 foot wide north-south drainage easement lying on the westedy portion of the properly at 126 Pamala Court; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and ~at the public health, economy, comfort, order, convenience, and welfare will be promoted by such dosing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SAN FORD, FLORIDA: SECTION 1: That certain 15 foot wide north-south drainage easement lying on the westerly potdon of the properly at 126 Pamala Court, more particularly described as follows: All of that certain 15 foot wide drainage easement lying along the west side property line of Lot 1 q-, Pamala Oaks SubdNision, according to the plat thereof as recorded in Plat Book ~7, Pa~e 46, of the Public Records of Seminole County, Florida, C'~ be and the same is hereby closed, vacated, abandoned. SECTION 2: If any section or portion of a section of this ordinance proves b invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become effective immediately upon its passage and adoption.
