AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING THAT CERTAIN
PORTION OF ELDER ROAD LYING BETWEEN RINEHART ROAD
AND UPSALA ROAD AND BETWEEN FIFTH STREET AND WILSON
AVENUE EXTENDED EASTERLY; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sa~ord to c~e~
art ~
vacate and abandon that certmn portion of Eider Road lying between Rlneh .
and Upsala Road and between Fifth Street and Wilson Avenue extended ~sterly; and
WHEREAS, a public hearing was held on September 12, 1994, for considera~on
and deterSnations to whether or not the closing, vacating and abandoning of that
cert~n portion of Eider Road lying between Rinehart R~d and Upsala Road and
between Fifth Street and Wilson Avenue extended Easterly should be allowed; and
WHEREAS, the City Commission has deterSned that the closing, vaca~ng and
abando~ng of that cer~n property does not co~Hct ~th the Comprehensive Plan
of the City of Sa~ord, Florida, and that the public health, economy, cohort,
order, conve~ence, and webare ~11 be promoted by such closing, vacating and
abando~ng.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That cert~n North-South Road right-of-way, more particularly
described as follows:
That certain north-south r~d right-of-way lying between
Lots 38 ~d 39, also between Lots 42 and 43 as shown on
M.M. S~th's TMrd Subdivision according to the plat
thereof as recorded in Plat Book 1, Page 86 of the Public
Records of Se~nole County, Flo~da,
be and the same is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of this ordinance proves to
be invalid, unlawful or unconstitution~, it shall not be held to impair the validity,
force or effect of any other section or part of t~s ordi~nce.
SECTION 3: That all ordinances or parts of ordi~nces in co~ct herewith
be and the same are hereby revoked.
SECTION 4: That t~s ordinance shall become effective immediately upon its
passage and adoption. = ~.
