FINDINGS OF FACT Property Owner: Nation Oak Avenue 11, LLC Mark A. Nation, Manager 570 Crown Oak Centre Drive Longwood, Florida 32750 - Applicant: David J. Smith David J. Smith, Inc. 1612 White Dove Drive Winter Springs, FL 32708 Project: Approval of the HPB to enlarge the building by moving the back wall of the single story building revisions to a previously issued Certificate of Appropriateness. Requested Development Approval: The Applicant requested approval of the HPB to enlarge the building by moving the back wall of the single story building. Additional Findings: The project is located at 216 Oak Avenue in the City's Downtown Commercial Historic District. The project relates to a non-contributing masonry vernacular building which was constructed in 1974 as evidenced from the records of the Seminole County Property Appraiser. The property owner is requesting approval to expand the building by moving the back wall to the west to 3' from the rear terminus of the previously approved addition to the building to the north (214 Oak Avenue) The parapet would be extended as well, retaining the existing height and a second door would be added. The project has no visual impact from Oak Avenue and little visual impact from the rear or the 3rd Street view, and the existing parapet will be retained and extended. The introduction of a back door for service function is appropriate. CONCLUSIONS OF LAW (a). The conclusions of law in the prior Certificate of Appropriateness are hereby ratified and affirmed. (b). Pursuant to Section 8.0 of Schedule "S" of the City's Land Development Regulations (LDRs), the HPB has reviewed the proposed Certificate of Appropriateness and all application documentation and matters relating thereto in accordance with the procedures for altering historic landmarks or structures within historic districts as set forth in Schedule "S" of the City's LDRs. (c). Specifically, Schedule "S" of the City's LDRs provides as follows: (1). New buildings shall have a recognizable top consisting of, but not limited to, cornice treatment, roof overhangs with brackets, stepped parapets, richly textured materials and/or different colored I; 2 1 i' , - materials. Only when the change is appropriate the style and period of the building may doors be relocated, enlarged, reduced or introduced. (d). To the extent that a conclusion of law as set forth herein also constitutes a factual finding, then such shall be taken to be so as part of this Development Order. (e). The proposed Certificate of Appropriateness is hereby found and determined to comply with the aforestated. (f). Additionally, the Certificate of Appropriateness sought is hereby found and determined to be consistent with the City of Sanford Comprehensive Plan and development of the property as proposed would be consistent with and in compliance to applicable land development regulations and all other applicable regulations and ordinances as set forth in the Code of Ordinances of the City of Sanford. ISM NOW, THEREFORE, IT IS ORDERED THAT: (1). The aforementioned application for a Certificate of Appropriateness is APPROVED. (2). This Development Order granting approval of a Certificate of Appropriateness touches and concerns the aforedescribed property and is subject to code enforcement action in accordance with the controlling provisions of law. 31 Done and Ordered on the date first written below.
