3175 ORDINANCE NO. 3175 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTIONS 16-3, TERM; PENALTY FOR DELINQUENCY AND 16-4, APPLICATION OF LICENSE TRANSFER OF THE SANFORD CITY CODE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, it is the desire of the Sanford City Commission to amend Sections 16-3, Term, Penalty for Delinquency and 16-4, Application of License Transfer of the City Code of Sanford, Florida, NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: Section 16-3, of the City Code of Sanford is hereby amended to read as follows: SECTION 16-3. Term, penalty for Delinquency. Except as otherwise provided, no license required by this Chapter shall be issued for more than one year, except when issued for a half year, day, month or quarter, as the case may be. All licenses shall be issued beginning August first of each year, shall be due and payable on October first of each your and shall expire on September thirtieth of the succeeding year. Those licenses not renewed by October first shall be considered delinquent and subject to a delinquency penalty of ten (10 ) per cent for the month of October plus an additional five (5) per cent penalty for each month of delinquency thereafter until paid; provided that the total delinquency penalty shall not exceed twenty-five (25) per cent of the occupational license fee for the delinquent establishment. Those persons who engage in any business, profession, or occupation and have not paid their occupational license renewal fees within 150 days after the initial notice of tax due shall be subject to an additional penalty of $2500.00. SECTION 16-4. Application of license; transfer. Licenses shall be good only for the particular business at the particular place of business which shall be named therein and for the person to whom issued. Licenses may be transferred to a new owner when there is a bona fide sale of the business upon application to the tax collector and payment of the transfer fee of up to ten (10) per cent of the annual license tax, but not less than three dollars ($3.00) nor more than twenty-five dollars ($25.00) and presentation of evidence of the sale and the original license. Upon written request and presentation of the original license, any license may be transferred from one location to another location upon payment of a transfer fee of up to ten (10) per cent of the annual license tax, but not less than three dollars ($3.00) nor more than twenty-five dollars ($25.00). SECTION 2: The Code of Ordinances of the City of Sanford, Florida be and the same is hereby amended in accordance with the terms, provisions, and conditions of this Ordinance. Further, that the sections of this Ordinance may be tenumbered or relettered to accomplish said amendment and the word "Ordinance" may be changed to "Section", "Article", or any other appropriate word. SECTION 3: If any section or portion of a section of this ordinance provides to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: That this ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this//~ day of~tg/L , A.D., 1993.
