3208 ORDINANCE NO. 3208 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING AN APPROVED PLANNED DEVELOPMENT PROJECT PLAN OF SAID CITY; SAID AMENDMENTS CHANGING THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING BETWEEN SR 46 AND ST. JOHNS PARKWAY AND BETWEEN INTERSTATE 4 AND RINEHART ROAD ZONED PD, PLANNED DEVELOPMENT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and adopted July 27, 1992, said Ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, Florida, regulating and restricting the location and use of buildings, structures, land, and water from trade, industry, residence or other purposed, be and the same is hereby amended as follows: PARCEL A: Begin at the NE intersection of Towne Center Blvd and St. Johns Parkway; thence run Niy and Ely along said Towne Center Blvd to an intersection with the S R/W of State RD 46, said point being a Point of Tangent; thence run N 82°20'10" E, 216.00 feet; thence S 07°39'48'' E, 10 feet; thence N 82°20'10"E 139.21 feet to a point Of curvature; said curve is concave to the right having a radius of 1800.08 feet, run through a central angle of 06026'43" and an arc length of 202.50 feet; thence run S 00°07'11" W, 329.52 feet; thence run S 87°59'22 W, 268.63 feet; thence run S 00°48'16'' E, 820.35 feet to a point of curvature concaved to the left having a radius of 170.00 feet, run through a central angle of 75°01'52'' and having a arc length of 222.62 feet; thence run N 89°37'39'' E, 140.03 feet; thence run S 00°22'21" E, 272.91 feet; thence run S 89037'39" W, 20.00 feet; thence run S 00°22'21" E, 225.00 feet; thence run S 19°35'42'' W, 224.22 feet to a point of the Nly R/W of said St. Johns Parkway; thence run Wly along said Nly R/W to the P.O.B.; containing 29.8 acres, more or less. PARCEL B: Begin at the SW corner of the SE 1/4 of the NE 1/4 of Section 29, Township 19 South, Range 30 East, of Seminole County, Florida; thence run N 00°16'35'' W, 419.69 feet; thence run N 89°34'41'' E, 30 feet; thence run N 00°16'35'' W, 93.42 feet for a P.O.B.; thence continue N 00°16'35'' W, 490.66 feet to a point on the Sly R/W of State Road 46; thence run along said Sly R/W of State Road 46 to an intersection with the Wly R/W of Towne Center Blvd; thence run Sly and SWly to the P.O.B.; containing 1.49 acres, more or less. be and the same is hereby rezoned to PD, Planned Development and the Gateway Plaza Master Plan with Conditions and Stipulations is attached as Exhibit "A" and is incorporated herein by reference as if fully set forth herein. SECTION 2: Severability. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of any other section or part of a section of this Ordinance. SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: Effective Date. Sanford, Florida --2-- ordinance No. 3208 Exhibit "A" to the rezoning ordinance for the Gateway Plaza PD a. The project shall be developed substantially in accordance with the information, data, plans and commitments contained in the Master Plan entitled "Gateway P.D., City of Sanford, Submitted For Planned Development Approval, March 16, 1994" received by the City on March 17, 1994 and supplemental information unless otherwise directed by the recommendations enumerated below and as may be amended from time to time as provided by procedures set forth in the City's Land Development Regulations. b. A traffic circulation plan for the site shall be submitted with preliminary subdivision plan. Such plan shall reflect internal circulation within the overall site and as well as transportation requirements necessary to provide adequate circulation in the immediate area and between adjacent property. Cross access points shall be placed between the Gateway Plaza PD and the Northgate PD as generally reflected on the Master Plan, The construction of cross access points across the M.M, Smith Canal, i.e., bridges between the two developments, shall be shared on a fifty-fifty cost basis between the property owners of respective sides of the canal. Based on build-out, the City shall decide when such facilities shall be constructed and shall have the authority to require the construction of same. Failure to cooperate and participate in this requirement shall constitute a violation of the City's Land Development Regulations, specifically, the Development Plan Approval Process, and shall be subject to code enforcement procedures. c. Agriculture shall be a permitted land use prior to development of any tract or portion thereof. The term "agriculture" shall be as defined in the City of Sanford Land Development Regulations.
