3210 ORDINANCE NO. 3210 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING AN APPROVED PLANNED DEVELOPMENT PROJECT PLAN OF SAID CITY; SAID AMENDMENTS CHANGING THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING BETWEEN SR 46 AND RINEHART ROAD AND BETWEEN TOWNE CENTER BOULEVARD AND RINEHART ROAD ZONED PD, PLANNED DEVELOPMENT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That Ordinance No. 3117 of the City of Sanford, Florida passed and adopted July 27, 1992, said Ordinance being the Comprehensive Zonlng Ordinance of the City of Sanford, Florlda, regulating and restricting the location and use of buildings, structures, land, and water from trade, industry, residence or other purposed, be and the same is hereby amended as follows: Begin at the SE corner of the NE 1/4 of Section 29, Township 19 South, Range 30 East, Seminole County, Florida; thence run S.89°43'25"W., 125 feet for a Point of Beginning; said point being on the Wly R/W line of Rinehart Rd; thence run Sly along said Wly R/W line to an intersection with the Nly R/W line of St. Johns Parkway; thence run SWly along said Nly R/W line through a curve concaved to the right having a radius of 25.00 feet and having a central angle of 90000'00" for a distance of 39.27 feet to P.T.; thence continue along said Nly R/W line S.89°37'39"W., 79.02 feet to a P.C.; thence continue along said Nly R/W line through a curve concave to the right having a radius of 595.00 feet, through a central angle of 20055'47" for a distance of 217.35 feet; thence run N.19°35'42"E., 224.22 feet; thence run N.00°22'21"W., 225.00 feet; thence run N.89o37'39"E., 20.00 feet; thence run N.00°22'21"W., 272.91 feet to the center-line of Lockhart-Smith Canal; thence continue along said center- line S.89~37'39"W., 140.93 feet to P.C.; thence continue along said center-line through a curve concaved to the right having a radius of 170.00 feet through a central angle of 75°01'52'' for a distance of 222.62 feet; thence continue along said center-line N.00°48'16,,W., 820.35 feet; thence run N.87°59'22"E., 268.63; thence run N. 00°07'11"E., 329.52 feet to the Sly R/W of S.R. 46; thence Ely, Nly and Ely to an intersection with the said Wly R/W of Rinehart Rd; thence run Sly along said Wly R/W of Rinehart Rd to Point of Beginning; AND ALSO begin at the SW intersection of Rinehart Rd and St. Johns Parkway; thence run Sly along the Wly R/W of said Rinehart Rd S00°22'21"E., 435.87 feet; thence run S.89°47'58-W., 494.26 feet; thence run N.00°17'42"W., 520.00 feet; thence run S.89°47'58"W., 639.93 feet to a point on the Ely R/W of Towne Center Blvd; thence run along said Ely R/W to an intersection with the Sly R/W of said St. Johns Parkway; thence run along said Sly R/W Ely to the Point of Beginning. be and the same is hereby rezoned to PD, Planned Development and the "Northgate P.D., City of Sanford, Submitted For Planned Development Approval, March 16, 1994" with Conditions and Stipulations is attached as Exhibit "A" and is incorporated herein by reference as if fully set forth herein. SECTION 2: Severability. If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect of any other section or part of a section of this Ordinance. SECTION 3: Conflicts. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: Effective Date. Sanford, Florida --2-- Ordinance No. 3210 Exhibit "A" to the rezoning ordinance for Northgate PD a. The project shall be developed substantially in accordance with the information, data, plans and commitments contained in the Master Plan entitled "Northgate P.D., City of Sanford, Submitted For Planned Development Approval, March 16, 1994" received by the City on Mamh 17, 1994 and supplemental information unless otherwise directed by the recommendations enumerated below and as may be amended from time to time as provided by procedures set forth in the City's Land Development Regulations. b. A traffic circulation plan for the site shall be submitted with the preliminary subdivision plan. Such plan shall reflect internal circulation within the overall site and as well as transportation requirements necessary to provide adequate circulation in the immediate area and between adjacent property. Cross access points shall be placed between the Gateway Plaza PD and the Northgate PD as generally reflected on the respective Master Plans. The construction of cross access points across the M.M. Smith Canal, i.e., bridges between the two developments, shall be shared on a fifty-fifty cost basis between the property owners of respective sides of the canal. Based on build-out the City shall decide when such facilities shall be constructed and shall have the authority to require the construction of same. Failure to cooperate and participate in this requirement shall constitute a violation of the City's Land Development Regulations, specifically, the Development Plan Approval Process, and shall be subject to code enforcement procedures. In addition to cross-access points provided for on the Northgate Master Plan, cross access shall be provided between Tracts 2/3 and Tract 4. c. Agriculture shall be a permitted land use prior to development of any tract or portion thereof. The term "agriculture" shall be as defined in the City of Sanford Land Development Regulations.
